A regular meeting of the Southold Town Planning Board was
held August 17, 1977 at 12:30 p.m. at the Fishers Island School,
Fishers Island, New York.
Present were:
Henry E. Raynor, Jr., Vice-Chairman
Frank S. Coyle
Frederick E. Gordon
James Wall
On motion made by Mr. Gordon, seconded by Mr. Wall, it was
RESOLVED to grant sketch plan approval to the map of
property of Thomas O. and Regina S. Pyle to be known as "Hay
Harbor Hills", located at Fishers Island, New York.
Vote of the Board: Ayes: Raynor, Coyle, Gordon, Wall
12:30 p.m. Public Hearing on the minor subdivision of property
of Hay Harbor Hills, owned by Thomas O. and Regina S. Pyle.
Mr. Raynor: Before reading the description, I have a letter from
the attorney representing the developers.
Southold Town Planning Board:
Pursuant to the request of the Secretary of the Board, this is to
advise that the metes and bounds description furnished to you are
the metes and bounds description prepared by the Title Guarantee
Company under Title No. 1295453, which is the metes and bounds
description of subject premises guaranteed by said company.
The Title Guarantee Company survey runs clockwise, whereas the
surveyor made the map counter-clockwise. Depending on whether
you are reading the map clockwise or counter-clockwise, each of
the courses will reverse; in other words, on the very first course
of the description which runs North 45 degrees 06 minutes 40 seconds

East, the survey will show South 45 degrees 06 minutes 40 seconds
West. This is exactly the same course only in one instance you
are running in a Northeasterly direction, and in the other you are
running in a Southwesterly direction.
I trust that this will clear up any confusion that you may have
with regard to this description and map, and certainly any engineer
or surveyor will assure you that both are correct and are exactly
the same.

Mr. Raynor: A letter should be sent from the Board to Matthews
and Ostrander stating that the map should be amended to accurately
reflect the legal notice that was posted.
Mr. Raynor read the legal notice of the hearing and presented
proof of publication from the Suffolk Times and the Day which were
duly notarized. Mr. Raynor went over the checklist.
Mr. Raynor: There are no highways to be constructed, therefore,
there will be no report from the Superintendent of Highways or
the engineer. As is the procedure with the board, is there anyone
present this afternoon that would like to speak in opposition to
the subdivision "Hay Harbor Hills". Hearing none, is there anyone
that would like to speak in favor of the subdivision "Hay Harbor
Hills". Hearing none, is there any member of the board that has
anything that should be brought up in the public hearing.
Mr. Wall: I would like to know about the existing right-of-way
along the edge of the bank.
Mr. Raynor: There aren't any contour elevations. This will be a
requirement of the County. The name has to be corrected and 100
foot setbacks will be required. The provisions of AlO6-41A(3) of
the Code of the Town of Southold will have to be met. Is there
anyone else wishing to be heard. Hearing none, I will declare the
hearing closed.
12:45 p.m. Public Hearing on the minor subdivision of property
owned by Alice S. Sturges. Mr. Sturges appeared.
Mr. Raynor read the legal notice of hearing and presented proof
of publication from the Suffolk Times and the Day which were duly
notarized. Mr. Raynor went over the file and the checklist.
Mr. Raynor: There will be no highway construction involved in the
development of this property. Therefore, there will be no report
of the Superintendent of Highways or the town engineer. As is the
policy of this board, we will ask if there is anyone present that
would like to speak in opposition to this subdivision. Hearing
none, I would ask if there is anyone present that would like to
speak in favor of this subdivision.

Mr. Sturges: The only purpose of this subdivision is to provide
the purchaser of our house with a little more room to the west.
We owned four lots. We agreed that we would give about 75 feet
further west which would protect him somewhat. That is the only
reason that we had for seeking approval.
Mr. Raynor: I see one small problem. You have one with the house
to be sold to Gaston. In order to process it, it has to be on
the sole name of the owner. It will have to be modified.
Mr. Sturges: I think his purpose was to use this office survey
for conveyance purposes, too.
Mr. Raynor: We have been down and looked at the property and would
all like to buy it.
Mr. Sturges: Where we are thinking of building is an even nicer
house site than we have now. It sticks out south a little bit
further.
Mr. Raynor: It is a beautiful location.
Mr. Sturges: We have enjoyed the house but we don't need it any
more as our family is grown.
Mr. Coyle: I don't see that either lot is numbered.
Mr. Raynor: Erase the old numbers and make one lot number one and
one lot number two. It simplifies the filing.
Mr. Gordon: There should be covenants.
Mr. Raynor: We have a standard format for covenants and restrictions.
This would stop any further subdivision on the property. It is
treated this way because it is not a major subdivision. For this
type of consideration, we restrict the type of development to one
house per lot as laid out. Mrs. Brush will forward the necessary
papers. Do you have anything else you care to tell us.
Mr. Sturges: Can you approve this subject to receiving the filing
copy?
Mr. Raynor: The Suffolk County Planning Department must review the
map before it can go any further. We couldn't approve it today
primarily because of the other bodies involved. If there is nothing
else, we will declare the hearing closed.
On motion made by Mr. Coyle, seconded by Mr. Gordon and
carried the meeting was adjourned. Meeting adjourned at l:lO p.m.
