THOMAS S. ELY, as Executor of thc Estate of Carol K. Ely, who died a resident of Ontario
County, New York on December 16, 2001, residing at 8987 Taft Road, Bloomfield, New York
14469, party of the first part; and
DOUGLAS J. ELY, residing at 386 Great~ Road, North Andover, Massachusetts 01845, and
RICHARD F. ELY, residing at 1683 Commonwealth Avenue, Apt. 6, Brighton, Massachusetts
02135, as tenants in common, party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten and 00tl00-($10.00)--dollars, and to
effect the distribution of the decedent's estate, and other good and valuable consideration paid by the party of
the second part, does hereby grant and release unto the party of the second part, the heirs or successors and
assigns of the party of the second part forever,
All that certain plot, piece or parcel of land, with the buildings and improvements thereon erected,
situate, lying and being at Mattituck in the Town of Southold, County of Suffolk and State of
New York, more particularly bounded and described as follows:
SEE SCHEDULE A ATTACHED HERETO AND MADE A PART HEREOF
BEING AND INTENDED TO BE the same premises as was intended to be conveyed to the party of
the second part by deed dated November 23, 1998 and recorded on December 30, 1998 in the office
of the Clerk of the County of Suffolk in Liber 11936 Page 773, which deed inadvertently and
incorrectly conveyed only undivided fractional interests in the property. The party of the first pan is
making this conveyance to correct the deed recited above and to confirm the intention of the decedent
that a complete interest in the property be conveyed to the parties of the second part.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all
the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the
premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of
the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same
first to the payment of the cost of the improvement before using any part of the total of the same for any other
purpose. The word "party" shall be construed as if it read "parties" when ever the sense of this indenture so
requires.
