Co~le (8:45), and Alfred Grebe. Soundview Meadows. Robert A. Celic, George L. Penny IV, Victor Prusinowski and Mr. and Mrs. Elliot Meyer appeared. The Chairman opened the hearing at 7:30 p.m. Mr. Moisa read the Notice of Hearing. Mr. Wickham: This is a minor subdivision with lots approx- imately four acres each. One of the things we require are covenants and restrictions. As normal procedure we submit these to our attorney and we have a letter from the Town Attorney to the Town Planning Board dated September 13, 1974. Dear Sirs: At your request I have examined the proposed Declaration of Covenants and Restrictions relative to the above minor sub- division. I have the following comments with respect to the Declaration: I would recommend that a metes and bounds description of the area embraced within the subdivision be made a part of the Declaration to insure that there is no question as to the area effected by the Declaration. A paragraph should be inserted in the Declaration to the effect that the entire tract embraced within the sub- division cannot be subdivided into more than four bots, and that each lot shall comprise an area of no less than four acres. I am returning herewith the original Declaration, subdivision map and letter of the Department of Public Works sent to me by Mrs. Brush. /s/ Robert W. Since there are no highways required, we have no letter from the Highway Department. I will read the Declaration of Covenants and Restrictions as we have it. WHEREAS, said ROBERT A. CELIC, residing at 119 Hubbard Avenue, Riverhead, New York; GEORGE L. PENNY IV, residing at 190 F Soundview Avenue, Southold, New York; and VICTOR PRUSINOWSKI, residing at 119 Hubbard Avenue, Riverhead, New York are the owners and fee-simple of certain premises in the Town of Southold, Suffolk County, New York, known and des- ignated as SOUNDVIEW MEADOWS at the northerly side of Route 27A, the easterly side of Mill Lane, and the north-easterly side of Soundview Avenue in the Hamlet of Peconic. WHEREAS, said Declarants are desirous of placing certain restrictions upon said premises which shall be binding upon all purchasers and their grantees, mortgagees, or successors in interest of the individual lots shown on said map as approved by the Planning Board of the Town of Southold, Suffolk County, New York. NOW, THEREFORE, THIS DECLARATION WITNESSETH: That the said Declarants, for the benefit of themselves, their successors and assigns, in consideration of the premises and for the purpose of carrying out the above expressed intentions, do hereby make known, admit, publish, covenant and agree that the said premises hereinabove set forth, shall hereafter be subject to the following covenants, easements, restrictions s~8 agreements: 1. Zoning regulations and ordinances of the Town, County and State or other governmental body in which the premises lie. 2. No more than one single family dwelling may be erected on any lot on the map entitled SOUNDVIEWMEADOWS as approved by the Planning Board of the Town of Southold; said subdivision map shall not contain more than four lots and each lot shall comprise an area of no less than four acres, which may not thereafter be subdivided. 3~ No lot as shown on the map entitled SOUNDVIEW MEADOWS shall be subdivided or sold except as a single unit or parcel, nor shall the owner thereof rent a portion or portions of the premises to boarders or transients without the consent and approval of the Southold Planning Board. A metes and bounds description of the entire subdivision area is attached hereto and made a part hereof. Prusinowski Planning B~6ard -4- November 18, 1974 Mr. Wickham: I think that the Planning Board will probably want to make a change in this saying exactly what you said, "No lot as shown on the map entitled SOUNDV~EW MEADOWS shall be subdivided or sold except as a single unit or parcel." We would insist on a period because this is what we told you we had to have. You can continue with a new sentence, "Nor shall the owner thereof, etc." If you leave that comma in it means that no lot as shown shall be subdivided except with the consent and approval of the Southold To~n Planning Board and we don't know what Planning Boards are going to do at some time in the future and it is our policy to tie these things up absolutely. You have to meet our requirements. All you have to do is to change the comma to a period, put a capital in there and everyone initial it and it is done. I want everybody to understand that when we have a minor sub- division we are extremely particular to see the lots are not redivided. We have been through this too many times and usually within three years they are back in our laps. Mr. Wickham: At this time I will open the hearing to those who wish to speak in opposition to this subdivision. Loraine Terry: On this Soundview Avenue, lots one aud two, does this area have alot of little marshy areas along the road? Mr. Penny: No, it is up further. Mr. Raynor: Any pond would have to show on the map. Mr. Wickham: Hearing no comment in opposition, I would like to ask if there is anyone who would like to speak in favor of it? Mr. Celic: We have nothing to say. We have given all our thoughts right here. There seems to be a pretty good market for this and we can satisfy everyone. Mrs. Elliot Meyer: We are neighbors. There is a lot here that has no access. Mr. Celic showed Mrs. Meyer where the access was. The gentlemen all initialed the Covenants and Restrictions and the hearing was declared closed. Syloret. The Chairman went over the checklist to make sure everything was in order. The £ollowing letter dated August 7, 1974 to Mrs. Hochman was read. Dear Mrs. Hochman: The following action was taken by the Southold Town Planning Board at a regular meeting held August 5, 1974. On motion made by Mr. Raynor, seconded by Mr. Coyle, it was RESOLVED that the developer of the subdivision named "Syloret" located at Cutchogue, New York, construct the recharge basin and the road in compliance with the directive of the Southold Town Superintendent of Highways. Vote of the Board: Ayes: Wickham, Coyle, Grebe, Raynor. Gentlemen: The Highway Committee and I approve of the layout of the road(s). The Highway Committee recommends that another area be set aside for the Park and Playground area and that a recharge basin will be put between the 50 ft. roadway and Long Island Lighting Company easement. /s/ Raymond C. Dean Sup't of Highways The following letter under date of April 9, 1974 addressed to the Southold Town Planning Board was read. Gentlemen: The Highway Committee and myself have reviewed the map on Syloret Estates located at Cutchogue, New York and recom- ment the following recommendations: Recommend that a recharge basin be located on either lot #10 or 11 because of the contour of the subdivision and the makeup of Bridge Lane. /s/ Raymond C. Dean SuP't of Highways The following letter under date of April 3, 1974 addressed to the Southold Town Planning Board was read. Dear Mrs. Brush: Pursuant to your letter of March 26 relative to recom- mendations by the Superintendent of Highways for the above captioned subdivision, we are enclosingprints of the road profiles referred to and the suggested leaching basins, as well as those already existing. It is our assumption that the developer will not be responsible for any regrading of the Town Highway known as Bridge Lane, but only for the placing of basins within its right-of-way lines to provide for drainage. It will be noted that there are two existing County bazims near the southerly end of Bridge Lane to take care of run-off in that area. Mr. Wickham: The point I am making is we go back to 1973 on this and the preliminary hearing was held in September of 1973. We have a preliminary subdivision map under date of August 28, 1974 (revised) with recharge basin and leaching basins. The final map does not show the details of the recharge basin. You made the changes on the preliminary map and it can be But on the final map. Mr. Raynor: Do you have the drawings completed? Mr. Sherwood: The Highway Department has standard plans and this is recharge basin type B. Mr. Wickham: Would it be possible to put an inset on the far side of the map os the recharge area? We have to have it on the one filed with the County Clerk. Mr. Sherwood: You want it done on the original so that any prints made from it will show it. Mr. Wickham: All we want is the detail of the drainage area. The secretary informed the Board of Mr. Tuthill's suggestion of moving the recharge basin closer to the road known as Bridge Lane and making it a type A recharge basin. Mr. Sherwood: We feel it will do the job here. There isn't going to be that much water there. The Highway Committee says you have to build a road which we think is silly. The recharge there is to pick up from the swale. Mr. Wickham: There is a dike to the north and all the rain comes down to the highway. Mr. Sherwood: I don't think you should expect this fellow to help with a pre-existing problem. Mr. Wickham: If he runs a single line of 18" pipe from the leaching basins to,the recharge basin ..... Mr. Sherwood: We have proposed type B and we would need a type A Which is open with a fence, etc. I don't think you could get it deep enough. I would rather put in a couple more basins. Mr. Wickham: At this time I will open the hearing to anyone who wishes to speak in opposition to this subdivision. Hearing none, is there anyone who wishes to be heard in favor of it? Mr. Sherwood: Representing the owners and developers, I would like to speak in favor of the subdivision. Planning Bb~ard -8- November 18, 1974 Mr. Wickham: In view of the fact that we do nov have a bond estimate at the present time I will declare the hearing closed and we will discuss it a little further, the methods of getting the improvements on the final map. Mr.- Sherwood: Are you going to require that the highway be fully constructed inasmuch as it doesn't go anywhere and doesn't serve anything? Here again the few times I have talked to Ray, he has been very vague about the whole thing. Mr. Wickham: Very frankly, the problem arises because the Planning Board cannot bond a developer to build a road at such a time as the Town of Southold might want it. This next farm might be developed sometime in the next ~en years. At this time, we have no machinery. We can insist that Mr. Hochman build such a road. Mr. Sherwood: Fram~aapractical point of view when the whole road goes through they may want to change the whole thing. It is poor planning to build a piece here and to the west and somehow try to connect them and hope the grade will work out. Mr. Wickham: The Town is reluctant to spend the taxpayers' money to build such a road ten years from now. Mr. Sherwood: Mr. Hochman would be willing to give money in &leu of having to do this. Whatever the minimum requirements are, I am sure that Mr. Hochman will go along with it and we will see they are incorporated in the plan. Mr. Wickham closed the hearing. St. Peter's Lutheran Church. The secretary was directed to check with the Town Clerk to see if he had received the amendment to the original petition for the change of zone. Inlet East. William Esseks, Esq. and Donald Denis appeared. Mr. Wickham opened the hearing at 8:30 p.m. Mr. Raynor read the Notice of Hearing. Mr. Wickham: The Planning Board has gone over this with the developers a good many times and we have worked with the Soil and Water Conservation District, the Highway Superin- tendent and the Highway Committee and we have gone round and round. I have a letter under date of October 9, 1974 to the Southold Town Planning Board. Gentlemen: Transmitted herewith are two (2) copies of additional storm water drainage data, which was requested by the Suffolk County Planning Commission. Please submit one copy to the Suffolk County Planning Commission and retain the other copy for your files. /s/ Howard W. Storage capacity of leaching pools at intersection of Harborview Avenue and Inlet View East Each pool = 2 - 4' 0" x 8' diameter storm drain rings Effective depth = 6.5' x 42.2 cu. ft. - 274 cu. ft. each pool 2. The down stream area of drainage area is to remain in its natural state. The ultimate disposal of storm water from storm sewer along Harborview Avenue is to return to ground water through surface leaching in low land westerly of the drainage easement. Mr. Wickham read the following letter under date of September 20, 1974 to Mr. William Esseks. Dear Mr. Esseks: In reviewing map dated April 5, 1974 for the above- captioned subdivision, the following deficiencies have been noted. Mr. Denis was contacted on July 22, 1974 and informed of Mr. Dean's recommendation of two rings instead of one for the catch basins (8' instead of 4~). This is not shown on the map. Part of recommendation #1 in letter of December 14, 1973 said 'that the road in this area conform more to the existing ground' The County Planning will require data at time of refer- ral on final map on (a) storage capacity of storm drain on Harborview Avenue (drainage Cales) and ~b) treatment of down stream area of easement (ultimate disposal). If you have any questions on this, I would suggest you contact the Superintendent of Highways. /s/ Muriel Brush The following letter under date of September 17, 1974 to the Planning Board was read. Dear Ms. Brush: We are delivering herewith original letter dated August 20, 1974 of New York State Department of Environmental Conser- vation to the effect that no tidal wetlands permit is required Planning B~rd -11- November 18, 1974 at this time and also the original final plat tracing, one cloth print and four paper prints of the "Map of Inlet East Estates". /s/ William W. Esseks The following letter dated August 20, 1974 addressed to Mr. William W. Esseks was read. Dear Mr. Esseks: Thank you for your letter clarifying the extent of the above- referenced property. We understand that although a portion of the land does border on tidal waters, the improvement (road) which you propose at this time, is more than 300 feet from tidal waters. Therefore, you will not require a tidal wetlands permit at this time. In the future, however, before additional work maybbe done within this 300-foot zone, you must reapply ~o this Department. /s/ Roy L. Haje Alternate Local Permit Agent Certification of approval of realty subdivision plans from the Suffolk County D~partment of Health Services was noted as received. The following letter under date of July 22, 1974 to the Planning Board was read. Gentlemen: The Highway Committee and I recommend the bottom of the swale area on Harborview to the west of the ste~l pipe in the drainage easement be left in the natural state. We recommend that two rings instead of one for the catch basins (8' instead of 4'). /s/ Raymond C. Dean Sup't of Highways The following letter was read from the Suffolk County Depart- ment of Planning under date of June 18, 1974. Dear Mr. Wickham: In accordance with your request, the staff has considered the above captioned proposed subdivision map and offer the following comments on it for your use: 1. The overall layout is considered to be satisfactory. 2. Consideration should be given to leaving drainage area below outfalls in natural state to slow down velocity of storm-water and increase absorption. Planning B~rd -12- November 18, 1974 3. Data will be required at time of referral on: a. storage capacity of storm drain on Harborview Avenue (drainage cales). b. treatment of down stream area of easement (ultimate disposal). Staff comments on a preliminary map do not constitute a review. When this map is in the final stage of preparation, it whould be referred to the Suffolk County Plarnaing Commission for review pursuant to Section 1333 of the Suffolk County Charter. /s/ Charles G. Lind Subdivision Review Section Mr. Wickham: We have officially requested together with the Town of Riverhead together with some other towns that the Planning Commission amend the County Charter so that they may act at the time of the preliminary rather than waiting until everything is done before they act. Is there anyone wishing to be heard in opposition to this subdivision. Hearing none, those who wish to speak in favor of it may do so. Mr. Esseks: I have spoken to this board before. We hope that we have done what we needed to do. We rely on the surveyors. The secretary mentioned that Mr. Denis had said he would give the town a slope easement. Mr. Esseks replied they would do anything they had to. Mr. Wickham: There being no one wishing to be heard further, at this time I will declare the hearing closed. Mr. Wickham: We still have to send this to the County Planning Commission. I would anticipate no problems at all because we have insisted that you do what they wanted done. Mr. Esseks took the original tracing copy and one linen for possible corrections. George Edwards Estate. Mrs. Phyllis Hale appeared. Mrs. Hale has anundivided half-interest in the George Edwards Estate and wanted to discuss with the board where reservation should be made for possible roads (east-west) in the future. · Planning B~rd -13 .... November 18, 1974 Hodor, Arshamomaque. Gary 01sen, Esq. appeared. It was pointed ou~.to Mr. 01sen that the elevations on this map substantially~A~ee with the map of the adjoining property (Shorecrest). He was told that there was very little chance that the town would approve the business site on the County Road and, therefore, he should either label it Section 2 or include it in the subdivision. This is opposed by the town and the county. The whole map will have to be redone with a change in the location of the park and playground also. A strip will have to be reserved on the northerly section by the county road for possible widening of the road. No access will be allowed onto the county road from the individual lots. Macari. Gary 01sen, Esq. appeared. The secretary was directed to find the aerial photographs and layout of the Long Island Expressway and also check the width. James Dean minor. Gary 01sen, Esq. appeared. The PlanD_ing Board had said at a previous meeting that they thought there should only be two lots in this subdivision of land but Mr. Dean is not happy with this thought and wants to make it at least three. He had originally come in for four. Mr. Wickham told Mr. 01sen that our regulations will not allow the undevelopable land to be used as a base for the 40,000 square foot minimum requirement for area. The Planning Board will require water tests. Mr. 01sen was directed to show the Planning Board a layout with three lots and if the build- able area (not meadow) is sufficient, the Planning Board will look at it again. Oregon View. Gary 01sen, Esq. appeared. Mr. Olsen was directed to have the driveways placed on the final maps for the lots abutting the County Roadl On motion made by Mr. Henry Raynor, seconded by Mr. Moisa, it was RESOLVED that the Southold Town Plauning Board approve the final map of the subdivision known as "Oregon View" subject to the following: 1. Receipt from the Town Clerk of the bond for road construction and drainage. 2. Maps corrected to show location of the driveways on lots 23, 24, 39 and 1. Planning B~o~r d -14- November 18, 1974 3. Receipt of the inspection fee. 4. Site plan approval of the structures at the entrances together with their placement on the map. Vote of the Board: Ayes: Wickham, Moisa, Raynor, Coyle and Grebe. It was the consensus of the Board to request that the subdivision "Soundview Acres at Orient" place the road against the Morris property in conformity with the master plan of the Town of Southold. On motion made by Mr. Moisa, seconded by Mr. Raynor, it was RESOLVED that the Southold Town Planning Board approve the map of the subdivision known as "Soundview Meadows" subject to the receipt of the filed covenants and restrict- ions corrected and initialled by the owners. Vote of the Board: Ayes: Wickham, Moisa, Raynor, Coyle and Grebe. On motion made by Mr. Raynor, seconded by Mr. Grebe, it was RESOLVED that the Southold Town Planning Board approve the final map of the subdivision known as "Syloret" subject to the following: 1. Two additional catch basins be placed at the inter- section of Bridge Lane and the road being constructed in the subdivision. 2. Drainage structures be shown on the final map. 3. The area to the south of the proposed road be shown as park and playground. 4. Curved curb and gutter be placed at the en~rauce to the subdivision. 5. Curbs and gutters be installed up to the 100' turn- around. Vote of the Board: Ayes: Wickham, Moisa, Coyle, Grebe and Raynor. Planning B-~rd -15 November 18, 1974 On motion made by Mr. Moisa, seconded by Mr. Grebe, it was RESOLED that the Southold Town Planning Board approve the recharge basin at "Shorecrest" as drawn by Roderick Van Tuyl4 P.C. May l, 1974 and as approved by the Town High- way Committee and Town Highway Superintendent, Vote of the Board: Ayes: Wickham, Moisa, Raynor, Coyle and Grebe. On motion made by Mr. Raynor, seconded by Mr. Moisa, it WaS R~SOLVED to hold a public hearing on the final map of the subdivision known as "Greenfields,' on December 16, 1974. Vote of the Board: Ayes: Wickham, Moisa, Coyle, Grebe and Raynor. It was the consensus of the Board that is minor adjust- ments were made, it would be possible to have only one lad below the minimum 40,000 square foot requirement in the proposed subdivision "Crown Land Lane". Mr. Edson was to be notified. It was the consensus of the Board that the developers of "Blue Horizons" redo the map as per the recommendations of Mr. Lawrence M. Tuthill, P.E. The secretary was directed to send the maps of "Peconic Homes - Greton" owned by the Hortons and Grefes to Mr. Barnett of the Soilda~d Water Conservation District for his recommendations as to a possible swale in the roads. The Town Board was to be asked if the Plar~uing Board would first be consultedfwhen a bond is to be released for a subdivision. On motion made by Mr. Grebe, seconded by Mr. Coyle and carried the minutes of the meeting of October ~28, 1974 were approved. Planning k~ard -16 .... November 18, 1974 On motion made by Mr. Grebe, seconded by Mr. Moisa, it was RESOLVED to recommend to the Town Board that the Town share the cost of the preparation of the survey of the quality of the water in the Town of Southoldwhich was done by the Incorporated Village of Greenport in an amount equal to from ten to twenty-five percent of the total cost with a request of from ten to twenty copies of the survey. Vote of the Board: Ayes: Wickham, Moisa, Grebe and Rayhor. Mr. Coyle abstained. A request is to be made to the Town Board to authorize Mr. McLendon to act as consultant for the Planning Board if and when it is necessary. It was also suggested that an updated report be obtained from Malcolm Purnie. A request was to be made to the Town Board to increase the fee of the Town Attorney and have him available for Planning Board meetings. Mr. Wickham reported that he has asked the Town Board to meet with the Planning Board for an informational meeting somewhere in the Town to discuss the proposed subdivision known as "Orient Point". Mr. Wickham feels that many people do not realize that the Planning Board has no option other than to give final approval to the subdivision at the end of three months. The Chairman directed that a letter be written to the Board of ApP~lS putting them on notice that a~th0ugh~ the Planning Bo.~dha~ no a~thority when it comes to CaSes before the Board oflAppeals, that they will nOthenceforth accept site planson d~vision of long narrow lots such as in the Peconio Bay Boulevard area unless they are at least 20,000 square feet in area and/or the residents establish a water district and purchase water from the Riverhead facility or make other arrangements for municipal water. With these long lots there will have to be a well-cesspool situation one behind the other and ~he flow is from north to south from cesspool to well. The Planning Board feels this is obviously daugerous and a real danger to health, safety and welfare.
