WITNE$SETH, that the pany of the first part, in consideration of ten dollars and other valuable consideration
paid by the party of the second pan, does hereby grant and release unto the party of the ~econd pan, the heirs
or successors and assigns of the party of the second pan forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being at Cutchogue, Town of Southold, Suffolk County, New 'fork bounded
and described as follows:
BEGINNING at a point at the corner formed by the intersection of the
westerly side of Meadow Lane with the northerly side of New Suffolk Avenue;
running thence North 76° 58' 20" West along the northerly side of New Suffolk
Avenue a distance of 112.5 feet to land now or formerly of David Terry Case,
Trustee of the David Terry Case Revocable Trust; running thence North 13° 01' 40"
East a distance of 150 feet to land now or formerly of Patrick and Timothy Block;
running thence South 76° 58' 20" East along said last mentioned land a distance
of 112.5 feet to the westerly side of Meadow Lane; running thence South 13° 01' 40"
West along the westerly side of Meadow Lane a distance of 150 feet to the northerly
side of New Suffolk Avenue at the point or place of BEGINNING.
TOGETHER with all the right, title and interest, if any, of the party of the
first part in and to the meadow, waters, and lands under water of West Creek in front
o~and abutting said premises, to the center line thereof.
TOGETHER with a free and unobstructed use in common with other owners of a
right-of-way for passage on foot over a certain Private Road two (2) rods in width
running from New Suffolk Avenue in a southerly direction to Peconic Bay. Said
right-of-way being bounded on the North by New Suffolk Avenue; on the East by land
now or formerly of Beverly King; on the South by Peconic Bay and on the West by land
now or formerly of the Estate of George H. Case, deceased.
BEING AND INTENDED TO BE part of the same premises conveyed to
the party of the first part by deed dated September 9, 2011 and
recorded in the Suffolk County Clerk's Office on September 16, 2011
in Liber 12671 Page 556.
TOGETHER with all right, title and interest, if any, of the party of the first pan in and to any streets and roads
abutling the above described premises to the center lines thereof; TOGETHER with the appurtenances and all
the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises
herein granted unto the parly of the second part, the heirs or successors and assigns of the party of the second
part forever.
AND the party of the first pan covenants that the party of the first part has not done or suffered anything whereby
the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first pan, in compliance with Section 13 of the Lien Law, covenants that the party of the first
part will receive the consideration for this conveyance and will hold.the right to receive such consideration as a
Umst fund to be applied [kst for the purpose nf paying the cost of the improvement and will apply the same first to
the payment of the cost of the improvement before using any pan of the lotal of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
