A regular meeting of the Southold Town Planning Board was
held June 6, 1977 at 7:30 p.m. at the Town Hall, Main Road,
Southold, New York.
Present were:
John Wickham, Chairman
Henry E. Raynor, Jr., Vice-Chairman
Frank S. Coyle
Frederick E. Gordon
Absent was:
James Wall
On motion made by Mr. Coyle, seconded by Mr. Gordon, it was
RESOLVED to hold a public hearing on the map of the minor
subdivision of property of Peter Kreh.
Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon

On motion made by Mr. Gordon, seconded by Mr. Ray-nor, it was
RESOLVED to grant sketch plan approval to the minor subdivision
of property of David Brawner as outlined on map amended April l,
1977, subject to covenants and restrictions being presented that
the remainder of the property will not be developed unless it is
presented as a major subdivision.
Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon

Harold Reese. Sterling Forest. Mr. Reese appeared.
The recommendations of the Town Engineer, Lawrence M. Tuthill, for
a recharge basin among other things were reviewed. Mr. Reese said
they had taken three or four test holes to about 14 feet and found

there was not clay, there was loam. The southerly end is almost
pure sand and gravel. He said Mr. VanTuyl seems to think that a
leaching basin at each end would be sufficient. Mr. Wickham
suggested that when the next test hole is done, one of the Town's
inspectors should be there. It should also be shown on one of
the maps. It should be done for each one of the catch basins.
Mr. and Mrs. John Fellinger-Ihar. Mr. and Mrs. Ihar appeared.
Mr. Scheinberg, the attorney, appeared.
Mr. Ihar presented five maps and it was noticed that lot #22 does
not have sufficient frontage. There was also discussion that the
park and playground area was not sufficient. Mr. Wickham said
lot #22 should be put into the park and playground area. Mr.
Scheinberg asked if they could sell the lots along the road
without the completion of the access roads. Mr. Wickham said they
could sell all the lots on the road once they have a filed map.
Mr. Wickham would like an update on the sand swales from the Soil
and Water Conservation District. The recommendations already
received were on a former map. Mr. Raynor asked about the ease-
ment being paved over and Mr. Scheinberg said the Supt. of High-
ways had indicated that they could grass it over. They were
requested to get a letter from the Supt. of Highways about this.
Mr. Tuthill suggested that a 15 foot easement for access to the
recharge basin be in the back of lot #17 and make the front ease-
ment only for the piping to the recharge basin and not access.
Joseph Sowinski minor subdivision. Thomas Sowinski, son of Mr.
Sowinski, appeared.
This is a split of property from the Dalchet Corporation. Mr.
Wickham said that the Planning Board had received a promise from
the Dalchet Corporation that they would not dispose of any more
lots without a major subdivision and it appears they have
violated their promise. As far as Mr. Wickham is concerned, this
Board is not prepared to approve a minor subdivision in view of
this promise to the Board. Mr. Wickham said this would be taken
up with the Town Attorney.
Richmond Creek Farms. (Skwara farm) John R. McNulty, Esq. appeared.
Mr. McNulty presented new maps and apparently there was a mis-
understanding of what had been said at a previous meeting. It
was mentioned that the grid pattern was not acceptable and what
the Board meant to say was they wanted the intersections offset.
There should be no access as much as possible from the State road.
There was an extensive discussion about this layout and Mr. McNulty
will resubmit.

Gatz cluster. Mr. and Mrs. Walter Gatz appeared.
Mr. Raynor questioned the one-foot strip and Mr. Gatz said the
matter is being settled by his attorney. It will be necessary to
have a 100 foot setback line from the top of the bluff and a
50 foot setback from the road. They should keep about a 60 foot
area. Provisions should be made for drainage.
Rand subdivision. William B. Smith and Charles Rand appeared.
Mr. Wickham had a question regarding the additional covenant and
restriction for the Brionngloid-by-the-Sea subdivision owned by
Mr. Rand. Mr. Rand added the words "north of Route 25", initialled
it and signed the bottom. This was dated 5/23/77. Mr. Raynor
remarked that he couldu't find anything in the restrictions
regarding resubdivision of any lots.
On motion made by Mr. Coyle, seconded by Mr. Gordon, it was
RESOLVED to hold a public hearing on the preliminary map of
the subdivision known as "Brionngloid-by-the-Sea" owned by
Charles Rand and located in East Marion.
Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon.
On motion made by Mr. Coyle, seconded by Mr. Gordon, it was
RESOLVED to release for sale lot no. 7 as shown on the
subdivision map of "Brionngloid-by-the-Sea" in East Marion,
subject to receipt of covenants that lots l, 2, 3, 6 and 7 will
not be further subdivided, such covenants to bind the successors
in title.
Vote of the Board: Ayes: Wickham, Coyle, Gordon
Nay: Raynor
Mr. Raynor asked to go on record as to the reason he was opposed
to the above resolution. He questioned the releasing of a third
of the subdivision without consultation with the Town Attorney
as to the legality of the action.
There was further discussion regarding requiring five per cent of
the area for park and playground.
Kouros. Edward Boyd, Esq. appeared.
There was discussion regarding selling the piece of property with
the 50 foot jog. Mr. Wickham said the Planning Board would insist
that no one of these lots be further subdivided except to sell
the 50 foot piece to one of the adjacent lot owners. Mr. Boyd
will bring in the sketch plan.

Ferend property. David J. Driscoll appeared.
Mr. Driscoll presented a drawing of a cluster concept major
subdivision. Mr. Raynor said there is a private right-of-way
to this property and for a major subdivision there has to be a
50 foot road. The Planning Board will not approve of any major
subdivision unless it has highways to town specifications. Mr.
Driscoll has several options. To have five lots, he must
determine if he can get the 50 feet necessary up to the property.
If that avenue is closed, then a different map has to be drawn
up to show a four lot minor with the garage on it and go to the
Board of Appeals and say it has living quarters over it and you
have a hardship. Mr. Driscoll will discuss the matter with his
colleagues.
Schriever change of zone application. The following letter is to
be directed to the cemetery association. "We have a petition for
a change of zone of property of William and Barbara Schriever
presented to this board by the Town Board for our recommendations
and we note that it is adjacent to the Orient Cemetery. We would
appreciate having any comments from your association."
Mr. Wickham would like all copies of correspondence from Mr.
Schriever forwarded to the Planning Board.
Bitses subdivision.
Mr. Bitses is to be asked for more information on his proposed
cluster concept subdivision. His meadowland must show on the
map. Dikes, if any, must show on the map. Any land s~bject to
flooding cannot be used in computation. Article XIII ~100-136 A (1)
In computing the maximum number of lots that may be created, any
lands which are subject to flooding or which are occupied by
public utility easements in such a manner as to prevent their use
and development shall not be considered part of the total gross
area.
On motion made by Mr. Gorden, seconded by Mr. Raynor, it was
RESOLVED to authorize the chairman to sign the maps of the
subdivision of D. T. and G. H. Smith.

Planning Board
Albertson & Pfeil site plan.
The following deficiencies were noted in the site plan presented
by Albertson & Pfeil for the project "Colonial Corners":
1. No designation of parking slots.
2. No lighting schedules.
3. No planting schedules.
4. No ingress and egress shown.
5. Front, rear and side profiles of any new construction.

The next meeting of the Planning Board will be held June 27, 1977.
Motion was made by Mr. Coyle, seconded by Mr. Raynor and
carried to adjourn the meeting.
