with offices at 1060 Cases Lane Extension, Cutchogue, New York 11935, party of the first part, and
NOFO VENTURES LLC, a New York Limited Liability Company
with offices at 104 Third Street, Greenport, New York 11944, party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten and 00/100--($10.00)--Dollars, and
other good and valuable consideration paid by the party of the second part, does hereby grant and release
unto the party of the second part, the heirs or successors and assigns of the party of the second part
forever,
ALL that certain plot, piece or parcel of land, situate, lying and being in the Village of Greenport, Town of
Southold, County of Suffolk and State of New York, bounded and described as folfows:
BEGINNING at a poi'nt on the easterly side of Third Street (Railroad Avenue) distant 266.85 feet southerly
as measured along the easterly recorded line of Third Street (Railroad Avenue) from the southerly end of
a tie line bearing South 42 degrees 18 minutes 45 seconds West having a length of 39.09 feet, said tie line
connecting the southerly recorded line of Front Street (SR 25) with the easterly recorded line of Third
Street (Railroad Avenue);
RUNNING thence from said point or place of beginning along land now or formerly of the American Legion
North 83 degrees 20 minutes 00 seconds East 130.00 feet to land now or formerly of the State of
New York;
THENCE along said last mentioned land the following (2} courses and distances; 1) South 6 degrees 40 minutes 00 seconds East 50.00 feet;
2) South 83 degrees 20 minutes 00 seconds West 130.00 feet to the easterly line of Third Street
(Railroad Avenue) and
THENCE along the easterly side of Third Street (Railroad Avenue) North 6 degrees 40 minutes 00
seconds West 50 feet to the point or place of BEGINNING.
BEING AND iNTENDED TO BE the same premises conveyed in Deed recorded in Liber 8334 page 465.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the
appurtenances and all the estate and rights of the party of the first part in and to said premises.
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and
will apply the same first to the payment of the cost of the improvement before using any part of the total of
the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the
sense of this indenture so requires.
