GORDON JAMES WALL Southold, N.Y. 11971 MINUTES April 4, 1977 TELEPHONE 765-1313 A regular meeting of the Southold Town Planning Board was held at 7:30 p.m. on April 4, 1977 at the Tow~ Clerk's Office, Main Road, Southold, New York. Present were: John Wickham, Chairman Henry E. Raynor, Jr., Vice-Chairman Frank S. Coyle Frederick E. Gordon Also, present were: Stephen Katz - L. I. Traveler - Watchman Peter Campbell - Suffolk Times Millicent Gossner - League of Women Voters Corwin Grathwohl - Southold Businessmen's Assn. 7:30 p.m. Public Hearing on the final map of the subdivision known as "Long Pond Estates, Section I", located on Laurel Avenue, Southold. Present at this hearing were Mr. and Mrs. William Price, Ernest Wilsberg, Richard Cron, Esq. Henry Raynor read the Notice of Hearing and presented proofs of publication from the L. I. Traveler - Watchman and the Suffolk Times. There was one distance missing. Mr. Wickham: Apparently, there are a couple of errors. On the last course, there is no distance on the map and backing up five or six, the first course following 999 there is no course or distance. At least, if there are, I can't see them. The checklist is in order. I have the approval of the Highway Department, a letter from the County and a memorandum from our engineer. Everything seems to be in order. At this time, I will open the hearing for anyone that wishes to be heard in opposition to this subdivision, "Long Pond Estates, Section I" on Laurel Avenue in Southold. I would say that this has been before the Planning Board since it was first submitted in 1975. Hearing no one that wishes to be heard in opposition, I will hear from anyone that wishes to speak in favor. Planning Board - -2- ~pril 4, 1977 Richard Cron, Esq.: I am the attorney and in support of the application. As you have indicated, this map has been before the Board on a great number of occasions over a considerable period of time. We believe at this time that the map complies with all the subdivision regulations and think it will comply with any of the County Planning requirements. We would request a resolution granting approval to this application. Mr. Wickham: Is there anyone else that wishes to be heard in favor of it? Hearing none, I will declare the hearing closed and say that the requirements of the County will have to be met as outlined. The bond will have to be posted for improvements made, as the case may be. The final action of this board will be contingent on filling those requirements. Mr. Raynor: Have you resolved the problem of the rights-of-way? Will you have a problem? Mr. Cron: They will have more than adequate access. Mr. Wickham: Is there one at the north end and the south end? Mr. Cron: I don't think so. There are so many markings on the map that I don't know what they all are. Mr. Wickham: It came to my attention just two days ago that the property to the east has a right-of-way over this. Mr. Cron: This was originally for Goldsmith. I don't have any problem with the present owners and I will deal with Mr. Lang's attorney. The only ones that need access are the present owners of the Goldsmith property and we won't have any problem with them. Mr. Wickham: Is there anyone else that wishes to be heard? Hearing none, I will declare the hearing closed. Greenbriar Acres. Mr. Cron asked if the letter from Mr. Tuthill has been received as to the matching of the roads in this subdivision to those in Tut's Acres. Mr. Tuthill is bringing the letter in later this evening. Centennial Manor (Luglio). Mr. Cron discussed the revised maps of this subdivision showing the roads revised and the recharge basin squared off. This will be referred to the Town Engineer for his recommendations and comments. Cutchogue Joint Ventures. Mr. Cron presented sketch maps of this proposed subdivision in Cutchogue. Planning Board - -3- April ~, 1977 Nina Stevens. Mr. Cron presented revised maps of this proposed subdivision on Oregon Road. The Board will review this map. Reese subdivision, Soundview Avenue. Mr. Reese was present. He was told that the park aud playground is restricted to the property owners within the subdivision. On motion made by Mr. Raynor, seconded by Mr. Gordon, it was RESOLVED to approve the sketch map of the subdivision of Harold Reese located at Soundview Avenue, Southold, said map dated January 6, 1977 and amended March 25, 1977. Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon 8:00 p.m. - Public Hearing on proposed minor subdivision of Hermine Hillmer located on 01d Orchard Lane, East Marion. Mrs. Hillmer appeared. Mr. Raynor read the Notice of Hearing and presented proofs of publication in the L. I. Traveler-Watchman and the Suffolk Times. Mr. Wickham: I have a letter from the County Planning Commission which says that this is referred for local consideration but the following is markedon the map. "A short radius curve should be considered as it will facilitate turning of vehicles, especially trucks. It is suggested that private road be established along east property line rather than proposed location so that existing and proposed lots will be back-to-back. In using the road in its proposed location the vehicles may detract from the residential amenities of the existing properties." Mrs. Hillmer: I think the suggestion about relocating the road is a good idea. Mr. Wickham: Does anyone wish to be heard in opposition to this minor subdivision in East Marion? Hearing none, is there anyone that would wish to be heard in favor? There is also a stipulation here that no sewage disposal facilities be allowed to be installed within 100 feet of Marion Lake. That is a suggestion of County Planning. Does anyone wish to be heard on this subdivision? Hearing none, I will declare the hearing closed. Country Club Estates. Philip Babcock and Gary 01sen, Esq. appeared. Mr. Babcock is planning on selling some of the property to the North Fork Country Club for golfing. There also was a question about park and playground and Mr. Wickham said there are uniform requirements for everybody. If the property is deeded out to the North Fork Country Club, then it is no longer part of the subdivision. Mr. Olsen said that with all the open area around the subdivision, he didn't feel it would be necessary to have a park and playground. There was discussion about the Country Club having covenants and restrictions that the property would be open space for perpetuity. Mr. Babcock said he would approach the Board of Directors. The Planning Board ~- -4- pril 4, 1977 property on the road that is being held out of the subdivision should be designated as Section II. Mr. Olsen said there are no development plans for this area at this point. The developer is to supply an affidavit of ownership. Drainage will have to be determined. Mr. Wickham made a comment that he wasn't sure that the name "Country Club Estates" is appropriate and this should be checked out by Mr. Babcock. On motion made by Mr. Raynor, seconded by Mr. Coyle, it was RESOLVED to grant sketch plan approval to the map of "Country. Club Estates" subdivision owned by Philip Babcock and others dated December 22, 1976. Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon. Quail Run Estates. (Ben Mendozza). Gary Olsen appeared and asked what the status of this subdivision. The Planning Board is still waiting for a letter from the Superintendent of Highways. John Fellinger-Ihar. Mr. and Mrs. Fellinger-Ihar and Mr. Howard Young, P. E. appeared. Mr. Young would like to follow Mr. Barnett's grass waterway method of drainage, with a 12 foot wide grass waterway on the lots themselves to contain some of the runoff and eventually lead down to the sand drain and southerly of Mr. Ihar's present house and adjacent to the proposed park area. Mr. Young presented copies of the map. Mr. Wickham discussed the water coming from the Krupski farm to this property and the fact that the town has a problem in this area. Mr. Wickham said the town regulations say that they must take care of the water from 300 feet outside of the subdivision and this means 300 feet on every side. Mr. Wickham suggested that Mr. Young talk with the Superintendent of Highways and see what can be worked out. Mr. Young asked that before this goes any further, could the Planning Board refer it to Mr. Barnett for his recommendations, as he might be able to shed some light on how this could be resolved. The Ihars protested that the whole burden of the drainage problem in this area should not be thrust on them. Mrs. Ihar said the regulation is not fair. The secretary was directed to send the map to Mr. Dean, Mr. Tuthill and the Soil Conservation District. Mr. Raynor would like to see the park area more centralized because most lot owners can't get access without the children going out on the road. Some of the lots are large because Mr. Ihar hopes to sell them in one parcel. There was a question in Mr. Raynor's mind about Lot #1 being a flag- lot. Mr. Wickham said that ordinarily the Planning Board does not require that a person has access where the Planning Board thinks they ought to. Plauning Board ~ -5- April 4, 1977 John Vescur. Shepard Scheinberg, Esq. appeared. The minor subdivision wa~ reviewed with the Board studying the overlay map of the area. There was talk about the possibility of selling the property nearest to South Harbor Road to the adjacent farmers. Rand subdivision. Mr. Goldberg, William Smith and Mr. Rand appeared. Sample covenants and restrictions were presented. They want to tie the property on the south side of the road to the other lots. There is no specific area for park and playground. There will have to be covenants and restrictions filed as to no further subdivision for the lots and those on the south side of the road not to be built upon. Rights-of-way are being used that are not allowed in a major subdivision. The regulations say that roads in a major subdivision shall be constructed to Tow~ highway specifications. Mr. Wickham said we are having the building inspector say that in minor subs, they are going to have to construct to Town highway specifications because of a suit in Islip. Mr. Raynor said he had talked to the Town Attorney, Robert Tasker, and he said to eliminate the numbers across the road, because it would lead to confusion. Mr. Raynor also said the banks want a 25 foot right-of-way. Mr. Coyle said the State Dept. of Transportation doesn't like so many cuts. Mr. Wickham said the roads will have to be to Town specifications with 50 foot and 36 feet paved. Mr. Raynor thought all the property to the south should be put in common ownership in a property owners' association and designated as park and playground. There was discussion on making it a four-lot minor subdivision. Mr. Wickham thought the Board might waive the requirement for a highway built to town specifications on one corner because it is next to the Town Beach. Mr. Raynor asked if there were any existing rights-of- way and Mr. Rand said he didn't think so. Greenbriar Acres. A letter was presented from Lawrence M. Tuthill, Town Engineer, stating that the road now lines up with the road into Tut's Acres. On motion made by Mr. Coyle, seconded by Mr. Gordon, it was RESOLVED that the developer of Greenbriar Acres be authorized to provide the final maps for this subdivision. Vote of the Board: Ayes: Wickham, Coyle, Gordon Abstention: Raynor On motion made by Mr. Coyle, seconded by Mr. Raynor, it was RESOLVED that upon explicit instructions from the Town Attorney, Robert Tasker, the resolution dated March 21, 1977 disapproving the site plan of Barzac be rescinded and the site plan be approved. Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon. Planning Board ~ -6- A L1 4, 1977 Laurelwood Estates~ Section 1. Mr. John Rose had been into the office questioning the necessity of the turnaround by his property in this subdivision as there is a Section II pending. The Board agreed that the turnaround would not be necessary if Section II is filed. On motion made by Mr. Coyle, seconded by Mr. Gordon, it was RESOLVED to authorize the chairman to sign the maps of "Highland Estates" upon receipt of the inspection fee and the commitment on the lot adjacent to the Presbyterian Church. Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon. Mr. Schriever had been in the office questioning if he could start preparing maps for a subdivision on property that he has requested a change of zone. The Planning Board was in agreement that two actions cannot be pending at the same time on the same piece of property. Mr. Lawrence M. Tuthilll will be requested to prepare a bond estimate on the subdivision known as "Long Pond Estates, Section I." On motion made by Mr. Raynor, seconded by Mr. Coyle, it was RESOLVED to approve the minor subdivision of property of Hermine Hillmer, subject to the Suffolk County Planning Commission recommendation of relocating the right-of-way to the easterly side of the property. Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon There has been a sale of the park and playground in the subdivision known as "Northwoods" to a tax exempt corporation. This matter will be discussed with the Town Attorney and the Town Board. Motion was made by Mr. Gordon, seconded by Mr. Coyle and carried to approve the minutes of the meeting of March 21, 1977. On motion made by Mr. Coyle, seconded by Mr. Raynor, it was RESOLVED to approve the site plan of Glen Heidtmann dated February 12, 1976. Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon Planning Board ~- -7- April 4, 1977 The revised map of "Centennial Manor" is to be sent to Mr. Lawrence M. Tuthill, Town Engineer, for his review and recommendations. Motion was made, seconded and carried to adjourn the meeting.
