RED FAWN PROPERTY LLC, a New York Limited Liability Company with offices at 450 West 8605
Champions Point, Apt. 104, Naples, Florida 34113, party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten and 00/100--($10.O0)--Dollars, and
other good and valuable consideration paid by the party of the second part, does hereby grant and release
unto the party of the second part, the heirs or successors and assigns of the party of the second part
forever,
ALL that certain plot, piece or parcel of land, situate, lying and being in the Town of Southold, County of
Suffolk and State of New York, known and designated as Lot no. 5 as shown on a certain map entitled,
"Map of Forestbrook at Bayview" and filed in the Office of the Clerk of the County of Suffolk on June 15,
2004 as Map Number 11119, being more particularly bounded and described as follows:
BEGINNING at a point on the westerly side of Red Fawn Road distant 429.,~l-feet northerly as measured
along the westerly side of Red Fawn Road from the extreme northerly end of a curve connecting the
northerly side of North Bayview Road with the westerly side of Red Fawn Road;
RUNNING THENCE South 84 degrees 56 minutes 48 seconds West afong the division line between Lot 6
and Lot 5 as shown on the above mentioned map 314.19 feet;
THENCE northerly along the division line between Lot 7 and Lot 5 as shown on the above mentioned map
along an arc of a curve bearing to the right having a radius of 352.00 feet a distance of 363.14 feet;
THENCE South 43 degrees 58 minutes 40 seconds East along the division line between Lot 4 and Lot 5
as shown on the above mentioned map 292.00 feet to the westerly side of Red Fawn Road;
THENCE southerly along the westerly side of Red Fawn Road along an arc of a curve bearing to the left
having a radius of 60.00 feet a distance of 111.16 feet to the point or place of BEGINNING.
BEtNG AND INTENDED TO BE the same premises conveyed to the party of the first part herein by deed
dated 10/14/2010 recorded on 11/3/2010, recorded in Liber 12641 page 951.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the
appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE
AND TO HOLD the premises herein granted unto the party of the second pad, the heirs or successors and
assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first pad will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and
wilt apply the same first to the payment of the cost of the improvement before using any part ef the total of
the same for any other purpose. The word "party" shall be construed as if it read "padies" whenever the
sense of this indenture so requires.
