GORDON JAMES WALL Southold, N.Y. 11971 M I N U T E S April 18, 1977 TELEPHONE 765-1313 A regular meeting of the Southold Town Planning Board was held April 18, 1977 at 7:30 p.m. at the Town Clerk's Office, Main Road, Southold, New York. P~esent were: John Wickham, Chairman Henry E. Raynor, Jr., Vice-¢~airman Frank S. Coyle Frederick E. Gordon James Wall Mr. Wickham called the meeting to order at 7:30 p.m. Dr. Rosenburg subdivision. Dr. and Mrs. Rosenburg appeared. The map shows four lots plus a reserved area. Highways will have to be built to town specifications for five lots. If it is made into four lots, covenants and restrictions will have to be filed for no further subdivision of the oversized lots. 25 feet will be required for the right-of-way. Square the lots to make them more saleable. Reese subdivision. Gary McLean appeared for Mr. Reese. There was no action taken on this subdivision as a letter has not yet been received from the Town Engineer, Lawrence M. Tuthill. Baymen's petition for a change in the Code of the Town of Southold. Mr. Raynor and Mr. Coyle met with the Town Board on April 12, 1977. The.]changes that they request can be provided with a variance for a non-conforming use from the Board of Appeals. It is to be requested that the Town Attorney give the Planning Board a written opinion on this. Planning Board -2- ~ril 18, 1977 Mr. Raynor reported that he had met with the Town Board on April 12, 1977, along with Mr. Coyle regarding the sale of the park and playground at the Northwoods subdivision. If this park and play- ground has, in fact, been sold anyone who bought it can't put a dwelling on it and anyone who has purchased a lot has the right over the park and playground area and anyone else coming in would be subject to complaint of the property owners within the sub- division. Greenman & Pedersen engineering firm. Mr. Raynor and Mr. Coyle met with the Town Board on April 12, 1977 concerning this matter. Mr. Raynor reported that it seemed to be the concensus of the Town Board that we presently weren't utilizing our own engineers enough. It was noted that Ed Bage and Larry Tuthill had been reluctant to send bills to the Town of Southold. A lot of the work they never submitted bills for. Mr. Robson of Greenman & Pedersen will send to this board recommendations, outlines and procedures that they are currently using in other towns. Most of the discussion centered on the area of the Superintendent of Highways, i.e., the asphalt mixture, the type of construction of recharge, leaching and catch basins. The burden is on them to submit to us an outline of some of the services they perform for other townships. They would like to meet at a future date. On motion made by Mr. Raynor, seconded by Mr. Coyle, it was RESOLVED that the following recommendations of the Southold Town Conservation Advisory Council as regards the subdivision of property of Edward C. Booth be adopted: The Conservation Advisory Council members inspected the site of Edward C. Booth and others on the north side of Soundview Avenue on Saturday, March 19, 1977. Although several small pools of fresh water were found, none would be classified as fresh water wetlands. A maOor portion of the site constitutes a natural drainage and recharge area. Major alterations to the site of the turnaround area could possibly lead to significant erosive and drainage problems. We would further submit that the fragile ecology of the dune bluff and north of it should not be altered and would not be suitable for extensive recreation. Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon and Wall. Plarnaing Board -3- ._~ril 18, 1977 On motion made by Mr. Gordon, seconded by Mr. Wickham, it was RESOLVED to approve the final map of the subdivision known as "Blue Horizons" subject to the following: 1. Recommendations of the Suffolk County Planning Commission. 2. Bond amount approved and acceptance of the bond by the Town Board. 3. Receipt of inspection fee. 4. Letter of approval of roads and drainage from the Super- intendent of Highways. 5. Recommendations of the Southold Town Conservation Advisory Council and the Town Trustees as to the areas to be debogged and filled. Approval of the Town Board for the wetlamds application to debog and fill. Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon, Wall Centennial Manor (Luglio). Mr. Cron appeared. There was no action taken on this map as a letter from Mr. Tuthill with his recommenda- tions has not yet been received by this Board. Cutchogue Joint Ventures. Mr. Cron appeared. The following comments were made. The road should be at right angles to Route 25. There will probably be some recommendation from Mr. Tuthill about the reverse curves. Park and playground should be approximately one and one-half acres. It will be necessary to have an affidavit of ownership in the file. The Board would like to see an overlay of the property showing where the pond on the Cross property is located in relation to this property. If the road would go through the pond, the Planning Board will waive the road being in this location. Nina Stevens. Mr. Cron appeared. The map will have to show 100 foot setback lines from the bluff. Covenants and restrictions will be required for each shorefront lot that no application will be made to further subdivide. There was a question about the ten foot right-of-way to the beach area and Mr. Cron replied that no cars would be allowed there. Mr. Raynor suggested that it be restricted to a footpath. Planning Board -~- ~_~ril 18, 1977 Soundwood Farms (Rubin). Maps were supposed to be sent from Vsn Tuyl's office but the secretary can't find them. Contact Mr. Van Tuyl to see if they were sent out. Mr. Cron appeared on this matter. Long Pond Estates. Mr. Cron appeared. The recommendations of Lawrence M. Tuthill dated April 17, 1977 were gone over. The following were his recommendations. 1. Water level of recharge basin No. i is elevation 15.0 and adjacent inlet frame elevation is 13.03, which would mean ponding in the roads. 2. Road profiles have grades below 0.5% which does not allow for a good runoff. 3. The road profile of Center Avenue contains an artificial hill. Comments 1. Lot Nos. 7, 22, 23, 24, and 28 do not have 150 feet width at the building line. Mr. Cron took the paper copy of the map because he said he didn't have one. He will check these items out. Washburn Estate minor subdivision. Charles Cuddy, Esq., and William Schriever, Executor of the Estate, appeared. There was discussion about the fact that the parcel of property on which the homestead is located has been deeded to Warren Washburn and Mr. Schriever as Trustee for the two younger children. One of the members of the Planning Board will contact the Town Attorney to see if this is alright. Mr. Cuddy argued that if a piece of property can be deeded over to a wife and the remainder go for a four-lot minor subdivision, wouldn't this be the same thing. Zaino & Sardelli. Rudy Bruer, Esq., appeared. It will be required that a covenant be filed on lot #6 for no further subdivision. On motion made by Mr. Raynor, seconded by Mr. Gordon, it was RESOLVED to approve the sketch plan of the map of property of Zaino & Sardelli, said map amended March 23, 1977. Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon and Wall. Planning Board -5- ~pril 18, 1977 Hoey & Daly. Mr. Raynor has not had the opportunity to inspect the runoff from this property. He requested a copy of the map so he can make an inspection in the near future. C. E. Allen Peter Kreh Mr. Raynor has inspected the property of both of these applicants for minor subdivisions. He requested that another member of the Planning Board call him to make arrangements to go on another inspection. Simon minor. The Town Engineer had requested a catch basin be placed in the town highway by lot #3 on this map. Mr. William Wickham, attorney for the Simon Estate, wrote that he had met with the Superintendent of Highways and there was a question about an individual doing work in the town road. He asked that the require- ment be waived. Mr. Wickham will contact the Superintendent of Highways to request something in writing as to his opinion on this. So.u~dview Restaurant addition. Irving L. Price, Jr., Esq., Jack Levin and Gordon Ahlers, P. E., appeared. Mr. Ahlers commented that permission has been obtained from the Department of Environmental Conservation, the Army Corps of Engineers, the Department of Public Works to go under the roads for sewage, the sewage has been approved, approval has been obtained from the Greenport Utilities, a permit for the parking lot and approaches to the area from the Suffolk County Department of Public Works, permission from the Board of Appeals to put the parking where it is on the map. He showed pictures that cars do not jut out onto the highway. Everything on the plans has been approved by the authorities that regulate. The Building Inspector indicated in a letter dated December lC, 1976 that parking would be required for 40 cars. It was remarked that there is trouble with the parking in front of the restaurant. There is not sufficient area without going out to the highway. Mr. Ahlers said it was alright according to the Dept. of Public Works. Mr. Wickham said it was not alright according to the ordinance of the Town of Southold. 200 square feet is shown and he needs 350 square feet. Mr. Ahlers said this is an extension of a non-conforming use and even if they didn't build, the parking would be as it is now. Mr. Wickham said his instructions from the Town Attorney were to meet the requirements. There is no recent letter in the file from the building inspector and Mr. Wickham will contact him for this. Colgate Design Corporation - 7-11 store, site plan. The following will be necessary for study of this site plan. Planning Board -6- ~ril 18, 1977 1. Front, side and rear profiles of the building. 2. Computation on parking. Parking slots are not adequate in size. 3. The loading space shown is not properly located. There is no indication as to how many loading zones are necessary. 4. Lighting schedule. Plan shows two lights in the front of the building. There should be an additional two in the rear. 5. There are no side yard plantings indicated. 6. There is a notation of typical test hole but no location of such show~. 7. Show municipal sewer and water on map. Village sewer goes right past front and should probably be hooked into. 8. Proposed sign looks as though it is too close to the highway. On motion made by Mr. Raynor, seconded by Mr. Gordon, it was RESOLVED to accept the design of the lots 7 through l0 on the Sound on map of property of Nina Stevens dated November 10, 1976 because of the fact that the lots are 50% oversized. Vote of the Board: Ayes: Wickham, Ray-nor, Coyle, Gordon and Wall. On motion made by Mr. Raynor, seconded by Mr. Gordon, it was RESOLVED to grant sketch plan approval to the map of 01msted and Haas as amended March 10, 1977 and to hold a public hearing on same. Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon, Wall Mr. Coyle made a motion, seconded by Mr. Gordon and carried to approve the minutes of the regular meeting of April 4, 1977. Fellinger-Ihar drainage. The Supt. of Highways should talk with Mr. Ihar about acquiring some property for drainage.
