first part in and to the lands below the ordinary high water mark of
Old Cove adjacent to the premises.
SUBJECT, however, to restrictions, reservations, covenants and condition
of record, if any; the rights of others to pass and repass over Carole
Road, which includes the southwesterly 20 feet of the premises, the
right, and the rights of the party of the first part or third parties
to grant to public utilities customary utility easements therein and
the following restrictions and covenants which shall attach to and run
with the land: (a) that the premises shall be used only for the purpose
of a dwelling for one family and such other buildings as are appurtenant
to the use and occupancy of the premises for residential purposes; (b)
that no business, industry, commerce, occupation or nuisance of any kind
shall be conducted or permitted on the premises, and (c) the party of th
second part, his heirs, legal representatives and assigns shall, at thei
own proper costs, charges and expense, uphold and keep in good repaid
that part of Carole Road and the bulkheading within and on their premise
SUBJECT to any state of facts an accurate survey might show.
