(631) 765-1809 ° Fax (631) 765-9064 FINDINGS, DELIBERATIONS AND DETERMINATION MEETING OF JUNE 21, 2012 RECEIVED Southold Town Clerk ZBA FILE: 6567 NAME OF APPLICANT: Southold Historical Society PROPERTY LOCATION: 54127 Main Road, Southold, NY CTM: 1000-61-2-7.2 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated April 27, 2012 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The Applicant's property is a .195 acre parcel in the HB Zone. The northerly lot line measures 42 feet, and the easterly lot line measures +/- 203 feet along adjacent properties. The southerly lot line measures 42 feet along Main Road, and the westerly lot line measures +/-202 feet along an adjacent property. The parcel is improved with a 26.4 ft. X 22.3 ft. principal structure, and a 26.4 ft. X 20.3 accessory structure, as shown, with a proposed new front porch addition for the principal structure, on the survey drawn by Wallace T. Bryan, Licensed Land Surveyor, dated Aug. 9, 2011. BASIS OF APPLICATION: Request for Variance from Article X Code Section 280-46 (bulk schedule), based on an application for building permit and the Building Inspector's March 9, 2012 Notice of Disapproval concerning proposed front porch addition to existing building located in the HB District, at; 1) less than the code required minimum front yard setback of 15 feet, 2) less than the code required minimum side yard setback of 10 feet, 3) less than the code required total side yards of 25 feet. RELIEF REQUESTED: The Applicant requests variances to construct a +/- 100 sq. fi. open, roofed porch addition to be located on the front of the principal building facing Main Road. The Applicant requests a variance for a front yard setback of 3.75 feet, when 15 feet is required by Code, requests a variance for a 2.2 feet single side yard setback, when l0 feet is required by Code, and further requests a variance for a combined side yard setback of 17.5 feet, when 25 feet is required by Code. ADDITIONAL INFORMATION: The Applicant proposes to build the new porch within the original footprint of a porch that had existed at the same location on the structure for many years in the past, prior to being damaged by a storm. After the storm, the porch was partially removed, leaving only the roof and entrance stairs intact. The Page 2 of 3 Junc 21,2012 ZBA File#6567 Southold Historical Society CTM: 1000-61-2-7.2 Applicant, the Southold Historical Society, and the new owner since 2011, now wants to restore the porch to this historic building as it had existed in the past, by utilizing the remaining roof overhang of the old porch. The Southold Historical Society expressed an intent to utilize this building as a small exhibition gallery for historic items now housed within their nearby headquarters building on Main Road. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on June 7, 2012, at which time writlen and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law ~267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. A porch had existed on this building for many years in the same location as the proposed new porch. The porch construction will restore an original feature to this building in the exact footprint where it had existed for many years. Many of other the buildings in the adjacent neighborhood along Main Road have nonconforming front and side yard setbacks. 2. Town Law §267-b(3)(b)(2), The benefit sought by the applicant cannot be achieved by some method, feasible tbr the applicant to pursue, other than an area variance. The roof for the proposed porch already exists with nonconforming front and side yard setbacks. The front porch can not exist again without the granting of varlances. 3. Town Law §267-b{3)(b){3). The variance granted herein for a 3.75 feet front yard setback is mathematically substantial, representing 75% relief from the Code required 15 feet setback. The variances granted herein for a single side yard setback of 2.2 feet and combined side yard setback of 17.5 feet are substantial since this represent a 78% relief from the Code required single yard setback of 10 feet, and a 30% relief from the Code required 25 feet combined side yard setback. However, the pre-existing porch roof and entrance stairs already have a nonconforming footprint, and this footprint will not be increased by the addition ora porch within the same area. 4. Town Law §267-b{3}(b)(4) No evidence has been submitted to suggest that a variance in this residential cotnmunity will have an adverse impact on the physical or environmental conditions in the neighborhood. The porch will have a storm drainage system that conforms to Chapter 236 (Storm water Management) of Code. 5. Town Law §267-b(3)(b)(5). The difficulty has not been self-created. The original porch of this pre-existing, nonconforming historic building was destroyed by a storm, with only the roof and steps remaining, and now the Applicant wants to re-build the porch in the same footprint that it had occupied in the past. 6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a restored front porch on an historic building, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Homing, seconded by Member Schneider, and duly carried, to GRANT, the variances as applied for, and shown on the survey drawn by Wallace T. Bryan, Licensed Land Surveyor, dated Aug. 9, 201 I. CONDITIONS: The restored porch shall not be enclosed by walls, and shall remain open except for support posts and railing similar to those shown in the file photo dated circa 1910. That the above conditions be written inlo the Building Inspector's Certificate of Occupancy, when issued.
