GORDON JAMES WALL Southold, N.Y. 11971 TELEPHONE 765-1313 A regular meeting of the Southold Tovrn Planning Board was held May 23, 1977 at 7:30 p.m. at the Town Hall, Ma~n Road, Southold, New York. Present were: John Wickham, Chairman James Wall Frank S. Coyle Absent were: Henry E. Haynor, Jr. Frederick E. Gordon 7:30 p.m. Public Hearing - "Horror Farms Estates" Richard E. Young appeared. Mr. Wall read the legal notice of hearing and proof was presented that it was published in the L. I. Traveler-Watchman an~ Suffolk Times. Mr. Wickham went over the checklist and read the following recommendations of the Suffolk Count~Dep~. o~-Planning. Dear Mr. Wickham: In accordance with your request, the staff has examined the proposed subdivision layout for a 22.~7 acre tract reputedly owned by Richard Young, et al, and offer the following comment on the map for your use. It is the opinion of the staff that the layout for the sub- division of the tract will be satisfactory provided that no storm water runoff will enter the drainage cha.nnels on the property To the west. According to our information (see enclosed topo map) these channels eventually flow into East Creek. Staff comments on a preliminary map do not constitute a review of the map by the Suffolk County Planning Commission. When the map has been finalized it should be referred to the Commission for review pursuant to Section 1333 of the Suffolk County Charter. /s/ Charles G. Lind Subdivision Review Section Planning Board - -2- - May 23, 1977 The following memorandum from Larry M. Tuthill, Town Engineer, under date of May 17, 1977 was introduced: 1. Recommend reverse curves on Horton Farm Lane be eliminated and there be 200' tangents between curves. Since the ground water table appears to be at elevation 2.0' it is recommended that the bottom of the recharge basin elevation be raised to 3.0' and the area of the basin be enlarged to accommodate the loss in volume. 3. Recommended that the permissible side slope on the entrance to the park and playground be I on 10. Mr. Wickham: I do not have a current letter from the Superintendent of Highways but besides that the file seems complete. I will open up the hearing now to anyone that is in opposition to this sub- division. Question from unidentified man: Is it regular one acre~ zoning going in? Mr. Wickham: Yes. Hearing none, I will ask for those that are in favor of this subdivision. Mr. Young: I have nothing to been going on for many years. wants me to do. say. It presents itself. It has I have tried to do what the town Mr. Wickham: I would like to say at this time that every subdivision that comes before this board must meet the requirements of the Town as to the acre and the requirements of the County as to drainage and as to water supply and sewer disposal and so on. We on the Planning Board are not allowed any latitude. They must meet our requirements. The obvious corollary to this is if a developer does meet all the requirements, the Planning Board may not say no. If there is nothing more to come before this hearing, I will declare the hearing closed and we will take action later this evening. Gehlmeyer site plan. Mr. Gehlmeyer appeared. The surface on the parking lot was discussed and Mr. Gehlmeyer said he wanted to use gravel. Mr. Wickham questioned the advisability of this. Greene division of land. A letter had been received from an attorney for the Greenes to divide a piece of property. It was determined that one lot is in the West Creek development and the other is a triangular piece adjacent to it on Grissom Lane which is in the Sleepy Hollow development. It was the consensus of the board that these people should go to the Board of Appeals for access to the rear lot. Planning Board ~ -3- -~ay 23, 1977 Wilsberg subdivision in Orient. On motion made by Mr. Wall, seconded by Mr. Coyle, it was RESOLVED to refer to the Town Board the proposed cluster subdivision of property of Ernest Wilsberg located in Orient for its determination as to whether it can be developed in the cluster concept. Vote of the Board: Ayes: Wickham, Coyle, Wall A meeting will be arranged for the discussion of the two changes of zone requested by Zabohonski, this meeting to be held on June 2nd. On motion made by Mr. Wickham, seconded by Mr. Wall, it was RESOLVED to grant sketch plan approval to the map of Dr. Meyer Rosenberg, property located at Indian Neck, Peconic, said map amended May 16, 1977. Vote of the Board: Ayes: Wickham, Coyle, Wall The property of Mever Rosenberg will require covenants and restrictions to be filed in the Suffolk County Clerk's Office as to no further subdivision of the land. Motion was made by Mr. Wall, seconded by Mr. Coyle and carried to approve the minutes of the regular meeting of May 2, 1977. Rand subdivision in East Marion. Mr. Rand, William B. Smith cud Mr. Goldberg, the attorney, appeared. Mr. Goldberg presented the application completed in duplicate. Mr. Wickham read the letter from the Southold Town Conservation Advisory Council dated May 19, 1977. Gentlemen: Our council inspected the Rand properties on May 7, 1977 as you requested. No wetlands were located on lots l, 2, 5, 6, 7 and 8. Wetlands were indicated on the "A" lots south of the state highway. A small area of bog and brackish water was located near the highway on lots 3 and 4. /s/ Frank A. Kujawski, Jr. Planning Board -4- May 23, 1977 It was determined by the board that there is more than enough property on lot 3 and ~ is oversized allowing plenty of land for a dwelling. The approval of the Tow~ Highway Committee for the roads has not been received which is necessary. The Board will require covenants that the lots on the south of the road can never be built upon. The Highway Committee will be contacted for a waiver. Fischer Estate. Rene Gendron appeared. Mr. Gendron requested a minor change in the right of way which will result in a change of three lots. On motion made by Mr. Coyle, seconded by Mr. Wall, it was RESOLVED to hold a public hearing on the amended map of the minor subdivision of property of the Fischer Estate, if such is necessary when there is a change of right-of-way location. Vote of the Board: Ayes: Wickham, Coyle, Wall On motion made by Mr. Wickham, seconded by Mr. Coyle, it was RESOLVED that in all cases involving rights-of-way in minor subdivisions which are not required to meet the town specifications for highway construction that one of the town engineers inspect the premises and using a soils map recommend the type of road suitable for such subdivision, such findings to be written. Vote of the Board: Ayes: Wickham, Coyle, Wall On motion made by Mr. Wall, seconded by Mr. Coyle, it was RESOLVED to grant sketch plan approval to the map of property known as "Folly Beach Limited" located at Mattituck, said map dated November 17, 1976. Vote of the Board: Ayes: Wickham, Coyle, Wall On motion made by Mr. Wall, seconded by Mr. Coyle, it was RESOLVED to grant sketch plan approval to the map of property of Peter Kreh located at Mattituck, said map dated December 14, 1976. Vote of the Board: Ayes: Wickham, Coyle, Wall Planning Board - -5- May 23, 1977 Mary W. MacNish minor subdivision. Abigail Wickham, Esq., appeared. This map was discussed with Ms. Wickham. It will be necessary to have the right-of-way 25 feet in width. A variance will be required from the Board of Appeals for the undersized lot. Ms. Wickham will come back to the Planning Board after the variance application has been processed. Stephan Minakyan minor subdivision. Abigail Wickham, Esq., appeared. Mr. Wickham suggested that nothing should be done on this minor subdivision until they have a contract from the county for the farmland in the County program. Appolonia Kirchgessner minor subdivision. Abigail Wickham, Esq., appeared and presented a letter signed by William Wickham, Esq., that the twenty foot strips would be conveyed to the adjoining ow~ners upon approval of the minor subdivision. On motion made by Mr. Wall, seconded by Mr. Coyle, it was RESOLVED to hold a public hearing on the map of the minor subdivision of property of Appolonia Kirchgessner. Vote of the Board: Ayes: Wickham, Coyle, Wall Greenbriar Acres. Richard Cron, Esq., appeared. Mr. Cron was prepared to present the final linens on this subdivision but it will be necessary that they go to the Real Property Tax Service Agency for county map numbers before they are filed. Mr. Adel will be presenting his bond for the roads and improvements in the near future. Nina Stevens. Richard Cron, Esq., appeared. Mr. Cron presented six copies of amend sketch map of this subdivision. On motion made by Mr. Coyle, seconded by Mr. Wall, it was RESOLVED to grant sketch plan approval to map of subdivision of Nina Stevens located at Cutchogue, New York, said map amended May 12, 1977. Vote of the Board: Ayes: Wickham, Coyle, Wall Planning Board -- -6- May 23, 1977 Cutchogue Joint Ventures. Richard Cron, Esq., appeared. There was discussion about the sufficiency of the park and play- ground. Mr. Cron will discuss this again with the engineer and come back at the next meeting. Soundwood Farms. Richard Cron, Esq., appeared. There was a suggestion to widen the entrance to the park and play- ground. The attorney would prefer to leave it narrow and designate it as a footpath. Mr. Wickham suggested that he put a minor subdivision on the Sound and go for farmland acquisition on the rest. Mr. Cron will discuss it with his client but felt he would feel negatively about it. On motion made by Mr. Coyle, seconded by Mr. Wall, it was RESOLVED to grant sketch plan approval to the map of the Walter Washburn Estate at East Marion, said map dated May 3, 1977 and hold a public hearing on same. Vote of the Board: Ayes: Wickham, Coyle, Wall Schriever change of zone application on property on Tabor Road from A to B Light Business. Mr. Cuddy and Mr. Schriever appeared. Mr. Cuddy asked the board to give consideration on the basis that every community has to have some business property. Mr. Schriever is the owner of property that would be utilized in the future for business if there is ever a business district in the Hamlet of Orient. Tabor Road would be most logical because it could be extended down to King Street. This board and the Town Board in 1968-69 said that this is the place to have business property, at least on the west side of the road. Mr. Wickham noted that there is a cemetery there and the board would insist on a buffer and always notifies the cemetery association. Lawrence M. Tuthill arrived at 9:40 p.m. On motion made by Mr. Coyle, seconded by Mr. Wall, it was RESOLVED to approve the site plan dated April 20, 1977 of proposed addition to the Soundview Restaurant, County Road 27, Greenport, said map to be signed by the chairman after he had a consultation with the building inspector as to reservation for possible expansion of the parking area. Vote of the Board: Ayes: Wickham, Coyle, Wall Planning Board -7- May 23, 1977 On motion made by Mr. Coyle, seconded by Mr. Wall, it was RESOLVED to grant approval to the preliminary map of "Horton Farms Estates" subject to the following recommendations of the Town Engineer, Lawrence M. Tuthill: 1. Recommend reverse curves on Horton Farm Lane be eliminated and there be 200 foot tangents between curves. 2. Since the ground water table appears to be at elevation 2.0' it is recommended that the bottom of the recharge basin elevation be raised to 3.0' and the area of the basLu be enlarged to accommodate the loss in volume. 3. Vote of the Board: Ayes: Wickham, Coyle, Wall On motion made by Mr. Coyle, seconded by Mr. Wall, it was RESOLVED to approve the site plan of the property of Robert V. Gehlmeyer located at Southold, subject to determination of type of surface on parking area on which Mr. Wickham will meet with the building iuspector. Vote of the Board: Ayes: Wickham, Coyle, Wall On motion made by Mr. Wall, seconded by Mr. Coyle, it was RESOLVED to grant sketch plan approval to the map of property of Charles Rand to be known as "Brionngloid-by-the-Sea, said map amended May 18, 1977, subject to a waiver from the Town Highway Committee on the construction of roads to town specifica- tions. Vote of the Board: Ayes: Wickham, Coyle, Wall It was the consensus of the Board to send the cluster concept subdivision map of James Bitses to the Southold Town Conservation Advisory Council as the question of buildable land was raised by the Town Board in its review of this matter. On motion made by Mr. Wall, seconded by Mr. Coyle, it was RESOLVED to grant site plan approval to the plan of Colgate Design Corporation for property located at Greenport, said map revised May 23, 1977, and to be signed upon receipt of Suffolk County Health Department approval. Vote of the Board: Ayes: Wickham, Coyle, Wall Planning Board - -8- May 23, 1977 It was the consensus of the Planning Board that the following should be done regarding the Simon minor subdivision of property on Wells Road, Peconic. Put a leaching pool on the property at lot no. 3 to connect to the catch basin on the road. The next meeting of the Planning Board will take place on June 2 at Fishers Island, followed by a regular meeting on June 6 and the following meeting to be held June 27. Motion was made by Mr. Coyle, seconded by Mr. Wall and carried to adjourn the meeting. Meeting adjourned at 10:45 p.m. Respectfully submitted, Muriel Brush, ~ecretary
