Status: Incomplete Site Plan Application under SPUD
As explained to you, I spoke to Mr. Kelly today and learned the following; the Planning Board
received two plans in error on April 2, 2007 and they are for the Building Permit file. Attached
you will find two complete copies of the plans for your file. Additionally, I was informed that no
site plan application will be submitted to the Planning Department and no site plan is required
since the building permit has been issued.
As I indicated to you today, the Planning Departments SP Incomplete File and the
Building Permit File 32827 Z does not contain a notice of disapproval or a "Final
Determination" signoff on the SPUD.
The research on the above referenced project is as follows:
On February 6, 2007, the Building Department sent a SPUD to the Planning Department
indicating a "Site Plan Required" and the "use permitted".
On February 9, 2007, the Planning Department responded with "We agree a site plan is
required under Town Code section 280-12. The use is permitted under 280-13 A-2-C as
proposed". This response was hand deliver to your Department.
On March 22, 2007, the Building Department issued a building permit under BP# 32827 Z for
this project.
Attached is a copy of the SPUD for your review.
Please review the Building Department records and forward the Planning Department for
the file written "Final Determination" indicating no site plan is required for this project.
