RAYNOR, Jr. FREDERICK E, GORDON JAMES WALL Southold, N.Y. 11971 MINUTES March 21, 1977 TELEPHONE 765-1313 A regular meeting of the Southold Town Planning Board was held at 7:30 p.m., Monday, March 21, 1977 at the Town Clerk's Office, Main Road, Southold, New York. Present were: John Wickham, Chairman Henry E. Raynor, Jr., Vice-Chairman Frank S. Coyle Frederick E. Gordon James Wall 7:30 p.m. Public Hearing on final map of "Blue Horizons". Mr. Raynor read the Notice of Hearing and presented affidavit of publication. Present were Peter Fauser, Nelson Axien, Arthur DeRosa and another young man who did not identify himself. The description and the map did not agree in a few instances. The map now says 'now or formerly of Webb' while the description and the previous maps said 'now or formerly of Corrado'. One course showed 646.31 and 646.35. Another said 62~ ll' 30" rather than 62° ll' 34". The following letter under date of March l, 1977 to Fauser, Corringham, P. C. from the N. Y. State Dept. of Environmental Conservation was read. Gentlemen: Your petition for a Tidal Wetlands Moratorium Permit has been reviewed by this office. As a result, we have determined that constrqction of subdivision known as Blue Horizons, Sections i & 2, Peconic, Town of Southold, will have no adverse effect upon adjacent tidal wetlands. Homes on lots 25, 26, 27 are to be a minimum of 75' behind the line of MHW. Cesspools must be situated at least 100' from MHW. *NOTE BELOW. Therefore, pursuant to Section 25-0202 of the Environmental Conservation Law and 6 NYCRR, Part 660.3 (c), you are hereby notified that no permit will be necessary. A copy of this determination must be available at the job site at all times during construction activity. Planning Board -2- March 21, 1977 /s/ Daniel J. Larkin Local Tidal Wetland Permit Administrator, Region 1 *Entire subdivision must be approved by Suffolk County Health Dept. for adequacy of sewage disposal. Mr. Raynor: We have a three-page list of recommendations from the District Conservationist. We have a letter dated June 18, 1976 to the Board from the Superintendent of Highways. Gentlemen: I have inspected the preliminary map and approve the road lay-out of Blue Horizons located at Peconic, New York. /s/ Raymond C. Dean The following memorandum dated May 23, 1976 from Lawrence M. Tuthill was read into the minutes. Recommendations 1. That road grades be approved on actual survey on center line of designed roads by methods m~re accurate than aerial photogr~mmetry. 2. That run-off quantities and holding capacities of recharge basins be computed and be shown on drawings. Comments 1. That the town highway specifications call for all recharge basins to be fenced, and if these fences are to be omitted it is believed that approval for such must come from the Town Highway Committee. The following affidavit of ownership was read. Arthur DeRosa, being duly sworn, deposes and says: That I am an officer of CPF Land Corp., to-wit its Treasurer, which corporation presently has an application for a subdivision pending before the Town of Southold Planning Department, That I reside at 443 Lennox Road, Huntington Station, New York, That the following people are all of the officers, directors and stockholders who have an interest either directly or indirectly in the CPF Land Corp.: Richard Principi, residing at Mainkoma Lane, Amagansett, N. Y. Alexander Fusaro, residing at 7 Bruno Street, Huntington, N. Y. Dominick Principi, residing at 447 Lenox Road, Huntington sra. Nina Curto, residing at 429 Lenox Road, Huntington Station Planning Board -3- March 21, 1977 That to the best of my knowledge, information and belief, there are no other persons, firms or corporations interested in this application except as hereinbefore set forth. That it is my understanding that the Town of Southold has determined that public policy requires a full, frank and complete disclosure of all persons having an interest, direct or indirect, in all applications to the Southold Town Planning Board and any other agencies of Town Government to insure that no question of conflicy of interest or favoritism may arise. /s/ Arthur DeRosa Duly Notarized Mr. Raynor: The application has been presented to the Town Clerk's Office, the filing fee has been presented, that about completes the outline. As the Board's policy has been, is there anyone that would like to speak in opposition to the subdivision "Blue Horizons" Sections i and 2 in Peconic? Hearing none, I will ask if there is anyone in favor of the subdivision entitled "Blue Horizons, Sections I and 2"? Mr. Fauser: I am here on behalf of the applicant. Due to the time element with this map and, if it complies, we would appreciate a final approval so that we can get the other necessary things to file it in the Suffolk County Clerk's Office. Mr. Raynor: Is there anyone else that would like to speak? Hearing none, is there any member of the Board who has any questions about this subdivision map? Mr. Wickham was going to measure some lines on the map and Mr. Fauser assured him that anything that was close or questionable is certified on the map. Mr. Fauser: Lot #1 has the notation that there will be no access on the County road. Mr. Raynor: Is there anyone else that has any questions? Mr. Axien: Are these to be public roads? Mr. Wickham: They have to be constructed to Town standards but they do not have to be dedicated to the Town. Mr. Axien: Are they going to be constructed for the two sections at the same time? Mr. Fauser: Yes, sir. Mr. Axien: Is it proposed to make the roads public? Mr. Fauser (to Mr. DeRosa): After the roads are constructed, is it your intention to make them public or private roads? Mr. DeRosa: I don't know. Planning Board -4- larch 21, 1977 Mr. Wickham: The To~n will not accept them until there is a certain amount of assessed valuation. Mr. Fauser: They will be private for the immediate future. Mr. Wickham: In most cases, the people want to dedicate for snow removal. Mr. Axien: It is a long road if the people themselves have to maintain it. Mr. Raynor (to Mr. Fauser): You are aware that the town sets a bond for all types of improvements and an inspection fee. Ail of this will be plrior to any type of construction. You will notify the Town Engineer before any work is done. Mr. Coyle: Are you going to make it in two sections or all in one shot? Mr. Fauser: It probably would be do it all as one shot, the entire on the amount of bonding, whether improvements at one time, I don't easier as a practical matter to clearing and grading, depending they would put in all the physical know. Mr. Raynor: The Board also notes that the maps do not have the approval of any County agencies. Mr. Fauser: We have to wait until the water is turned on at the cottages before the County will take a water testing. We had the Health Department approve the test wells. I have revisions to the engineering drawings. We put the one down concerning the roof leaders and we have shown all the calculations on the drainage. I also have a copy that the Town Engineer requested where we have run out the center line. I offer this to you for your reference. Mr. Coyle: At the present time, are there any buildings? Mr. Fauser: There are presently four or five cottages that are occupied in the summer. Mr. Coyle: There is some sort of restriction. Mr. Wickham: We want 100 foot setbacks from the bluff. Mr. Raynor: Is there anyone else present tonight that has any questions about the subdivision before us? Mr. Axien: What's the difference between the maps that you brought and the maps that were here? Mr. Fauser: The Planning Board asked for the setback lines on the lots that were close. We were requested to restrict the accessibility of one lot which was a County requirement. Mr. Raynor: Is there anyone else that has anything to say on this subdivision? If not, I will declare the hearing closed. Planning Board -5- ~rch 21, 1977 8:00 p.m. Public Hearing on the minor subdivision of property owned by the Fischer Estate and to be known as "Indian Woods". Lewis Edson and Rene Gendron appeared. Mr. Raynor read the Notice of Hearing and presented proof of publication. Mr. Raynor: Usually, in a subdivision we have recommendations from the Superintendent of Highways. As there is no proposed public road construction, the subdivision has none. The subdivision falls outside the jurisdiction of the County as far as the tidal wetlands are concerned. (Mr. Raynor went over the checklist.) As is the policy of this Board, we will entertain anyone that would like to speak in opposition to the subdivision entitled "Indian Woods" at Southold. Hearing none, the Board would like to hear anyone that would like to speak in favor of the subdivision "Indian Woods". Mr. Gendron: If we have everything to your satisfaction, I would hope that you would give us an 0.K. to proceed. Mr. Raynor: Is there anyone that would like to add further in favor of this application. Hearing none, is there any member of the Board that has some imput into this proposed subdivision? Mr. Wickham: Do you have this under contract? Mr. Gendron: Subject to your approval. After we have your approval, we will get the deed. Mr. Coyle: On Rene's Drive, you will drive through a pond. Mr. Gendron: Howard (Terry) said it would be alright as long as I put in some fill. Mr. Coyle: There must be a lot of clay in that area to keep the water at that height. Mr. Gendron: There is clay there. Mr. Raynor: Is there anyone that has any questions concerning the subdivision? Hearing none, I will declare the hearing closed. Barzac site plan - Ed Bage, P. E. was present representing this matter. There was some discussion about relocating the chimney and the fact that the building was so close to the property line that the grass couldn't be mowed without going on the adjacent property. Mr. Howard Terry's letter indicating that the plans submitted meet all of the requirements for parking, lot coverage and setback was read. The floor plans were presented. Planning Board -6- March 21, 1977 Richmond Shores at Peconic. Richard Lark, Esq. and Robert Cummins appeared. Howard Young, P. E. was also present. Mr. Lark presented revised maps eliminating the bubble roads in the cluster. Mr. Lark said he had talked with the Supt. of Highways and Mr. Dean had indicated to him that he would go along with the one cul de sac. The recharge basin has been moved. There is a planting schedule provided along the Main Road with the recommendation of the Soil Conservation District. Mr. Young said he had put the recharge basin where he had because he wanted to get it as far away from Richmond Creek as possible. Mr. Raynor said he would like to see one designated area as park and playground per se and would prefer to see it in the southeasterly corner along Richmond Creek. Mr. Lark said there would be deed restrictions as to the 50 foot setback and so forth. Some area was left open along Spring Lane in case it is ever widened so there would be a minimal effect on the subdivision. .~aradise by the Sound. Roger Rath and Frederick Zeims, Esq. were present. Also present was Howard Young, P. E. There was a lengthy discussion on the 2,000 if of curbing without piping as recommended by Lawrence Tuthill, Town EngineerJ Valley gutters should be eliminated. Mr. Zeims said Charles Lind of the County Planning Department had suggested that on the Sound, two lot owners have a common access to the Sound. Mr. Zeims thought they would use the Town access. There was discussion about the water main hookup to the municipal supply system and who to get permission from for the easement. He was told to contact the Village of Greenport's Supt. of Utilities, James I. Monsell. There was extensive discussion about the 100 foot setback requirement from the bluff. Zaino & Sardelli. Rudolph Bruer, Esq., Mr. Zaino and Mr. Sardelli appeared. This is a major subdivision. There had been maps previously presented which the attorney requested back and presented a new map. The back of lot #6 will probably be the park and play- ground. Have joint access for lots #2 and #3 and the other lot on the Main Road have access limited to Indian Neck Lane. There should be a walkway in the rear to the park and playground. Old Towne Park. James Bitses, Esq., Mr. Bitses presented another drawing subdivision which shows 12 lots. He map on Tuesday. the property owner, appeared. of the proposed cluster concept will bring in copies of the On motion made by Mr. Coyle, seconded by Mr. Raynor, it was RESOLVED to approve the map of the minor subdivision of property of the Fischer Estate, known as "Indian Woods", said map to be signed upon receipt of covenants and restrictions filed in the Suffolk County Clerk's Office as to no further subdivision. Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon, Wall Planning Board -7- ~rch 21, 1977 On motion made by Mr. Raynor, seconded by Mr. Gordon, it was RESOLVED that the site plan for the addition to the Barzak building, North Road, Southold, be disapproved because of insufficient buffering as a result of the orientation of the building. Vote of the Board: Ayes: Wickham, Raynor, Gordon, Wall. No: Coyle On motion made by Mr. Raynor, seconded by Mr. Gordon, it was RESOLVED to grant approval to the sketch plan of "Richmond Shores at Peconic, as revised March 14, 1977. Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon, Wall On motion made by Mr. Raynor, seconded by Mr. Gordon, it was RESOLVED to submit the drawing of the subdivision of James Bitses to be known as "01d Towne Park" to the Southold Town Board for its decision as to whether this property can be developed in the cluster concept. Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon, Wall On motion made by Mr. Gordon, seconded by Mr. Coyle, it was RESOLVED that the minutes of the Southold Town Planning Board meeting of February 28, 1977 be approved subject to a correction on page 3 regarding the "Richmond Creek Farms" development where the wording should be 'excluded' rather than 'included'. Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon, Wall There was no action taken on the Gibbons minor subdivision because it is an adjourned hearing awaiting new maps with contours and adjoing owners being noted. On motion made by Mr. Coyle, seconded by Mr. Gordon, it was RESOLVED to approve the preliminary map of the subdivision known as "Heritage Harbor" subject to a notation being placed on the map that Lot #10 can only be used for the higher use district, Residential-Agricultural. Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon, Wall Planning Board -8- ,rch 21, 1977 Greenbriar Acres. A letter is to be requested from Lawrence Tuthill, Town Engineer, indicating if the road to "Tut's Acres" coincides with the road in this subdivision. On motion made by Mr. Wall, seconded by Mr. Coyle, it was RESOLVED that a public hearing be held on the final map of the subdivision known as "Long Pond Estates", Southold. Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon, Wall On motion made by Mr. Wall, seconded by Mr. Coyle, it was RESOLVED that a public hearing be held on the final map of the minor subdivision of property owned by Hermine Hillmer, East Marion. Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon, Wall Before a public hearing can be held on the minor subdivision of Kirchgessner, it will be necessary to have maps showing adjacent property owners as requested from the attorney for the developer, William Wickham, Esq. Hill Crest Estates. The Planning Board discussed this subdivision of property being developed by Ernest and Harold Wilsberg. It was suggested that the lots on the Sound be cut down to 100 feet width. This would make eight lots, one of which can be park and playground. It will be necessary to have 100 foot setbacks and the developers will have to apply for a cluster of this particular section of the subdivision. Mr. Raynor will study the problem of the runoff from the subdivision of Hoey & Daly causing water and mud, silted catch basins and flooding of the Mitchell property across the street. Quail Run Estates. There was a recommendation from Lawrence M. Tuthill, Town Engineer, to eliminate the reverse curve on this subdivision. The Planning Board was in agreement that the curve is insignificant as it is so gentle. The Supt. of Highways will be advised of same and asked for a letter approving the roads and drainage. Planning Board -9- March 21, 1977 The following letter to the Planning Board under date of February 22, 1977 was read. Gentlemen: I am in the process of negotiating for the purchase of the Hansen farm land in Mattituck. I hope to be able to sell a substantial portion of the upland, six to nine acres, to another party as one of several plans for the future use of the land. It is my understanding that occasional single sales of substantial portions of a property are customarily treated as casual sales by the Planning Board and are accepted without requiring a subdivision procedure. Please advise if my understanding is correct. I realize that any further sales from either parcel would require subdivision approval. /s/ George Toumanoff Mr. Wickham stated that a casual sale is one every three or four years. The Planning Board was in agreement that the question should go to the Town Attorney, Robert Tasker, Esq., for his opinion. The next meeting of the Southold Town Planning Board will be held on April 4, 1977. The Planning Board was in agreement that the park and playground in the Reese development should be in the rear of the parcel.
