GORDON JAMES WALL Southold, N.Y. 11971 MINUTES TELEPHONE 765-1938 A regular meeting of the Southold Town Planning Board was held July 18, 1977 at 7:30 p.m. at the Town Hall, Main Road, Southold, New York. Present were: John Wickham, Chairman (9:00 p.m.) Henry E. Raynor, Jr., Vice-Chairman Frank S. Coyle Frederick E. Gordon James Wall 7:30 p.m. Public Hearing on the minor subdivision of property of George and Opal Akscin. Mr. and Mrs. Akscin appeared. Mr. Raynor read the notice of hearing and presented affidavits of publication from the Suffolk Times aud the Long Island Traveler- Watchman. Mr. Raynor: This has been before the board in April, May, June and July. (Mr. Raynor went over the checklist.) There are no requirements for highway construction so there will not be a letter from the Superintendent of Highways or the Highway Committee. As is the policy, I will ask if there is anyone present that would like to speak in opposition to the subdivision of George and Opal Akscin. Hearing none, I would like to ask if there is anyone that would like to speak in favor. Mr. Akscin: I am in favor of it. Mr. Raynor: Is there anything that has transpired since you last met with us? Mrs. Akscin: We changed the highway so it is 150 feet on that lot. There are no changes other than that. Mr. Raynor: Is there anyone that has any information pro or con that they would like to bring before the board? Planning Board -2- ~y 18, 1977 Mr. Raynor: You will have to pick up the form for covenants and restrictions as to no further subdivision of lot number 3. We will ask for recommendations of the tow~ engineer as to the type of surface required on that right-of-way. In the past, it has been a dustfree surface. Mrs. Akscin asked if the road would have to be completed right away and Mr. Raynor said the town attorney would be contacted and the board would get back to Mrs. Akscin. On motion made by Mr. Coyle, seconded by Mr. Wall, it was RESOLVED to approve the map of the minor subdivision of George and Opal Akscin dated June 9, 1977 and amended June 30, 1977, subject to covenants and restrictions being filed in the Suffolk County Clerk's Office as to no further subdivision of lot number 3. Vote of the Board: Ayes: Raynor, Coyle, Gordon, Wall The following reports were read which were presented by Edward Bage, P.E. #200 - Minor subdivision of Laurel Acres. l~inspected the Right of Way as shown on this map and recommend the following action be taken: 1. The surface of the Right of Way should be graded level, at the present time it has many dips. 2. A three inch layer of pea gravel should be spread over the entire surface of the Right of Way. #202 - Minor subdivision of Laurel Acres. The recommendations made in my Report #200 dated June 3, 1977 have been accomplished. The Right of Way has been graded level and a three inch layer of pea gravel applied over its entire surface. This right of way is now in acceptable condition. On motion made by Mr. Gordon, seconded by Mr. Wall, it was RESOLVED that the Southold Town Planning Board accepts the recommendations and findings of Edward Bage, Town Engineer, as contained in Reports #200 and #202 for the subdivision Laurel Acres. Vote of the Board: Ayes: Raynor, Coyle, Gordon, Wall Planning Board -3- ~_.ly 18, 1977 On motion made by Mr. Coyle, seconded by Mr. Gordon, it was RESOLVED to approve the amended drawings of Colgate Design Corporation dated March l, 1976 and amended February 4, 1977 to include brick veneer on the complete exterior of the sidewalls of the building. Vote of the Board: Ayes: Raynor, Coyle, Gordon, Wall Mr. Raynor signed the amended drawings as approved. 7:45 p.m. Public Hearing on the minor subdivision of property of Dr. Meyer Rosenberg. Mr. Raynor read the notice of hearing and presented affidavits of publication from the Suffolk Times aud the Long Island Traveler- Watchman. It was to be noted that no course is shown on the map for the waterfront. Mr. Raynor: This subdivision has been before the board since February and as there is no road construction for town approval, there is no letter of recommendation from the Superintendent of Highways. It should be noted that the subdivision has a right-of-way running through the middle, north to south, and egress and ingress will be from that right-of-way and not put on Indian Neck Road. This is one of the restrictions that the board has spoken to the principles about. (Mr. Raynor went over the checklist.) As is the policy of this board, we will ask if there is anyone present that would like to speak in opposition to the minor subdivision of Dr. Meyer Rosenberg. Hearing none, I will ask if there is anyone present that would like to say anything in favor of the subdivision of Dr. Meyer Rosenberg. Hearing none, is there anyone present who has any interest or any information that should come before this board at this time. Mr. Coyle: I think it should be noted that the driveway there was established many years ago and is 16 feet wide and the right-of-way shown on the map is 25 feet. It is a curbed right-of-way at the present time and will not be the corrected width that we approved. Lot number 4 should have the corrected width of the right-of-way before it is sold. Mr. Raynor: All of the lots are oversized and the board's policy is to ask for covenants and restrictions that it not be further subdivided. There is a notation on the map but we will need the affidavit from the principles. Do any of the board members have anything? We will declare this hearing closed. Planning Board -4- ~ .ly 18, 1977 Sterling Forest. (Harold Reese subdivision) Gary McLean appeared. The following letter under date of July ll, 1977 was read: Gentlemen: I approve of the layout and clearing of the road and recommend leaching pools and not a recharge basin for this subdivision. The driveways of lots I & 8 must be on the proposed road and not on to Soundview Avenue. /s/Raymond C. Dean, Supt. of Highways Mr. Reese should present the preliminary maps with the road profiles. 8:00 p.m. Public Hearing on the minor subdivision of property of Folly Beach~ Limited owned by C. E. Allen et al. Mr. Raynor read the notice of hearing and presented affidavits of publication from the Suffolk Times and the Long Island Traveler- Watchman. Mr. Raynor: This is a preliminary hearing of the minor subdivision of Folly Beach, Limited. I will ask if there is anyone here this evening that would like to speak in opposition to this subdivision. Hearing none, I would ask if there is anyone present that would like to speak in favor of this subdivision of Folly Beach, Limited. Hearing none, is there anyone present that has some information that should come before this board concerning this particular subdivision. I have a letter from the Suffolk County Department of Planning which I will read. Dear Mr. Wickham: The Suffolk County Planning Commission at its regular meeting on July 6, 1977, reviewed the proposed subdivision plat, entitled, "Minor Subdivision-Folly Beach Limited", referred to it pursuant to Section 1333 of the Suffolk County Charter. After due study end deliberation it resolved to disapprove said map for the following reasons: 1. From the information provided it cannot be determined if there is an adequate water supply on the site and that the site is suitable for disposal of sewage. This map, therefore, should only be considered for approval after it has been determined by the Suffolk County Department of Health Services that there is an adequate water supply available to serve each lot and that sewage disposal on each lot will not adversely affect James Creek and Peconic Bay. 2. Lot 2 has insufficient depth to provide a 100 foot setback from James Creek for a residential building and for any sanitary disposal facility required on the lot. Planning Board -5- .ly 18, 1977 3. It is not known what the constitution of the subsurface strata on the site is and what effect it will have on disposal of sewage and erection of buildings on the lots. It is believed that the immediate underlying material was salt marsh. 4. The nature of the right-of-way raises questions as to the accessibility of large vehicles and emergency vehicles ot the lots. 5. Erosion of the Peconic Bay in this vicinity is considered to be critical and the erosion rate should be taken into considera- tion in the lot layout. The Commission also offers the following comments on the map for your use and consideration: The subdivision of this tract presents several serious problems for the environment and future lot owners. It is suggested that the subdivider of this tract be requested to join together with the subdivider of the adjacent tract, to the north, so that a unified layout can be developed utilizing a common efficient right-of-way. The layout of these subdivisions should also take into consideration that the residential buildings that will be erected on the lots may, some day in the near future, be used for year round use. /s/ Charles G. Lind, Chief Planner Subdivision Review Section Mr. Raynor: To date this is the only correspondence in regard to this preliminary subdivision. Are there any questions the board would have concerning this. Mr. Coyle: I think this should be taken into consideration. Mr. Raynor: It would be my suggestion that we call in the Southold Town Conservation Advisory Council to get its recommendations. I would think that the Soil & Water Conservation District officer should be consulted and we should have some recommendations of the Board of Health. Perhaps, we should have Mr. Kreh in to consider the parcels as a joint submission and file as a major subdivision. Does anyone else have anything on it. I will declare the hearing closed. On motion made by Mr. Coyle, seconded by Mr. Wall, it was RESOLVED to request recommendations on the subdivisions of Folly Beach Limited and Peter Kreh from the Southold Town Conservation Advisory Council, The U. S. Dept. of Agriculture Soil & Water Conservation district and the Suffolk County Board of Health. Vote of the Board: Ayes: Raynor, Coyle, Gordon, Wall Planning Board -6- ~ ~ly 18, 1977 Peter Blank, Jr. Mr. Blank presented a proposed major subdivision in Orient containing 60,000 square foot lots with a 60 foot road. He wants to put in swales if possible. The topography of the land varies only five feet. This will be sent to the Soil & Water Conservation District for its recommendations on the swale drainage. Mr. Raynor asked if it was possible for Mr. Blank to get a letter of intent from the adjacent property owner, Mr. Van Nostrand, as to the location of the park and playground if some day his property is subdivided. The roadway appears to be within the 1200 foot maximum. Fellinger-Ihar subdivision. Mr. and Mrs. Ihar appeared with their attorney, Mr. Scheinberg. Mr. Scheinberg presented three copies of the map showing the 15 foot easement for ingress and egress for the recharge basin along the northerly boundary of the proposed subdiv- ision. They have gone to the Board of Appeals and received approval for the 15 foot access to lot number 22. Lot 22 is now a legal lot. There is sufficient square footage in the park and playground. Before they go back to the Soil & Water Conservation District, they want to make sure they have sketch plan approval. The District Officer will devise the cross-sections for the swale area. Mr. Scheinberg was instructed to talk to the Supt. of Highways as to what, if anything, he wants over the easements. On motion made by Mr. Gordon, seconded by Mr. Wall, it was RESOLVED to grant sketch plan approval to the map of the property of John and Olivia Fellinger-Ihar, said map dated March 1977 and amended July 15, 1977. 22, Vote of the Board: Ayes: Raynor, Coyle, Gordon, Wall Mr. Wall made a motion, seconded by Mr. Gordon and carried to approve the minutes of the meeting of June 27, 1977 with corrections noted on page 15 regarding Nunnakoma Waters. On motion made by Mr. Coyle, seconded by Mr. Wall, it was RESOLVED to approve the sketch map of the minor subdivision of property of Shirley Saland at Nassau Point, said map dated May 1977. Vote of the Board: Ayes: Raynor, Coyle, Gordon, Wall On motion made by Mr. Coyle, seconded by Mr. Wall, it was RESOLVED to disapprove the map of the minor subdivision of property of Appolonia Kirchgessner, said map dated February 4, 1976 and a~ended April l~, ±~'f'f, 1'or the following reasons: 1. The right-of-way is not included in the subdivision. Planning Board -7- .ly 18, 1977 2. Two strips of property are excluded from the subdivision. 3. Lots are unnumbered. 4. J. & C. Peters, as presently shown, is landlocked. Vote of the Board: Ayes: Raynor, Coyle, Gordon, Wall Mr. Wickham arrived at this point. Paradise-by-the-Sound. Roger Rath and Frederick Ziems, Esq. appeared. The recommendations of Larry Tuthill were read wherein he recommended that a hydrant be placed at the easterly end of Road "D". Contact Larry Tuthill about his recommendations on the setback from the bluff and ask him for a letter explaining his calculations on drainage which were in response to the drainage calculations of Howard Young, P. E. Mr. Ziems presented a letter dated July 18, 1977 with supporting letters from Lockwood, Kessler & Bartlett, Inc., Consulting Engineers, and Young & Young, Professional Engineer and Land Surveyors, regarding the setback from the bluff on the Sound. There was lengthy discussion on this matter. The 100 foot setback was the recommendations of the County. Their request was that the Planning Board again send it to the county as they had been told by the county that they would again consider it and possibly come back with a different recommenda- tion. Eli~ah's Lane Estates. Edward Bage, Town Engineer, and Shirley Saland appeared. The road contractor also appeared with Mrs. Saland. The road was designed to go to Sections II and III, but this land has now been sold back to a farmer and is being farmed with no intention of a subdivision for the near future. The roads go to nowhere and the request was made that they be allowed to put the roads in at the present elevation. Mr. Bage was asked to draw up a report and it is up to the engineer to regrade. Tangney minor subdivision. Abigail Wickham, Attorney, and Mr. Tangney appeared. There was a question on the access and whether it should be built to town specifications. This lot was split off by the Board of Appeals and needs its approval to be redivided as this was part of the condition of approval of the original split. Ms. Wickham will get back to the board. Kalamaras minor subdivision. John Lynch, Esq., appeared with Mr. Kalamaras. The board would like to inspect the property. Planning Board -8- ~ly 18, 1977 On motion made by Mr. Wickham, seconded by Mr. Gordon, it was RESOLVED to hold a public hearing on the preliminary map of the subdivision of property know~ as "Kouros Acres" owned by Olympia Kouros, map dated October 15, 1976 and amended June 16, 1977. Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon, Wall The matter of the recommendation on the change of zone request from William and Barbara Schriever was tabled as the letter from the Orient School Board has not yet been received. Driftwood Cove. Mr. Coyle aud Mr. Gordon made an inspection of this site. They noted there was a split rail fence and a stockade fence which were alright. In front of tenant 13, there is a big pile of dirt and it is not complete. There is no parking lot at the south end. It is about three-quarters completed. Morchel. Mr. Henry made an inspection of this siste. There are no plantings in the front. There is no front grading and gravel where necessary. The fence is not constructed on the easterly line to stop traffic flow to Sigsbie Road. There have been several reported accidents on that intersection and as soon as possible the fence should be set up to correct the traffic problem. A copy of this information is to be transmitted to the building inspector. On motion made by Mr. Wickham, seconded by Mr. Coyle, it was RESOLVED to approve the preliminary map of the subdivision known as "Brionngloid-by-the-Sea" owned by Charles Rand, map dated May 18, 1977, subject to the following: 1. 100 foot setback from the Sound to be shown on map. 2. Right-of-way to be between lots 4 and 5 and frontage be provided for lot 6. 3. Vehicular access be restricted to the rights-of-way for lots 2, 3, 4 and 5. 4. Receipt of covenants and restrictions as to no further subdivision of the lots in the subdivision. 5. Receipt of covenants and restrictions as to no development of the property on the south side of State Road. Vote of the Board: Ayes: Wickham, Coyle, Gordon, Wall Nay: Raynor Planning Board -9- ~ly 18, 1977 Mr. Bage requested that there be a review of the policy of cuts and fills on roads. The Board asked him to present his recommendations in writing and they will be given consideration. On motion made by Mr. Gordon, seconded by Mr. Wall, it was RESOLVED to approve the map of the minor subdivision of property of the Walter Washburn Estate. Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon, Wall On motion made by Mr. Wickham, seconded by Mr. Coyle, it was RESOLVED to not resend the maps of the subdivision Paradise- by-the-Sound to the Suffolk County Planning Department for review of the 100 foot setback requirement from the Sound at this time. Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon, Wall On motion made by Mr. Wickham, seconded by Mr. Coyle, it was RESOLVED to approve the minor subdivision of property of Peter Kreh subject to recommendations of the Suffolk County PlannLug Commission. Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon, Wall On motion made by Mr. Wickham, seconded by Mr. Wall, it was RESOLVED that the Southold Town Planning Board is not in favor of any resolution by the County of Suffolk that would usurp home rule. Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon, Wall A letter requesting information is to be written to the New York State Dept. of Environmental Conservation. Ernest Wilsberg and others have applied to the DEC for permission to construct a water supply system. There is no approved subdivision of any type. Thirty- eight lots is an arbitrary number so the design criteria is going to be arbitrary also. The public notice does not indicate the location of the well points or the storage facilities. Planning Board -10- ~ly 18, 1977 Pyle. This proposed subdivision was reviewed. It is located on Fishers Island and' an inspection will be made of the property. *** On motion made by Mr. Wickham, Seconded by Mr. Wall, it was RESOLVED to approve the sketch map of the subdivision of Alice S. Sturges at Fishers Island, subject to bluff line and 100 foot setback being shown on the final map. Vote of the Board: Ayes; Wickham, Raynor, Coyle, Gordon, Wall *** On motion made by Mr. Gordon, seconded by Mr. Wall, it was RESOLVED that report #211 of Edward Bage, Town Engineer, regarding the minor subdivision of Wiederman & Gilowski be accepted. Vote of the Board: Ayes: Wickham, Raynor, Gordon, Coyle, Wall *** On motion made by Mr. Wickham, seconded by Mr. Coyle, it was RESOLVED that report #212 of Edward Bage, Town Engineer, regarding the minor subdivision of Milton Mehlman be accepted. Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon, Wall 01msted & Haas are to be informed that the 100 foot setback line should be shown on the map of their minor subdivision. This setback line is from Mattituck Creek. *** Motion was made by Mr. Wickham, seconded by Mr. Coyle and carried that the meeting be adjourned.
