This Trustee, as well as Trustee President, Jim King were present in the Trustee Office. President King declined to assist the Grudmans on account of his prior commitment to abstain from the all matters in the Andreadis permit process, so the task of assisting the Grudmans was left to this Trustee. The Grudmans lodged concerns surrounding a number of issues beyond the jurisdiction of this Office such as the duration and noise generated by the project's construction and the proximity of the deck to their plot line to which they were commended to see the Building/Code Enforcement Departments. They complained about specific items they felt were contrary to the Wetland Permit, alleging: the presence of a fire pit in the patio area(noted in the approved plans), the construction of an impervious concrete base underlying the brick walk, an incomplete hay bale/silt fence line along the southerly Andreadis plot line and vegetation control in excess of poison ivy and single tree removal outlined in the permit. The Grudmans left the Trustee Office at 14:20 Hrs. having spent the entirety of the one half hour with this Trustee, appreciative of the time spent with them. I informed them I would take the matter up with the Board of Trustees. At the evening work session of this date it was the consensus of all the Board members present: King, Bergen, and Bredemeyer to refer the matter to the Bay Constable to check on permit compliance in reference to the specific allegations above. I don't know how construction at 700 north drive with multiple pours of concrete on a pourous piece of land that provides drainage leading to a protected waterfront is allowable or acceptable to the town, county or state. Where there were bushes and shrubs in the prtecdtected area, the land is virtually bare of green coverage. I view clearly land without green coverage in what used to be green coverage in the protected area. Building a patio is basic. This project is over two weeks of construction with no permit required and no input from adjacent neighbor accepted. I request the town do deligence and inspect the project to verify that no permitting is or was required before the further desruction of this lot by this owner without the town reviewing, inspecting and affirming that it is legal and in the best interest of the community. There is a continuous flow of concrete dust on my house It has gone on for two weeks. There must be a barrier tall enough to ptotect my house. A pervious patio is what was proposed. It appears to be non pervious concrete that would divert water towards my property. Is there any monitoring of this work? I have instead concentrated my efforts on building and developing my home and property at 700 North Drive properly, correctly and in full compliance with all building, zoning and other planning laws and ordinances. To that end, I have always submitted the proper applications and have proceeded with the work pursuant to the various approvals and permits granted to me for such building and development. Given Mr. & Mrs. Grudman's latest communications to you, I believe that a succinct statement once and for all "for the record" is in order so that the official records on file with you do not consist solely of the Grudmans' missives. Ever since we purchased the then vacant property/lot and filed the necessary building and development applications, the Grudmans, for reasons that were and remain a mystery to me, have seen fit to engage in a single-minded campaign seeking at every turn to block the issuance of any approvals and to prevent me from proceeding. Their efforts, which would not surprise me to learn are simply motivated bythe fact that for years they were just used to having an open, undeveloped piece of property standing on higher property next door, have been unsuccessful. More troubling is the fact that the Grudmans, in pursuing their quite personal agenda, have also seen fit to make demonstrable misstatements. To illustrate my point, I direct your attention to two misstatements that are central to the Grudmans' latest communication and repeated past attempts to paint us as being totally abusive to the environment we chose for our retirement: "He (Andreadis) has attempted on several occasions to remove trees and was stopped because it invaded the protected area between his property line and environmentally protected property...He was prevented from cutting trees in this protected area." I have no recollection of ever being contacted by any authorities because of protected area invasions, let alone being stopped by anyone in an attempt to cut trees in the protected buffer. The record will show that we have always filed for the necessary permits, complied with regulations and acted only in accordance with granted approvals. Cont~ued... Upon completion of major construction, we planted thirty two (32) green giant evergreens, 10' to 14' high; four (4) multiple trunk white birches, 20' to 25' high; four (4) assorted fruit trees, 6' to 10' high; twenty (20) Norway spruces, 12' to 14' high; one (1) white pine, 12' high; eleven (11) large sea grass bushes (cat tails); thirty three (33) assorted bushes and small trees; and numerous minor plantings (flowers, decorative and aromatic plants). Please note our property is only one acre and the plantings proposed by Creative Environmental Design would significantly increase those previous plantings. My wife and I have steadily invested in providing privacy and a pleasant, environmentally sensitive setting for our family and our community. I would welcome the opportunity to meet at the site with you, or representatives of any authority having jurisdiction, and go through the Grudmans' missives, line-item by line-item. I believe any objective observer would find them as flawed as the two examples above, including the only time I had to take any corrective action, after being reported by Grudman, by rotating my tool shed 90 degrees and replacing it sideways so it would meet the property set back requirement along a property line in his woods (I thought that setbacks did not apply to prefabricated tool sheds)! We would greatly appreciate it if you could please put this communication on file to the same extent as the Grudmans' communications have been placed on file. I do not intend to again respond to the Grudmans' either past or future communications. I will, as stated above, continue with the course I have always followed -- filing any necessary or required application and documents and proceeding in accordance with any and all permits granted to me. My wife Adele and I own! the. adja¢~t proper~ 620 North Drive, next door to 700 North Drive, Mattituck ~ . , ~. I object to the construction of any patio that close to my property line, permeable or not,especially not within the 20 ft. setback with my property line established by town the of Southold. I furthermore object to a patio in that area close to my house because of the peace and quiet I will lose. Anything built must comply with all codes. There should be no patio nor any construction built that close to a neighbor's house. As for the plan for 2 sets of stairs on either side of the pool: The proposed stair on the east side, closest to my property directly opposite my bedroom window will affect the privacy and value of my property. Expanding the pool noise, that I currently have is unacceptable. If a step is needed, then one step on the north side leading to his stairway to the dock is more than adequate. The fact is, the noise, particularly yelling and screaming of children and adults when the pool is in use is disturbing as is, but it is within his setback on his property and he has the right to have the pool. To add steps with corresponding foot traffic closer to my house is inappropriate and unacceptable. The removal of select trees in the protected slope to the water has been the objective of Andreatis since he bought the property. He has attempted on several occasions to remove trees and was stopped because it invaded the protected area between his property line and environmentally protected property. This land heals itself and does require assistance from one with a history of destruction of vegetation. This is just one more attempt to invade the protected lands to improve his view. History of this person's actions prove that nature, especially in the protected area does not need nor deserve the" help" of Andreadis. I reported his attempted intrusion when he first built his house to the county environmental office and the town of Southold. He was prevented from cutting trees in this protected area .I strongly object to removal of any trees, bushes or shrubs in the protected area. He Clear Cut his own land. Only minor plantings that do not replace what he destroyed shows his lack of concern for nature. The brick path permeable or not, along my property line within the setback next to my house is abusive and unacceptable The setback is called that for a reason. In my absence when he first built, he managed to invade the setback. I was not legally notified. I will not accept any more incursion. The fact that it will add noise and traffic within feet of all my bedroom windows should be reason enough to deny this request. I reject his request I furthermore want it noted that I object to any intrusion of setback requirements. Furthermore, I want to be on record of objecting to any project that allows anything built within setback or protected land.. The request for a path within the protected environmentally sensitive land is unacceptable. His plan will destroy protected land for no benefit to the environment. Evidence and history show lack of his concern for environmental issues. I reject this request to construct in the protected land, a 4 X 24 catwalk path invading and destroying protected land. In general, Andreatis continues to attempt to expand his property beyond what the town codes allow. Every issue described in this matter either compromises the setback rules or provides the ability for this neighbor to intrude on the peace and quiet any neighbor has the right to expect. I object to each and every item described in SCTM 1000-106-6-25, as per my comments on each issue. I furthermore object to a patio in that area close to my house because of the peace and quiet I will lose. Anything built must comply with all codes. There should be no patio nor any construction built that close to a neighbor's house. As for the plan for 2 sets of stairs on either side of the pool: The proposed stair on the east side, closest to my property directly opposite my bedroom window will affect the privacy and value of my property. Expanding the pool noise, that I currently have is unacceptable. If a step is needed, then one step on the north side leading to his stairway to the dock is more than adequate. The fact is, the noise, particularly yelling and screaming of children and adults when the pool is in use is disturbing as is, but it is within his setback on his property and he has the dght to have the pool. To add steps with corresponding foot traffic closer to my house is inappropriate and unacceptable. The removal of select trees in the protected slope to the water has been the objective of Andreatis since he bought the property. He has attempted on several occasions to remove trees and was stopped because it invaded the protected area between his property line and environmentally protected property. This land heals itself and does require assistance from one with a history of destruction of vegetation. This is just one more attempt to invade the protected lands to improve his view. History of this person's actions prove that nature, especially in the protected area does not need nor deserve the" help" of Andreadis. I reported his attempted intrusion when he first built his house to the county environmental office and the town of Southold. He was prevented from cutting trees in this protected area .I strongly object to removal of any trees, bushes or shrubs in the protected area. He Clear Cut his own land, Andreatis removed all the vegetation on his property without replacing any vegetation of substance leaving the entire property without vegetation including the setbacks. His history is the abuse and destruction of nature. Only minor plantings that do not replace what he destroyed shows his lack of concern for nature. The brick path permeable or not, along my property line within the setback next to my house is abusive and unacceptable The setback is called that for a reason. In my absence when he first built, he managed to invade the setback. I was not legally notified. I will not accept any more incursion. The fact that it will add noise and traffic within feet of all my bedroom windows should be reason enough to deny this request. I reject his request I furthermore want it noted that I object to any intrusion of setback requirements. Furthermore, I want to be on record of objecting to any project that allows anything built within setback or protected land.. The request for a path within the protected environmentally sensitive land is unacceptable. His plan will destroy protected land for no benefit to the environment. Evidence and history show lack of his concern for environmental issues. I reject this request to construct in the protected land, a 4 X 24 catwalk path invading and destroying protected land.
