Consequently, kindly accept the following items into the record: (1) Project Description (three [3] copies); and (2) Updated Plans, prepared by Suffolk Environmental Consulting, Inc., last dated April 6, 2012, indicating all project specifications (three [3] sets). Kindly review and include within our file concerning this project. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will be evaluated as to its significant beneficial and adverse effects upon the coastal area (which includes all of Southold Town). 3. If any question in Section C on this form is answered "yes", then the proposed action may affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. Thus, the action should be analyzed in more detail and, if necessary, modified prior to making a determination that it is consistent to the maximum extent practicable with the LWRP policy standards and conditions. If an action cannot be certified as consistent with the LWRP policy standards and conditions, it shall not be undertaken. A copy of the LWRP is available in the following places: online at the Town of Southold's website (southoldtown.northfork.net),the Board of Trustees Office, the Planning Department, all local libraries and the Town Clerk's office. Foster a pattern of development in the Town of Southold that enhances community character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of development. See LWRP Section III—Policies; Page 2 for evaluation criteria. ® Yes ❑ No ❑ Not Applicable With respect to the proposed addition to the existing dwelling: As indicated within Policy 1, "Development that does not reinforce the traditional land use pattern of the Town of Southold would result in a loss of the community and landscape character of Southold.", this project is a proposal to construct a 2nd-Story Addition to an existing dwelling within subject property, a property situated within a neighborhood consisting primarily of similarly-sized single-family dwellings within similarly-sized properties. The proposal, as designed, will not result in adverse effects to the surrounding environment in that the project will not expand upon the "footprint" of the existing dwelling, and will not encroach any further towards the surface waters of Gull Pond to the east. In addition, the surrounding neighborhood is comprised of older residential dwellings which have existed harmoniously within this area for years and have not resulted in any form of adverse effects to the surrounding environment. Accordingly, we believe that this proiect is consistent with this policy. With respect to the proposed reconstruction of the proposed bulkhead and docking assembly: Subject proposal is consistent with the policy in that the siting/utilization of the reconstructed dock assembly and siting/utilization of the proposed reconstructed/reconfigured bulkhead will maintain the character of the surrounding neighborhood, which currently consists of many similarly-improved residential lots with similar accessory structures (i.e. dock assemblies and bulkheading along Gull Pond). In addition, subject proposal will be in harmony with the "...beneficial use of a coastal location..." in that the legally created residential waterfront (i.e. coastal) lot will be enhanced by the reconstructed dock assembly in order to maintain access to the contiguous surface waters and the maintenance of existing erosion control structure (i.e., bulkheading). Accordingly, we believe that this project is consistent with this policy. Attach additional sheets if necessary • • Policy 2. Protect and preserve historic and archaeological resources of the Town of Southold. See LWRP Section III—Policies Pages 3 through 6 for evaluation criteria n Yes ❑ No ® Not Applicable With respect to the proposed addition to the existing dwelling: Policy 2 is not applicable in that subject lot and the surrounding neighborhood cannot be deemed a substantial historic and/or archaeological resources. With respect to the proposed reconstruction of the proposed bulkhead and docking assembly: Subject proposal is not applicable to this policy in that it will have no impact to any potential historic and/or archaeological resources within the surrounding area. Attach additional sheets if necessary Policy 3. Enhance visual quality and protect scenic resources throughout the Town of Southold. See LWRP Section III—Policies Pages 5 through 7 for evaluation criteria ® Yes ❑ No ❑ Not Applicable With respect to the proposed addition to the existing dwelling: Subject proposal will not adversely impact the visual duality of the surrounding area in that the existing property has been improved with a single-family residence for many years without any evidence of resulting in adverse impacts to the neighborhood. In addition, the neighborhood itself is comprised of similarly sized properties, improved similarly for many years, and which also has not resulted in any form of adverse impacts to the surrounding area. Furthermore, this policy could not preclude both the legal creation of this property as a building lot, or the improvement thereon. With respect to the proposed reconstruction of the proposed bulkhead and docking assembly: Subject proposal will not adversely impact the visual quality of the surrounding area in that the surrounding area is currently comprised of properties improved with similar appurtenances (i.e. dock assemblies and bulkheads) of equal, if not greater, size and scope. Scenic resources, assumedly views of Gull Pond, are not at risk due to the reconstructed dock assembly and bulkheading being typical of the character of this section of waterfront. Accordingly, this proposal will comply with Policy 3. Attach additional sheets if necessary NATURAL COAST POLICIES Policy 4. Minimize loss of life, structures, and natural resources from flooding and erosion. See LWRP Section III—Policies Pages 8 through 16 for evaluation criteria ® Yes ❑ No ® Not Applicable With respect to the proposed addition to the existing dwelling: Subject property is currently improved with a bulkhead along the southwestern section of subject property and has protected subject property from any and all flooding and/or erosion events since the improvement thereon. The proposal is to renovate and expand upon the 2nd-Floor of the existing dwelling and therefore cannot be applicable to Policy 4. With respect to the proposed reconstruction of the proposed bulkhead and docking assembly: Subject proposal will fully comply with Policy 4 in that the reconstructed bulkheading &dock assembly is designed to be comparable in design and scope as that of the surrounding bulkheading and dock assemblies, which have not resulted in loss of life, structures, and natural resources within this area. Accordingly, this proposal will comply with Policy 4. Attach additional sheets if necessary • • Policy 5. Protect and improve water quality and supply in the Town of Southold. See LWRP Section III - Policies Pages 16 through 21 for evaluation criteria ® Yes ❑ No ® Not Applicable With respect to the proposed addition to the existing dwelling: Subject proposal will comply with Policy 5 in that a more efficient sanitary system is proposed to be installed thereon, and which will conform with any and all conditions of the Suffolk County Department of Health Services. With respect to the proposed reconstruction of the proposed bulkhead and docking assembly: Subject proposal is not applicable in that the proposal is simply to reconstruct the existing shoreline protection (i.e., bulkheading) and reconstruct a dock assembly which will not result in any form of adverse effects to air quality. Accordingly, this proposal is not applicable with this policy. Attach additional sheets if necessary • • • Policy 8.
