party of the second part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said
premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will
receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be app}ied
first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the
improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it
read "parties" whenever the sense of this indenture so requires.

--lying and being in the Town of Southold, County of Suffolk and State of New
York, bounded and described ~s follows:
BEGINNING at the corner formed by the intersection of the northerly side
of North Bayview Road with the Westerly side of proposed road to be known
as "Brigantine Drive, as said road and drive are shown on "Map of Harbor
Lights Estates, Section One, Baywiew, Town of Southold", (as corrected by af-
fidavit recorded in Liber 5833 cp 52), filed in the Suffolk County Clerk's
Office on June 8th, 1965 as map number 4362, which said point of beginning
is North 73 degrees 05 minutes 20 seconds West 459.33 feet, from the easterly
boundary of land of Frederick and Harold Reese and from said point of be
running thence along the northerly side of said North Bayview Road, North 73
degrees 05 minutes 20 seconds West 130 feet; running thence North 17 degrees
01 minutes 50 seconds Est 170 feet; running thence South 73 degrees 05 minutes
20 seconds East, 130 feet to the westerly side of said Brigantine Drive;
running thence along the westerly side of said Brigantine Drive, South 17
degrees 01 minutes 50 seconds West, 170 feet to the cornerlaforesaid at the
point or place of BEGINNING.
TOGETHER with an easement over the streets or roads shown on said filed
map.
TOGETHER with the use, in common with others, of the beach area and the
parking area adjacent thereto; said beach area having a depth of approximately
50 feet from the average high water mark on Peconic Bay and the parking area
