A regular meeting of the Southold Town Plauning Board was
held on November 15, 1976 at 7:30 p.m. at the Town Clerk's
Office, Main Road, Southold, New York.
Present were:
John Wickham, Chairman
Frederick E. Gordon
James Wall
Absent were:
Henry E. Raynor, Jr. - ill
Frank S. Coyle - out of town
Barbara A. Howard minor subdivision.
Mr. Gordon read the legal notice for the public hearing
for approval of this minor subdivision. He presented proof of
publication in the Long Island Traveler - Watchman.
Mr. Wickham: Since it requires no highways, we have no letter
from the Town Superintendent of Highways. The file is complete.
Does anyone wish to be heard in opposition to this subdivision?
Hearing none, does anyone wish to be heard in favor of this
subdivision? Hearing none, I will declare the hearing closed.
Dan Smith. Mr. Smith appeared.
Mr. Smith would like to divide his property on North Bayview
into two lots and sell a small piece on the north of the
property to Peter Bogovic to round off his property. Mr. Smith
will bring into the Planning Board office a copy of a letter he
received from DEC and from the Town Attorney, Robert Tasker, Esq.
He was told that it will be necessary for him to present a map
just showing the present minor subdivision he is applying for.

Centennial Manor~ Section I - Luglio and others. Mr. Cron appeared.
Mr. Ben Orlowski appeared.
Mr. Gordon read the notice of public hearing for the preliminary
map of this subdivision and presented proof of publication in the
Long Island Traveler - Watchman.
Mr. Wickham: For the record, I want it noted that we do not have
a letter from the Superintendent of Highways at this time. Does
anyone wish to speak in opposition to this subdivision? Hearing
none, I will call for anyone that wishes to speak in favor of
this subdivision.
Mr. Cron: I am appearing on behalf of the developers of this
subdivision and I would respectfully request that the Board grant
the preliminary approval of the map with the understanding that
a couple of revisions be made. One is with respect to squaring
off the recharge basin and a recommendation from the Town Engineer
and Superintendent of Highways as to how they want the road laid
out to Stillwater Avenue, so after hearing from the County
Planning, we can proceed. I think Section I meets the requirements
of the subdivision regulations of the Town of Southold.
Mr. Wickham: Does anyone else wish to be heard in favor of this
subdivision? Hearing none, I will declare this part of the
hearing closed.
Mr. Wickham explained to Mr. Cron that this will have to go to
the Suffolk County Planning Commission and a permit will be
required under the Town Wetlands Ordinance if any change is going
to be made in the wetlands, any changes proposed in the arm of
the creek, a permit from the Town Trustees will be required. Mr.
Cron said he didn't think the subdividers had any intention of
doing that.
The following letter from the Suffolk County Department of
Planning under date of November 4, 1976 was read.
Dear Mr. Wickham:
The Suffolk County Planning Commission at its regular meeting
November 3, 1976, reviewed the above captioned proposed
subdivision plat referred to it pursuant to Section 1333, Suffolk
County Charter. After due study and deliberation, it did take
the following action.
The Map of Greenbriar Acres, as submitted, was approved
subject to the meeting of the following conditions which are
necessary to help preserve the traffic safety and carrying
capacity of the state road and also to prevent the creation of a
procedurally defective minor subdivision.

1. Redesign of southeast portion of the map to eliminate
access from Lot i to Main Road.
2. Requiring dry wells at all roof leaders on Lots 1 - 5
inclusive.
3. Since the two lots fronting on Main Road were originally
part of the tract and the creation of these two lots out of the
original tract constitutes a subdivision, a subdivision map
creating these lots shall be referred to the Commission in
accordance with the provisions of the County Charter to avoid
the creation of a subdivision that is procedurally defective.
The Commission also offers the following comments on the map:
The creation of the cross street formed by the intersection
of Elijah's Lane and Birchwood Road and the location of Woodfield
Court relative to the private road serving "Tut's Acres" should
be reconsidered due to the potential traffic safety problems that
they may create.

Subdivision Review Section
No one considered one lot with access on the State Road was
too much and Mr. Cron was told to bring in a minor subdivision of
the property mentioned. He will have Young & Young check to see
if the road to Suter's property does not, in fact, line up as that
was the intention of the developer.
Soundwood Farm. Mr. Cron discussed this subdivision briefly and
will send in maps to the Plamaing Board at a future date.
Cutchogue Joint Ventures. Mr. Cron discussed this briefly and
will send in maps in the near future.
Simon minor subdivision. Mr. William Wickham, attorney for the
developer, discussed this subdivision. Mr. Wickham presented two
declarations, one having to do with no further subdivision of the
lots shown on the minor subdivision map and the other that if any
other property is developed, it will come in as a major subdivision
to be approved by the Planning Board. The latter was discussed
by Mr. Wickham and Mr. Tasker and Mr. Wickham said that Mr. Tasker
had approved of this covenant. Mr. Wickham, chairman, said that
the Plan~ing Board requires that there be a notation on the map
that this property will not be further subdivided.
Kirchgessner. William Wickham, Esq. appeared. There was some
discussion about a twenty foot jog.

Hale and Hughes minor subdivisions. Irving L. Price, Jr., Esq.,
appeared. Mr. Price requested sketch plan approval and a resolution
for a public hearing on the map.
On motion made by Mr. Gordon, seconded by Mr. Wall, it was
RESOLVED to grant sketch plan approval to the map of the
minor subdivision of ~roperty of Phyllis Hale located in Orient,
and a public hearing be held on approval of it.
Vote of the Board: Ayes: Wickham, Gordon, Wall.
On motion made by Mr. Gordon, seconded by Mr. Wall, it was
RESOLVED to grant sketch plan approval to the map of the
minor subdivision of property of Barbara Hughes located in Orient,
and a public hearing be held for approval of it.
Vote of the Board: Ayes: Wickham, Gordon, Wall.
Mr. Gordon made a motion, seconded by Mr. Wall and carried
to approve the minutes of the regular meeting of October 25, 1976.
Mr. Wickham signed the minutes as approved.
The following letter was read regarding the Shackman
minor subdivision in Laurel, under date of November--~--gT~76
Dear Sirs:
In reply to yours of the 29th relative to the Laurel
Cemetery Association. I have contacted officers of the association
and although we might be interested in acquiring additional land,
we do not have the necessary funds to make such a purchase.
We fully appreciate the opportunity you of the Planuing
Board have given us and we thank you for it.

The following letter under date of November 10, 1976 was read.
Gentlemen:
Transmitted herewith for your report and recommendation
are suggested amendments to the Code of the Town of Southold by
the Southold Town Baymen's Association, Inc., copy attached.

On motion made by Mr. Gordon, seconded by Mr. Wall, it was
RESOLVED to authorize the Chairman to sign the map of the
minor subdivision of John Simicich.
Vote of the Board: Ayes: Wickham Gordon, Wall.
Estate of Piccione. The letter from the Suffolk County Planning
Commission was presented where this is left to local
determination. The covenants and restrictions may now be filed
in this matter and the map will then be signed.
Paradise by the Sound (formerly Time Structures, Inc.) Roger Rath
and Frederick J. Ziems, Esq., appeared.
George Stankevich, Esq. apparently had left off twelve copies of
the map and profiles some time Monday morning. These maps have
been again revised and Mr. Rath will be in some time during the
week to present the 12 revised copies. It seems the profiles will
be the same. 100 foot setbacks from the bluff will be required
by the County and the Town and Mr. Rath will check with the
engineer to see if there is sufficient room to put in a good sized
house on the Sound as it stands. The road could be pushed further
south, if necessary to make more acreage in the waterfront lots.
Heritage Harbor (Riverside Homes)
Mr. Hills had mailed in six copies of the revised map on this
property showing three catch basins as required by the Town
Engineer. These catch basins are shown in the town road and it
is improbable that the Town would allow this to be done. The
catch basins will have to be shown on the developers property.
Richard Miller (formerly Catalano). A gentleman had been into
the office that wanted to buy 150 feet on the road (Aldrich Lane).
He had been referred by the Building Department because this
isn't a subdivision. The Planning Board wants his intentions
in writing that he does not plan to resubdivide this property.
They also want something from Mr. Miller as to what he intends
to do with the rest of the property.
Winds Way site plan. The revised site plan has been presented
and it was tabled until the next meeting.

Hodor & Staller minor subdivision. The map was reviewed. This
is a three-lot minor subdivision with large acreage on the
County Road. Covenants will be required that this property will
not be further subdivided plus a statement on the map to that
effect.
KOA. The regrading of this property was mentioned and one of
the tow~ engineers will be instructed to go down and see what
they are doing.
Motion was made by Mr. Gordon, seconded by Mr. Wall and
carried that the meeting be adjourned. Meeting was adjourned
at 10:45 p.m.
