as co-Trustees of the Americo Alberi Testamentary Trust u/w dated July 20, 1991, late of Suffolk County,
deceased, Suffolk County Surrogate's Court File No. 922P96

JAMES L. ALBERI, residing at 73 Mission Hills Court, Holmdel, NJ, 07733, as Tenants-in-Common

WITNESSETH, that the party of the first part, by virtue of the power and authority given in and by said last
will and testament and in consideration of TEN ($10.00) ...............................................................
dollars, paid by the party of the second part, does hereby grant and release unto the party of the second part,
the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected,
situate, lying and being at Bayview, near Southold, in the Town of Southold, County of Suffolk and State
of New York, known and designated as lot number seven (7) on a certain map entitled "Map of Section I,
Paradise Point at Bayview, Town of Southold, Suffolk County, New York", surveyed March 25, 1963, by
Otto W. Van Tuyl & Son, Licensed Land Surveyors, Greenport, N.Y., filed in the Office of the Clerk of
Suffolk County of thc 11th day of April, 1963 as Map No. 3761.
TOGETHER WITH a right of way for ingress and egress in common with others over the roads as shown on
said map.
SUBJECT TO covenants and restrictions of record and to the covenants and restrictions contained in Liber
5919 page 36.
BEING AND INTENDED TO BE the same premises conveyed to HELEN C. ALBERi, deceased, by
deed dated July 26, 1991 and recorded in the Office of the Clerk of the County of Suffolk in Liber
11363 page 409 and to James L. Alberi and Mary Pinker, Trustees under the terms of a Trust created
by Will of Americo Alberi, deceased, by deed dated July 14, 1997and recorded in the Office of the
Clerk of the County of Suffolk in Liber 11852 page 159.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the
appurtenances, and also all the estate which the said decedent had at the time of the decedent's death in said
premises, and also the estate therein, which the party of the first part has or has power to convey or dispose
of, whether individual, or otherwise;
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been incumbered in any way whatever, except as aforesaid.
AND THE party of the first part, in compliance with Section !3 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement, and
will apply the same first to the payment of the cost of the improvement before using any part of the total of
the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year first
above written.
