GORDON JAMES WALL Southold, N.Y. 11971 TELEPHONE 765- 1938 A regular meeting of the Southold Town Planning Board was held on Monday, November 21, 1977 at 7:30 p.m. at the Town Hall, Main Road, Southold, New York. Present were: Henry E. Raynor, Jr., Frank S. Coyle Frederick E. Gordon James Wall Vice-Chairman Absent was: John Wickham, Chairman, (out of town) Allen and Kreh minor subdivisions. C. E. Allen, Peter Kreh, Jr. and John McNulty, Esq., appeared. The presentation of a combined major subdivision rather than two minor subdivisions was briefly discussed. The town attorney is to be contacted about this matter. Test holes and test wells should be done on the property to satisfy the Board of Health. Mr. McNulty requested some time at the next meeting. On motion made by Mr. Gordon, seconded by Mr. Wall, it was RESOLVED to approve the sketch map of James Dean for property on the west side of Dean Drive, subject to the following: 1. Wetland permit from the Town of Southold. 2. Approval of the New York State Department of Environmental Conservation. 3. Approval of the Suffolk County Department of Health for water supply. Vote of the Board: Ayes: Raynor, Coyle, Gordon, Wall It was also discussed that the map will havaeto have contours shown on it and covenants and restrictions will have to be filed in the Suffolk County Clerk's Office as to no further subdivision. Planing Board -2- Novemb~ ~ 1977 On motion made by Mr. Gordon, seconded by Mr. Coyle, it was RESOLVED to approve the map of the minor subdivision of property of Stanley and Helen Sled~eski~ said map dated March 16, 1977 and amended August 30, 1977, and authorize the vice-chairman to sign the map. Vote of the Board: Ayes: Raynor, Coyle, Gordon, Wall On motion made by Mr. Gordon, seconded by Mr. Wall, it was RESOLVED to approve the map of the minor subdivision of property of Mary W. MacNish, said map amended October 13, 1977, subject to the following: 1. Recommendations of the Suffolk County Planning Commission. 2. Notation being placed on the map that no lot shall be further subdivided. 3. Filing of covenants and restrictions that no lot will be further subdivided being filed in the Suffolk County Clerk's Office. Vote of the Board: Ayes: Raynor, Coyle, Gordon, Wall On motion made by Mr. Gordon, seconded by Mr. Wall, it was RESOLVED to approve the sketch map of the minor subdivision of Arlene Marvin, said map dated October l~, 1977, subject to notation being placed on the map that the access will be from the right-of-way to Luther's Road. Vote of the Board: Ayes: Raynor, Coyle, Gordon, Wall It will also be necessary that covenants and restrictions be filed as to no further subdivision and a notation be placed on the map. The following letter to Mr. John Wickham, Chairman, under date of November 18, 1977 was read into the minutes. Robins Island. Dear John: I have just returned from a short vacation to see your letter of November 10th. Unfortunately the Ingoglia-Samuels deal is finished, and I cannot really blame them for n~t going on any further. As you know, there were 3 lis pendens that had to be removed, and this and other local matters caused further delay. In the event some future buyer comes up with the same sort of plan, I am sure this would help your Planning Board expedite the matter. Cordially, /s/ John W. Mackay On motion made by Mr. Wall, seconded by Mr. Gordon, it was RESOLVED to grant final approval to the map of the minor subdivision of Alice S. Sturges, said map revised August 12, 1977, and authorize the vice-chairman to sign the map. Vote of the Board: Ayes: Raynor, Coyle, Gordon, Wall The following letter dated November 8, 1977 from the Suffolk County Department of Planning in regard to the Time Structures, Inc. subdivision was read into the minutes, letter dictated 10/26/77. Dear Mr. Wickham: Mr. Rath and Mr. Ziems stopped by at this office yesterday, October 25, 1977, to discuss their proposed subdivision. Their specific concern is the 100 feet setback requirement along the Sound and the impact that the setback will have in siting the houses on the shore front lots. They had with them a topo map of the bluff that was prepared by Lockwood, Kessler & Bartlett, Inc., from 1955 aerial photographs and three letters: (1) Lockwood, Kessler & Bartlett, Inc., dated February 8, 1977; (2) Young and Young, dated June 27, 1977; (3) Frederick J. Ziems, dated July 18, 1977. It is their opinion that this material substantiates their contention that the setback requirement should be relaxed and, therefore, this material should be considered by the Commission. While I requested that copies of this material be left with me for information purposes, this material will not be considered as part of the official file of the Commission unless your Planning Board indicates that it should be. This in in accordance with Commission policy that no materials concerning any subdivision will be accepted from any subdivider or their agents for consideration by the Commission in its review unless it is authorized for acceptance by the local referring agency. It was pointed out to both gentlemen that if they felt that they had valid information concerning the stability of the shore- line along their property that they wanted the Commission to consider that they submit it to the Town Planning Board with a request that it forward the material to the Commission. Planning Board -4- Noveml ?~, 1977 You are being informed of this visit in accordance with Commission policy that when any subdivider or his agent discusses his subdivision with the staff and that discussion includes materials that have not been included in any correspondence from the local planning agency that the local planning agency be so notified. /s/ Charles G. Lind, Chief Planner A copy of the above letter was sent by the Planning Department to the applicant's attorney so he has an opportunity to present it at a future time. Drossos parking. The Planning Board reviewed the agreement between Mrs. Drossos and the Long Island Lighting Company for a 100 x 200 foot parking area on property of LILCO. The agreement is to be transmitted to the building inspector with a request to recalculate the parking area involved to be sure it is adequate for parking under the town regulations. Val Stype ~ite plan. Mr. Stype appeared. The letter from the building inspector was read. They propose a walkway from the park district to the building. A new plot plan will be necessary showing reservation that has been made. An application has been made to the Board of Appeals to be heard December l, 1977. On motion made by Mr. Gordon, seconded by Mr. Coyle, it was RESOLVED to grant site plan approval for the property of Val Stype based on the revised sketch of the addition and super- imposing the walkway and incorporating it on one of the maps, all subject to the approval of the Board of Appeals for parking. Vote of the Board: Ayes: Raynor, Coyle, Gordon, Wall Kouros. The deed from Kouros to Horton has been presented at the ~-~anning Board office by Edward Boyd V. The Planning Board reviewed the deed and noted that it contained the covenants as to no further subdivision and what could be done with the 50 foot strip. On motion made by Mr. Gordon, seconded by Mr. Coyle, it was RESOLVED to hold a public hearing on the preliminary map of the subdivision known as Southold Gardens. Vote of the Board: Ayes: Raynor, Coyle, Gordon, Wall Planning Board -5- No~, .~ber ~, 1977 On motion made by Mr. Gordon, seconded by Mr. Coyle, it was RESOLVED to hold a public hearing on the preliminary map of the subdivision known as Country Club Estates. Vote of the Board: Ayes: Raynor, Coyle, Gordon, Wall On motion made by Mr. Gordon, seconded by Mr. Coyle, it was RESOLVED to hold a public hearing on the final map of the minor subdivision of property of Appolonia Kirchgessner. Vote of the Board: Ayes: Raynor, Coyle, Gordon, Wall On motion made by Mr. Gordon, seconded by Mr. Coyle, it was RESOLVED to hold a public hearing on the final map of the subdivision knownas Woodbine Manor. Vote of the Board: Ayes: Raynor, Coyle, Gordon, Wall *** On motion nade by Mr. Gordon, seconded by Mr. Coyle, it was RESOLVED to hold a public hearing on the final map of the subdivision known as the minor subdivision of property of Lloyd Terry. Vote of the Board: Ayes: Raynor, Coyle, Gordon, Wall The public hearings are being rescheduled for Appolonia Kirchgessner, Centennial Manor, Woodbine Manor and Lloyd Terry because of a deficiency in the advertisement as to length of time notice was given. These public hearings were rescheduled upon the direction of the town attorney. Planning Board -6- No~ ~mber ~, 1977 On motion made by Mr. Coyle, seconded by Mr. Wall and carried, the minutes of the meeting of October 19, 1977 were approved. Frank Murphy minor subdivision. Mr. Murphy and John McNulty, Esq. appeared. It will be necessary to have spot elevations shown on the map. Lots must be numbered. Notation is to be placed on the map as to no further subdivision and covenants and restrictions must be filed in the Suffolk County Clerk's Office indicating same. This will come in as Sections I and II. Southold Savings Bank site plan. Richard Lark, Esq. appeared and made a presentation on behalf of the Southold Savings Bank. It was determined that the Planning Board has sole jurisdiction as to parking requirements for banks. There were two plans presented. Plan A is the present property and Plan B shows the Prince property which the bank owns and Mrs. Prince has a life interest in. The Prince house will be replaced with remote tellers at a future date. The building inspector computed the drainage for a six-inch rainfall. Mr. Lark showed a copy of a letter to the Southold Savings Bank from Supt. of Highways Dean approving the curb cut. There is a 20 foot right-of-way to connect the bank property with property owned by Riverhead Auto Parts and leased to the Town for parking. George Furnam of Weidersum Associates also made a presentation. Raymond Terry, representing the Southold Savings Bank, spoke very briefly. Mr. Raynor indicated that the Board was very appreciative of Mr. Terry's time and effort when the Board made its field study. On motion made by Mr. Coyle, seconded by Mr. Wall, it was RESOLVED to grant ~plan approval to the plans submitted by the Southold Savings Bank with the following provisions. 1. Lighting schedule to be presented including the type of bulb to be used and wattage. 2. Specific lighting drawings on the north entrance over ramp area. 3. As-built plans. Drainage to be provided for a six-inch rainfall. 5. Planting schedule to include list of plantings, type of ground cover and what is below the planting area 6. Solid slabs be provided as opposed to perforated drainage domes for the drainage. Vote of the Board: Ayes: Raynor, ~ordon, Coyle, Wall Planning Board -7- Novemb ~2~, 1977 Motion was made by Mr. Coyle, seconded by Mr. Wall and carried that the meeting be adjourned.
