Dear Mr. Herrmann:
The Southold Town Board of Trustees reviewed the survey prepared by Nathan Taft
Corwin III, Land Surveyor, last dated May 17, 2012, and determined that the proposed
construction of an in-ground swimming pool with a pool drywell, and a pool equipment
shed; minor exterior alterations to an existing dwelling including the replacement,
relocation, and/or addition of windows and doors; and install a new sanitary system is
out of the Wetland jurisdiction under Chapter 275 of the Town Wetland Code and
Chapter 111 of the Town Code.
Therefore, in accordance with the current Wetlands Code (Chapter 275) and the
Coastal Erosion Hazard Area (Chapter 111 ) no permit is required. Please be advised,
however, that no construction, sedimentation, or disturbance of any kind may take place
seaward of the tidal and/or freshwater wetlands jurisdictional boundary or seaward of
the coastal erosion hazard area as indicated above, or within 100' landward from the
top of the bluff, without further authorization from the Southold Town Board of Trustees
pursuant to Chapter 275 and/or Chapter 111 of the Town Code. It is your responsibility
to ensure that all necessary precautions are taken to prevent any sedimentation or other
alteration or disturbance to the ground surface or vegetation within Tidal Wetlands
jurisdiction and Coastal Erosion Hazard Area, which may result from your project. Such
precautions may include maintaining adequate work area between the tidal wetland
jurisdictional boundary and the coastal erosion hazard area and your project or erecting
a temporary fence, barrier, or hay bale berm.

Dear Mr. King:
We represent Erie Klodnicki, who plans to construct an inground swimming pool and install a pool
drywell and pool equipment; make interior and minor exterior alterations to an existing dwelling,
including the replacement, relocation, and/or addition of windows and doors;, and install a new sanitary
system, all more than 100 feet fi"om the most landward limit of tidal wetlands associated with James
Creek, as depicted on the site plan prepared by Nathan TaR Corwin III, L.S., last dated May 17, 2012. A
copy of this site plan is enclosed with site photographs and an agent authorization letter.
As all proposed work and related construction activities will therefore occur beyond the jurisdiction of the
Board of Trustees pursuant to §275-3(C)(5) of the Southold Town Code, would you kindly prepare a non-
jurisdiction letter for the project. Please note that we are simultaneously requesting under separate cover
a wetlands permit for activities depicted on the site plan that would occur less than 100 feet from
wetlands, including removal of the existing sanitary system; replacement and extension of the existing
dri~'~way; and installation of fencing.
