MINUTES
SOUTHOLD TOWNPPLANNING BOARD
July 8, 1974
A regular meeting of the Southold Town Planning Board
was held at 7:30 p.m., Monday, July 8, 1974, at the Town
Clerk's Office, Main Road, Southold, New York.
There were present: Messrs. John Wickham, Chairman;
Henry Moisa, Vice-Chairman; Henry Raynor and Frank Coyle.
Mr. Grebe was not in attendance.
Page 15 of the minutes of June 24, 1974 were to be
amended to read Southold Town Fire Districts Officers Asso-
ciation instead of Orient Fire District.
The Secretary was directed to ask Howard Terry, Building
Inspector, to check the site plan against the building
orientation of the present structures of the Naugles Dock
property.
Inlet East. Donald Denis appeared.
Mr. Wickham read the following letter dated June 18, 1974
to the Southold Town Planning Board from the Subdivision
Review Section of the Suffolk County Department of Planning.
Dear Mr. Wickham:
In accordance with your request, the staff has considered
the above captioned proposed subdivision map and offer the
following comments on it for your use:
1. The overall layout is considere to~'~b~satisfactory.
2. Consideration should be given t~ leaving d~a~nage
area below outfalls in natural state to blow down veloclt~y~
of storm-water and increase absorption. -

3. Date will be required at time of referral on:
a. storage capacity of storm drain on Harborview
Avenue (drainage cales).
b. treatment of down stream area of easement
(ultimate disposal).
Staff comments on a preliminary map do not constitute
a review. When this map is in the final state of prepara-
tion, it should be referred to the Suffolk County Planning
Commission for review pursuant to Section 1333 of the Suffolk
County Charter.

Mr. Denis said he had had the water tested and approved and
he will send the results to us. In regard to number 3 of the
County letter, Mr. Denis felt it was shown on page 3. of the
maps. It was decided to ask the Superintendent of Highways
what he wants on the bottom of the swale area on Harborview
Avenue to the west of the steel pipe~in the drainage easement~
The possibility of two rings instead of one on the catch
basins was discussed.
Crown Land Lane. Mr. Edson appeared.
Mr. Edson: Environmental said they are not going to approve
the maps because of the jurisdictional difficulty between
them and the Board of Health. I am asking you tonight for
permission to redo the map on a standard basis.
Mr. Edson was asked by the Board tow rite a letter indicating
the problem he has had with the County in securing a cluster
development approval from them, and how the situation stands
now. The Board will try to do something.
Nick Pappas. Dom Aurichio, Esq. appeared.
Mr. Aurichio indicated that Mr. Morris would alternate the
right of way he has for the road that will be put in. The
Board felt that Mr. Morris should ~et more width in the right
of way from the proposed road to his property. Mr. Aurichio
will have to get a right of way agreement from Mr. Morris.
Crescent Beach. Mr. Kavanaugh and Rudy Bruer, Esq. appeared.
A sketch was shown giving more property to each house. Mr.
Kavanaugh proposed putting aside 20,000 square feet for his
own house and outbuildings with the proposed road going through
the middle of this set aside property. The Board suggested~

that he have the road go around his property, at a width of
fifty feet from Maple Lane to the property line in case of
a possible hookup in the future. The Board also said they
would want a copy of the restrictions on the property.
Peconic Homes, Inc. Greton Estates. John Fryer, Esq., two
Horton brothers and two Grefe brothers appaared.
Mr. Fryer said the problem of the southern boundary had been
resolved and the title company had insured the title of the
property as shown on the map. The lis pendens has been dis-
continued and the property is owned by the Horton brothers and
the Grefe brothers. Mr. Fryer presented the Board with the
test well report and he was instructed to supply the Board
with road profiles, the drainage structure and contours
including 300 feet outside the property. He was also to
find out if the property is within 500 feet of the creek.
Mike Tsontos. Leisure Oaks, Factory Ave. condominiums.
Mr. Tsontos and Steve Tsontakis appeared.
Mr. Tsontos was advised to put in a couple of test wells for
water and to talk to the Board of Health to see if his plan
would be advisable in this area.
Highland Road Corporation. Richard Lark, Esq., Howard Young,
Mr. Piscatello and Mr. Mohring appeared.
The Board again indicated they would be happier if a loop road
were put in instead of the cul-de-sacs. Mr. Wickham read a
letter from the Superintendent of Highways saying he approved
of the road layout. Mr. Young said a loop road would cost one
lot and cause a drainage problem.O The cul-de-sacs would also
distnrb less of the woods. Mr. Lark was also directed to get
test well reports.
Mr. MoiSa acted as chairman. On motion made by Mr.
Wickham, seconded by Mr. Coyle, it was
RESOLVED that the preliminary map of the subdivision
Orient Point located at Orient, New YOrk, be approved subject
to any county requirements.

On motion made by Mr. Wickham, seconded by Mr. Coyle,
it was
RESOLVED that a public hearing be held on August 5,
1974, on the matter of the preliminary map of subdivision
known as Soundview Acres at Orient, New York, owned by
Albert E. Cinelli and Carl G. Hornwood.
Vote of the Board: Ayes: Wickham, Coyle, Raynor, Moisa.
On motion made by Mr. Wickham, seconded by Mr. Raynor,
it was
RESOLVED that the Southold Town Planning Board recommend
to the Southold Town Board denial of the petition of Louis
Zaino and Armando Sardelli requesting a change of zone on
certain property situated at Peconic, New York, from "A"
Residential and Agricultural District to "B-$" General Busi-
ness District. This petition seems to be based on the
illegality of the zoning law. To the best of the knowledge
and belief of the Southold Town Planning Board the zoning
laws of the Town of Southold are constitutional and were
adopted after due process and the Southold Town Planning Board
feels that the existing use of the property as zoned is
correct.
Vote of the Board: Ayes: Wickham, Raynor, Coyle, Moisa.
Lands End.
It is the understanding of the Southold Town Planning Board
that the developer of this subdivision has to meet the Town
requira ~ts. He has posted a bond to this effect. The Town
requirements are that he construct a 100 by 100 foot turn-
around and this will have to be followed with the usual amount
paved.
The next meetings will be held July 22 and August 5, 1974.
Motion was made by Mr. Wickham, seconded by Mr. Coyle and
carried that the ~eeting be adjourned. Meeting was~adjoUrned
at ll:00 p.m.
