A regular meeting of the Southold Town Planning Board was
held August 30, 1976, at 7:30 p.m. at the Town Clerk's Office,
Main Road, Southold, New York.
Present were:
John Wickham, Chairman
Henry Raynor, Vice-Chairman
Frank S. Coyle
Frederick Gordon
Kirchgessner minor subdivision. William Wickham, Esq. appeared.
Mr. Wickham said he had gone to the Board of Appeals and they
had given approval of the undersized lots. He had originally
presented a 55 foot road and was criticized by the Board of
Appeals so he had the road cut down to 35 feet. The members
will check to see where the roads go along with Norris.
Simon minor subdivision. William Wickham, Esq. appeared.
They are looking for a minor subdivision of three lots on the
southerly end of the farm. It is the Charles Simon Estate.
The board requested covenants that the other property would
come in as a major subdivision in the future. This covenant
would run with the property. Anything over 40,000 square feet
the board would require a covenant that it could not be
resubdivided. The distance is to be checked from Wells Road to
Richmond Creek to see if it is within the County jurisdiction.
Hill Crest Estates~ Section I. Ernest Wilsberg appeared.
Mr. Coyle said it has to be 100 foot back from the bluff, but
Mr. Raynor said there is no bluff. The County will make a
determination. The lots are not 150 foot wide at the building
line on the Sound. There cannot be seven lots across. Mr.
Wickham discussed leaving the lots the way they are and going
for a cluster. This amounts to a variance without going to the
Board of Appeals. They will probably need a little bit bigger
parking area for park and playground.

Bayley minor. Rudy Bruer, Esq. and Robert Bayley appeared.
The County letter was read that disapproved the map. Mr. Bruer
presented copy of recorded covenants not to further subdivide
the property. Lot #4 will be restricted so it can only use the
right-of-way for ingress and egress. This will also be used by
Lot #3. No access will be put on the map. The road will be
renamed right-of-way with notation for possible future dedication
to the Town of Southold. A notation will be put on the map for
no further subdivision.
Olympia Kouros. Mr. Bruer appeared.
Mr. Bruer again asked if the leg on the one lot couldn't be some
time in the future conveyed to an adjacent property owner with
the stipulation that it can never have a residential house on it.
Maude Morgan. Helen Reiter appeared.
Mrs. Reiter was told to have Mrs. Morgan check to see if she can
buy an additional 15 feet of right-of-way from Mikayan in order
to subdivide this property or wait until the Mikayan property is
subdivided.
Frank J. Murphy. Frank Murphy appeared.
The Chairman was annoyed that Mr. Catalano is selling this
property piecemeal. Mr. Murphy wants to make a minor subdivision
to the south on this property and use the remaining open farm
acreage to plan Christmas trees for his nursery. He said it
will remain in this use for at least 15 years.
Greenbriar Acres. Richard Cron, Esq. appeared.
Mr. Cron presented 2 linen maps and 5 paper maps of the final map
of this subdivision and requested a public hearing.
Lu~lio. Richard Cron, Esq. appeared.
Dot in 100 foot turnaround on Section I and make lines denoting
Section I at right angles. Show meadowland on the map. If
Freedom Court going to the Main Road is eliminated, the piping
will not be necessary as advised by the Town Engineer. Relocate
the recharge basin as it appears it is located in the wetlands.

San Simeon by the Sound. George Koch, Pastor Coleman and a
delegation from the Lutheran Church appeared.
Mr. Raynor was annoyed because he had not seen the variance
requests and the color-coded map before the meeting. Mr. Koch
said he had submitted them to Mr. Terry and was told by Mr.
Terry that he would submit them to the Planning Board. This was
done about a week ago. There are 18 variances, each submitted
separately. They are variance requests for setbacks and front
yard parking. There is one exception request for the "Inn".
This is scheduled for hearings by the Board of Appeals on September
15th. Mr. Koch presented one color-coded copy of the plan to
the Planning Board and a copy of the Sections and said he would
supply another copy to the Board of Appeals.
Jo~na Ski minor.
Mr. Raynor reported that John Ski wants to make a three lot
subdivision on five acres in Fishers Island. He suggested that
members of the Planning Board go to Fishers Island in the near
future to look at this property and discuss it with Mr. Ski. It
seems Mr. Ski has stockpiled loam which he wishes to sell off
the subdivision.
Motion was made by Mr. Coyle, seconded by Mr. Wickham and
carried that Henry Raynor and Frederick Gordon, i~he is able,
go to the New York State Planning Conference in October at
Monticello. It was suggested that the secretary also go on this
trip.
On motion made by Mr. Raynor, seconded by Mr. Gordon, it was
RESOLVED to approve the minor subdivision of property known
as "Rod 'n' Reel Estates Co." at Arshamomaque, dated June 4, 1976,
subject to receipt of filed covenants and restrictions that this
property will not be further subdivided.
Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon.
On motion made by Mr. Coyle, seconded by Mr. Raynor, it was
RESOLVED to grant an extension until September 20 to take
action on the subdivision known as "Southold Gardens", owned by
Babcock & Rimmler, at the request of the attorney for the
developer.

Ted Dowd subdivision.
The Chairman said he had reviewed the recommendations on drainage
which were submitted by Charles Barnett of the Soil & Water
Conservation Service of the Dept. of Agriculture. The rest of
the board will make a review and take action at the next meeting.
On motion made by Mr. Coyle, seconded by Mr. Gordon, it was
RESOLVED that the Planning Board of the Town of Southold
concurs with the position of the Village of Greenport as regards
dredging of Fordham Canal and a letter be sent to the Tidal
Wetlands Permit Administrator indicating same.
Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon.
On motion made by Mr. Wickham, Seconded by Mr. Raynor, it was
RESOLVED to recommend to the Southold Town Board approval
of proposed Local Law to amend Chapter 100 (Zoning) of the Code
of the Town of Southold in relation to the exclusion of dwelling
units in certain use districts and to redefine the terms Public
Water and Public Sewer.
Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon.
On motion made by Mr. Coyle, seconded by Mr. Raynor, it was
RESOLVED to disapprove the change of lot lines on minor
subdivision of Jonathan Stern because the change creates two
substandard lots because they do not have the required 150 width
at the building line.
Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon.
Andersen.
No action was taken on this minor subdivision as the Board would
like to study it further.
Christine King minor subdivision.
On motion made by Mr. Raynor, seconded by Mr. Gordon, it was
RESOLVED to approve the sketch map of the subdivision of
property of Christine King and to set a date for a public hearing
on same.
Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon.

Dawn Estates.
On motion made by Mr. Raynor, seconded by Mr. Coyle, it was
RESOLVED to recommend to the developer of Dawn Estates that
this property be developed as a major subdivision.
Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon.
Blue Dolphin site plan.
The Blue Dolphin owned by Spinthourakis would like to put a second
floor on their existing motel ~nit for four additional units.
The Planning Board will require information as to what district
this property is in; how much total area the property has; how
many units there are presently; front, side and rear profiles of
the proposed building; square footage in each proposed unit;
information as to whether there are fire escapes for the second
story.
On motion made by Mr. Raynor, seconded by Mr. Gordon, it was
RESOLVED to approve the final map of subdivision known as
"Paradise by the Bay" owned by John E. Rath, subject to the
following:
1. Recommendations of the Suffolk County Department of
Planning.
2. Written approval of the Highway Superintendent and Highway
Committee as to waiving of curbs in the subdivision.
3. Acceptance of the performance bond by the Southold Town
Board.
Receipt of inspection fee by the Town of Southold.
5. Resolution of any drainage problems.
Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon.
Heritage Harbor (Riverside Homes).
A drainage report on this subdivision has been submitted by
Young & Young, Engineers. This will be forwarded to the Planning
Board for their study and recommendations.
On motion made by Mr. Raynor, seconded by Mr. Gordon, it was
RESOLVED to hold a public hearing on the minor subdivision
of property known as "Laurel Acres" owned by Hans Rein and the

Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon.

On motion made by Mr. Coyle, seconded by Mr. Raynor, it was
RESOLVED to approve the site plan received August 30, 1976
of "San Simeon by the Sound" subject to the Board of Appeals
granting variances for front yard parking and setbacks and
granting a special exception for the "Irn~".
Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon.

Mr. Raynor made a motion, seconded by Mr. Gordon and carried
to approve the minutes of the meetings of August 2, 1976 and
August 17, 1976.

Gehlmeyer site plan for parking.
Mr. Gehlmeyer will be informed that he needs a lighting schedule,
planting schedule, parking schedule drawn to scale.
Motion was made by Mr. Coyle, seconded by Mr. Raynor and
carried that the meeting be adjourned. Meeting was adjourned at
12:00 a.m.
