A regular meeting of the Southold Town Planning Board was
held May 2, 1977 at 7:30 p.m. at the Town Hall, Main Road,
Southold, New York.
Present were:

Vice-Chairman Raynor called the meeting to order at 7:30 p.m.
7:30 p.m. Public Hearing for the minor subdivision of Olmsted
and Haas. Mr. Raynor read the notice of hearing and produced
an affidavit of publication from the Suffolk Times.
Mr. Raynor: As is the usual procedure, I will ask for anyone
that has any objection to this particular subdivision, any
information in opposition to this subdivision to bring before
this board at this time. Hearing none, I will ask if there is
anyone present that would like to speak in favor of the application
for a minor subdivision.
Richard 01msted: Basically, what we are trying to do is get tax
relief by dividing the property into three lots with two waterfront
lots.
Mr. Raynor: This particular map has been before the Planning Board
for most of the winter and into the spring and presented as a
sketch form in February and has been gone over as to constructing
the right-of-way. Each lot is in excess of ~0,000 square feet
which is the minimum requirement of the Town of Southold. The
applicant has submitted a fee and in the file we have a description
of the property and the application itself. This particular
subdivision has no road construction. Therefore, it will not be
necessary to have a bond set or the superintendent of highways
have to give any particular approval of same. Is there anyone
here this evening that has any information for this board that
should be brought to this board at this particular hearing concern-
ing this particular piece of property?

Mr. Coyle: I think there probably should be a form filed that
these shall not be subdivided again. One is an acre and a half
and one is pretty near an acre and a half.
Mr. Raynor: Any lot that is in excess of 40,000 by a large margin,
the board has always requested a covenant or restriction be put
on lots so a purchaser would not subdivide the premises. We have
the forms in the office. It is a standard form that the town uses.
Mr. Olmsted: I do not object to signing a form but is it legal?
Who am I to tell them. If I sell it, the property is not mine.
Mr. Raynor: In reference to that, the Town of Southold is one of
the few towns that operate under the minor and major subdivision
ordinance. You have applied for a minor. What this does is save
you road construction and further improvements on the property.
We have been told by the Town Attorney that anything in excess of
this should be covenanted as such that it cannot be subdivided
so it eliminates not going below the standards. If one of these
lots were divided it would bring down the standards below the
minimum.
Mr. Gordon: It should be so stated on the final map, too.
Mr. Wickham arrived at this point in the meeting. (7:40 p.m.)
Mr. Raynor: Has anyone else anything to bring up? Hearing none,
I will declare this hearing closed.
Zeidler and Bloom. The Messrs. Zeidler and Bloom who are members
of Countrywide Management Corporation appeared for information.
They are owners of 75 acres on Albertson's Lane and Middle Road.
They also own a 25 foot strip to the Sound which the board requested
be shown on the map that they finally bring in. What they showed
the board was a possible cluster concept subdivision. They did
not leave any copies of the proposal. Mr. Wickham informed Mr.
Bloom that they cannot use land which is not buildable for a base
for the cluster. A determination would have to be made as to what
could be used as a basis for the cluster. Mr. Wickham said some
towns and DEC standards allow wetlands to be used for clustering
but the Town of Southold does not. In this case, it will make a
difference. Mr. Raynor said one of the considerations would be
to show test borings to see what they have. The first step would
be to have the proper number of sketches submitted from a field
survey.
Rosenberg minor subdivision. Mr. Rosenberg had called requesting
information on how he could subdivide his property. The board
agreed that he could combine lots i and 3. The right-of-way could
be maintained at the 16 foot width but a dotted line should show
25 feet. The frontage and driveways should all be from the right-
of-way.

Horton Farm Estates.
On motion made by Mr. Wickham, seconded by Mr. Gordon, it was
P~ESOLVED to hold a public hearing on the preliminary map of
the subdivision known as "Horton Farm Estates" located at Cutchogue,
owned by Richard Young and others.
Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon
A follow-up letter is to be sent to the Superintendent of Highways
and the Town Engineer requesting their recommendations in time for
the public hearing.
Mr. Raynor read the recommendations of the Town Engineer, Lawrence
Tuthill, regarding the following subdivisions:
Sterling Forest, Reese
Centennial Manor, Luglio
Cutchogue Joint Ventures
The recommendations will be discussed later in the meeting when
Mr. Tuthill arrives.
Colgate Design Corporation. Mr. Amato and another gentleman appeared.
A new site plan was presented. They also presented 3 copies of
side, front and rear profiles. One copy of each is to be given to
the building inspector. There was discussion about easterly line
planting. Water runs past this area but sewer doesn't according
to what the developers found out from the Greenport Utilities
Dept. Mr. Wickham was concerned about storm water.
George and 0pal Akscin minor subdivision, Southold. The secretary
was asked to find out if the Reydon Shores subdivision is an
excepted subdivision. The Akscins will call for an appointment
when they have a full drawing of the property.
Rand subdivision. Mr. Rand appeared.
A letter was read from Mr. Rand where he requested waiver of the
requirement for a town road to be built to service one lot in the
subdivision. The Southold Town Conservation Advisory Council has
been asked to make an inspection of the property as far as wetlands
are concerned and they will make their report shortly after the
18th of May when they meet.
Mr. Raynor reported that on April 20, 1977, he, Mr. Coyle and Mr.
Gordon made an inspection of the Washburn minor subdivision, Rand
subdivision and Paradise-by-the-Sound.

Soundview Restaurant. The Board reviewed the site plan submitted
for this extension. They reviewed the building inspector's comments
on it. There is a letter in the file from the Suffolk County Dept.
of Public Works stating that the parking on the north side of the
road is the concern of the Town of Southold, not the County.
Lloyd Terry. Mr. Terry is desirous of making a minor subdivision
within a large tract of property. He will make a decision and
bring it back to the board. His problem seemed to be one of
economics with the farming he is currently doing on the property.
Washburn Estate minor subdivision. Mr. Charles Cuddy, Attorney,
and Mr. Schriever appeared. Mr. Cuddy requested that the~board
treat this as a minor subdivision, rather than a major. The one
lot has been deeded into the name of the Trust for the children
and the one child who is of age. The remainder is still in the
estate. Mr. Raynor said that the Town Attorney said it would be
a matter of how the will was made out and Mr. Cuddy replied that
the will left everything to the children with Mr. Schriever as
executor and trustee for the minor children. Mr. Cuddy will
discuss this with Mr. Tasker again.
Hale and Hughes minor subdivisions. The board reviewed these
two minor subdivisions. The covenants to not further subdivide
have been filed in the County Clerk's Office. Mr. Wickham
suggested that a dotted line be placed on the map of Hale 100
feet back from the bluff. The maps are ready to be signed and
Mr. Wickham will come into the office during the week to sign them.
Kirchgessner minor subdivision. A determination will have to
be made as to who owns the two 20 foot jogs and they will have to
be disposed of one way or another.
The board was apprised of the Environmental Quality Review Act
seminar to be held at the Medford Inn on May 5, 1977. Mr. Raynor
will attend this session.
Galardi restaurant at Boatmen's Harbor, Cutchogue. Correspondence
was read from the Fleets Neck Property Owners Association regarding
their objection to this property being used for a restaurant. The
reading of the letter was for information only as this has not come
before the Planning Board yet.

Motion was made by Mr. Coyle, seconded by Mr. Gordon and
carried to approve the minutes of the meeting of April 18, 1977.
Mr. Bear appeared before the board regarding the development called
Nunnakoma Waters in Southold. There were several lots held out by
the Health Department at the time this map was filed, such lots not
to be built upon until public water is available. The Department
of Health now says underground water is available in suf£icient
quantities and quality for these lots to be sold and built upon.
Mr. Bear objects to these lots being built upon. The Planning
Board will have to study this matter and also check to see if this
development is on the excepted list of subdivisions in the Town of
Southold. Mr. Bear is a former member of the Nassau County
Planning Commission and has been named to the Planning Committee
of the Southold Town Meeting group. He offered his assistance in
any matter which the Planning Board would like it.
Schackman minor subdivision. This subdivision is proposed to have
two lots in the business district and two lots in the residential
district, each of which is over the acreage required. The Planning
Board would like two 50 foot rights-of-way designated on this map.
One should be directly in back of the business property and the other
on the northerly end. These should also contain the wording
"reserved for possible future dedication to the Town of Southold".
The attorney, Gary Olsen, is to be informed.
Gibbons minor subdivision. The adjourned public hearing will be
continued at the next meeting of the Planning Board to be held
May 23, 1977.
Sleepy Hollow. The secretary is to again write to the Superintendent
of Highways, the Town Engineer and the Town Highway Committee as to
their action on the relocation of the 100 foot turnaround for this
development.
The Planning Board had been requested by the Town Board to review
the services that could be made available from the Greenman and
Pedersen Engineering firm. Mr. Jack Robson sent a proposal of the
services the firm would render and requested a meeting with the
Planning Board to discuss the matter. The Planning Board, upon
review of the proposal, decided that these services were already
being rendered by the two local engineers and they see no use for
the services of this firm.

On motion made by Mr. Raynor, seconded by Mr. Wickham, it was
RESOLVED that upon a mutual agreement with the attorney for
the developer of Long Pond Estates, action will be postponed on
the final map which, as presented, is not acceptable to the Suffolk
County Planning Department as being in final form.
Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon
On motion made by Mr. Coyle, seconded by Mr. Gordon, it was
RESOLVED to approve the map of the minor subdivision of
property of Olmsted and Haas, revised March 10, 1977, subject to
recommendations of the Suffolk County Planning Commission and
restrictions being filed in the Suffolk County Clerk's Office as
to no further subdivision. It should also be stated on the map
that the property cannot be further subdivided.
Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon
Colgate Design Corporation site plan was further discussed. The
secretary is to deliver one copy of the site plan to the Building
Inspector for his determination on the zoning requirements and
parking sufficiency. Buffering will be required along the fence.
Drainage should be figured based on a 6 inch rainfall rather than
a 2 inch as shown.
On motion made by Mr. Wickham, seconded by Mr. Coyle, it was
RESOLVED to waive the requirement of a fifty-foot road built
to town specifications on the west side of the property and use a
25 foot right-of-way between lots 3 and 4 on the condition that
the developer of the Rand property in East Marion include lot 1
with lot 8. There will also be required a 25 foot right-of-way
on the east side of the property.
Vote of the Board: Ayes: Wickham, Coyle, Gordon
Nay: Raynor
The recommendations of Mr. Lawrence M. Tuthill, Town Engineer,
on the subdivisions of Sterling Forest, Cutchogue Joint Ventures
and Centennial Manor were accepted by the Board and will be
forwarded to the developers or their representatives.

The next meetings of the Planning Board will be held on
May 23, 1977 and June 6, 1977.
Motion was made by Mr. Coyle, seconded by Mr. Gordon and
carried that the meeting be adjourned. Meeting was adjourned
at ll:O0 p.m.
