INSTRUCTIONS
a. This application MUST be completely filled in by typewriter or in ink and submitted to the Building Inspector with 4
sets of plans, accurate plot plan to scale. Fee according to schedule.
b. Plot plan showing location of lot and of buildings on premises, relationship to adjoining premises or public streets or
areas, and waterways.
c. The work covered by this application may not be commenced belbre issuance of Building Permit.
d. Upon approval of this application, the Building Inspector will issue a Building Permit to the applicant. Such a permit
shall be kept on the premises available Ibr inspection throughout the work.
e. No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector
issues a Certificate of Occupancy.
f. Every building permit shall expire if the work authorized has not commenced within 12 months after the date of
issuance or has not been completed within 18 months from such date. If no zoning amendments or other regulations affecting the
property have been enacted in the interim, the Building Inspector may authorize, in writing, the extension of the permit for an
addition six months. Thereafter, a new permit shall be required.

SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and
determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA.
PROPERTY FACTS/DESCRIPTION: The subject property is a non-conforming 21,000+/- square foot lot measuring 100 feet
along Rocky Point Road and 210 feet deep. It is improved with a single-story, one family dwelling as shown on the survey
prepared by Otto W. Van Tuyl and Son dated November 26, 1963.
BASIS OF APPLICATION: Request for a Vadance under Section 280-124, based on the Building Inspector's November 6,
2008 Notice of Disapproval conceming a proposed addition and alterations to the existing single-family dwelling on a
nonconforming 21,000+/- square foot lot, stating that the new construction will be less than the code-required minimum side
yard of 15 feet.
LWRP: This application is not subject to review under Chapter 268 because the variance relief requested does not involve
features that relate to a regulated natural feature or a bulkhead or other shoreline.
RELIEF REQUESTED: The applicant proposes an addition on the rear of their single-family dwelling measuring 5 ft. by 24 ft. to
expand the size of the living room. The addition will maintain the pre-existing non-conforming side yard setback at 10 feet,
where the code requires 15 feet.
REASONS FOR BOARD 'ACTION: On the basis of testimony presented, materials submitted and personal inspections, the
Board makes the followinQ.findings:
1. Town Law .~267-b(3)!b)(3)(1). Grant of the variance will not produce an undesirable change in the character of the
neighborhood or a detriment to nearby properties. The proposed addition is only 5 ft. deep and 18 fl. high and will be in the
very large rear yard of thi~ property, so it will not be visible from the read. The rear yard and side yards are screened from
neighbors by mature trees:and vegetation.
2. Town Law .~267-b(3)(b)(2). The benefit sought cannot be achieved by some method, feasible for the applicant to pursue,
other than an area vadance because the house was originally built many years ago with a 10 ft. side yard (nonconforming).
Stepping back the proposed addition by another 5 feet would create a much less functional and attractive amhitectural solution
to the applicant's needs for an expanded living room space.

3. Town Law ~267-b{31(b)(3). The vadance granted herein/s not substantial in so far as the proposed addilion will maintain an
exisling 10 fl. side yard and the fact that the house is located vary dose to the sou~erly pmde~ line, leaving a 16 +/- foot on
the side yard on the norlh on a vary narrow lot.
4. Town Law ~267-b(3)(b){S). The difficulty has not been self-a'eated but is the result of a )re-exislJng non-conforming side
yard.
5. Town Law ~267~31¢b~4). No evidence has been subrnit~ed to suggest that a variance in this residential community will
have an adverse impact on ~e physical or envimnmantal condilJons in the neighborhood. The subject pmpsrty is fiat, and the
proposed addition is to be built on slab without land disturbance.
6. Town Law ~267-b. Grant of the requested relief is the minimum action necessa~ and adequate to enable the applloant to
enjoy the benefit of an expanded living mom space, while preserving and protec~ng the character of the neighborhood and the
health, safer7 and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying ~ balandng test under New York Town
Law 267-B, motion was offered by Member Weisman, seconded by Member Schneider, and duly canied, to
GRANT the variance as applied for and shown on the architectural plans dated October 2008 (Project No. 08051)
numbered sheets 1-5 prepared by Edward J. Cebul, Design Den, subject to the following Condition:

My husband, Michael Conway, died earlier this year (copy of Death Certificate enclosed), and the house
has passed to me through his estate.
Unfortunately, I don't know who the electrician is who did the work for Richard Feehan, the general
contractor from Allied Builders who buil~'this project. I know Richard submitted the building survey to
you. When I asked Richard earlier this year about the electrical inspection, he told me that the
electrician had filed his paperwork with you. If you cannot locate this paperwork, please be in touch

§R9905.2.8.2 Valle, ye. Valley linings shall be iastalled in accordance

Valley linings of the following types shall be permitted:
1 For open valley (valley hning exposed) lined with metal, the
volley lining shall be at least 24 inches (610 mm) wide and of any
of the corrosion-resistant metals in Table R9905.2.8.2.
2. For open valleys, valley liniag of two plies of mineral surface
roll roofing, compyng with AS~I D 249, shall be permitted. The
bottom Ioysr shall be 18 inches (¢57 mm) and the top layer a
minimum of 56 inches (914 mm) wide.
5. For closed valleys (volJey covered with shingles), valley
lining of one ply of smooth rol~ roofing compyng with ASTM D 224
Type II or Type UI and at least 56 inches (914 mm) wide or valley
lining as described in Items 1 and 2 above shall be permitted.
Specialty underloyment complying with AS1MD 1970 may be used in
