WITNESSETH, that the party of the first part, in consideration of Ten Dollars and
other valuable consideration paid by the party of the second part, does hereby grant
and release unto the party of the second part, the heirs or successors and assigns of
the party of the second part forever, in
ALL that certain plot, piece or parcel of land, with buildings and improvements
thereon erected, situate, lyiug and being in the Town of Southold, County of Snffolk
and State of New York, north of Mattituck, bounded and described as follows:
BEGINNING at a point on the northerly side of Sound View Avenue, where the
I sa~ne is intersected by the southeast corner of premises to be described and the west
line of lands now or formerly of John Popleski; running thence along tile norlhcrly
side of Sonnd View Avenue South 50 degrees 16 minutes 50 seconds west 90 feet;
running thence North 25 degrees 29 minutes 30 seconds west 658.96 feet more or
less to the high water line of the Long Island Sound as it existed October 25, 1960;
running thence easterly along said high water line the tide line of which runs North
65 degrees 41 minutes 20 seconds east a distance of 90 feet to the westerly line of
lands now or formerly of John Popleski; running thence along said lands South 25
degrees 14 minutes 40 seconds east 635 feet to the uortherly side of Sound View
Avenue at the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the Gramor by
deed dated September 1,2003 and recorded in the Suffolk County Clerk's Office in
Liber 12280 at page 238 ou October 27, 2003, subject to a life estate in E. Lawrence
Deckinger, the said E.' Lawrence Deckinger having died a resident of Queens'
Connty, New York, on January 9, 2008.
Together with all right, title and interest, if any, of the party of the first part in and
to any streets and roads abuning the above-described premises to the center lines
thereof;
Togelher with the appnrtenances and all the estate and rights of the party of the firs~
part in and to said premises;
To have and to hold the premises herein granted nnto the party of the second part,
the heirs or successors and assigns of the party of the second part forever.
And the party of the first part covenants that the party of the first part has not done
or suffered anything whereby the said premises have been encumbered in any way
whatever, except as aforesaid.
And the party of the first part, itl compliance with Section 13 of the Lien Law,
covenants that the party of the first part will receive the consideration for this
conveyance and will hold the right to receive such consideration as a trust fund to
be applied first for the purpose of paying the cost of improvement and will apply the
same first to the payment of the cost of the improvement before using auy part of
the total of the same for any other purpose. The word "party" shall be construed as
if it read "parties" whenever the sense of this indenture so requires.
