This is in regard to the site plans for the referenced project which were submitted to us for review.
Upon review of the proposed work, we find that the plans are acceptable as submitted. This site plan
approval for highway work permit issuance is contingent upon our receipt of all of the following
items within six (6) months of the date of this letter and no further revisions are made to the plans.
If the Highway Work Permit will be secured by anyone other than the property owner, i.e. contractor,
the applicant must provide a signed letter from the property owner stating the applicant is authorized
to act on behalf of the property owner in this matter. The letter must also include the property
owner's mailing address and telephone number.
Prior to issuing a Highway Work Permit, you must submit the required permit fee and Surety Bond
(sample enclosed). It is also mandatory that protective liability insurance be provided by the
permittee. This must be accomplished by either submitting a completed Perm 17, Certificate of
Insurance, in accordance with Option A (form enclosed), or by submitting the fee specified below to
be covered under the NYSDOT Blanket Policy. Also, enclosed is a Highway Work Permit
Application to be completed and returned to us. The application, completed Perm 17 and the Surety
Bond must be secured by the same party. The applicant did previously submit a check to us,
however, the check is being returned enclosed. It is dated for over a year ago and only covers the
insurance fee. Please see below for current Highway Work Permit fees.

All checks issued to the State of New York must show a Federal Identification Number.
Permit Fee (Payable to "State of New York"): $15.00
Bond Amount: $2,500.00
Insurance Fee: $25.00

This is to acknowledge receipt of your submission concerning the subject issue.
In order to process your application please provide us with the information that we previously
requested in our June 28, 2006 letter to Mr. Rudolph H. Bmer, Esq. Excerpts from that letter are as
follows:
"Your client will be responsible for constructing access to the property in accordance with current
standards. In order for your client to gain and construct access to the State Highway your client will
need to apply for a Highway Work Permit from us. In order to progress the application process
your client will need to define what the access will be used for, i.e. residential, farm,
commercial, etc. Once the use of the access is defined three (3) sets of plans shall be prepared
and presented for our review.
The plans may be in the form of a sketch if the access will be for residential or farm use.
Guidance for preparing the sketch can be found in our policy manual. Three (3) sets of
professionally prepared plans, by a licensed architect or engineer, must be submitted if the
access will be used for commercial purposes. Guidance for professional plan preparation can
also be found in our policy manual.
Once plans have been submitted to our office, we will review them to ensure that all proposed
work within the State highway right-of-way is in compliance with current standards. Once the
plans contain all of the information needed to issue a Highway Work Permit, your client may
submit the application, fees, insurance and guarantee deposit. We have enclosed a Highway

Work Permit application for your reference. The reverse side of the application lists the types of
operations, i.e. residential driveway, commercial driveway, etc. Each operation has a corresponding
permit and insurance fee requirement."

This is to acknowledge receipt of your submission concerning the subject issue.
As your letter pointed out we did have a construction project that reconstructed Route 25 through the
section along your client's property frontage. The project was advertised to the public, with public
input requested, prior to commencing work. The project has been completed and it appears that the
project has installed curb along your client's property frontage.
It is apparent from the photos that were taken and submitted that a driveway or access road did not
clearly exist at this site. There may have been locations along your client's State highway frontage
that permitted your client to gain access to the parcel but that does not necessarily mean that access to
the site was ever constructed in accordance with State permit policy and guidelines. We draw your
attention to our Policy for access to the State highway which is available on our website at
www.dot.state.ny.us/traffic/safety/hwp/dwpolind.pdf.
For your information the marking designated as "6+280" was part of the project stationing for our
construction project and does not relate to access in any manner.

This permit application should be sensitive to the unique visual and historic setting of the
Long Island North Shore Heritage Area, which runs from the Queens/Nassau County line to Orient
Point, and from Route 25 or I495, whichever is farther south, north to Long Island Sound.
In all future correspondence, please refer to the subject case number. The plans must also include the
County tax map number.
