All that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being in the Town of Southold, County of Suffolk and State of New
York, known and designated as Lot Number Sixteen (16) on a certain map entitled "Bay Haven
at Southold, Suffolk County, New York", surveyed December 10, 1958 by Otto W. Van Tuyl &
Son, Licensed Land Surveyors, Greenport, New York, and filed in the Office of the Clerk of
Suffolk County on the 22"°day of January, 1959, as Map No. 2910 and being more particularly
bounded and described as follows:
BEGINNING on the Easterly side of Gin Lane distant 140.0 fee southerly from the comer
formed by the intersection of the easterly side of Gin Lane and the southerly side of Mid Way
and from said point of beginning;
RUNNING THENCE along the division line between lots 16 and 17 on the aforementioned
map, south 52 degrees 05 minutes 50 seconds .~asL 125:00 feet; ',
THENCE parallel with Gin Lane, south 37 de~ree~' 54 minutes ~10'~econds west, 140.00 feet;
THENCE along the division line betweendots 15 and 16 oi~ the aforementioned map, north 52

THENCE along the said easterly side of Gin Lane, north 37 degrees 54 minutes 10 seconds east,

The Grantors herein intend that by this conveyance to the Grantee (Trust) that their interest
formerly held as tenants by the entirety is by this instrument changed to 'tenants in common' as
held by the Trust. Each of the two beneficiaries of the grantee trust shall have an undi¥ided 50%
interest in the subject premises as the sole and separate property of each such beneficiary.
Said property BEING AND INTENDED TO BE the same as that conveyed to the party of the first part by
deed dated 6/18/1993 and recorded 07/02/1993 in LIBER 11635 PAGE 369 in the Office of the County
Clerk, Suffolk County, State of New York and said property is also known as 1085 Gin Lane Southold,
NY 11971
tOGETHER with all right, title and interest, if'any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the
appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE
AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and
assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first pan, in compliance with Section !.3 of the Lien Law, covenants that the party
of the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and
will apply the same first to the payment of the cost of the improvement before using any part of the total
of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever
the sense of this indenture so requires.
