bounded and described as set forth on Schedule A hereto.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by deed, dated
December 13, 1996 and recorded in the Office of the Suffolk County Clerk on Jan uary 2, 1997 in Liber 11808 page
881, and by confirmatory deed dated January 24, 1997 and recorded in the Office of the Suffolk County Clerk on
April 8, 1997 in Liber 11824 page 407.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the
estate and rights of the party of the first part in and to said premises; TO HAVE AN D TO HOLD the premises herein
granted unto the party of the second part, the heirs or successors and assigns of the party of the second part
forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby
the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first
part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust
fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the
payment of the cost of the improvement before using any part of the total of the same for any other purpose. The
word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.

ALL that cedain lot or parcel of land, with the buildings and improvements thereon,
in the Town of Southold, Suffolk County, State of New York, being a part of that
portion of Fishers Island lying Easterly of the following line, viz.:
BEGINNING at the southeasterly corner of land owned by the United States, known
as the Fort H. G. Wright Military Reservation, Mount Prospect Tract, on the shore of
Block Island Sound or the Atlantic Ocean; and
RUNNING THENCE northerly following the East boundary of the said land of the
United States to the southerly line of East End Road (sometimes called Oriental
Avenue) and which point is the northeasterly corner of land of the United States;
THENCE crossing the East End Road and following the same course as the Iast to
the shore of West Harbor or Fishers Island Sound;
Said lot or parcel of land being bounded and described as follows:

BEGINNING at a stone monument set on the Westerly side of a road 40 feet wide,
said monument being 884.39 feet West of a point which is 184.98 feet North of
another monument marking the U. S. Coast and Geodetic Survey Triangulation
Station "Chocomount 2" (which said "Chocomount 2" monument is located on the
summit of the highest hill on Fishers Island, N.Y. about two and one-quader miles
West of the Eastern end of Fishers Island and lies South 79 degrees 29 minutes 46
seconds East of Nodh Dumpling Light in Fishers Island Sound); and
RUNNING THENCE North 43 degrees 36 minutes 20 seconds West, 284.88 feet to
a point;
THENCE North 62 degrees 42 minutes 10 seconds West, 34.88 feet to a point;
THENCE North 11 degrees 16 minutes 50 seconds East, 186.40 feet to a point;
THENCE North 48 degrees 05 minutes 34 seconds East, 111.14 feet to a point;
THENCE South 45 degrees 6 minutes East, 324.46 feet to a point;
THENCE South 21 degrees 46 minutes 40 seconds West, 277.26 feet to a point;
and
THENCE North 68 degrees 56 minutes 20 seconds West, 20 feet to the monument
set at the place of BEGINNING.
SUBJECT TO an easement for pedestrians and vehicles, as appurtenant to and for
the benefit of the premises adjoining the above-described premises on the
southwest (hereinafter"Lot 4-G"), for purposes of ingress and egress to and from Lot
4-G and the private road adjoining Lot 4-G on the east and southeast, said
easement being 16 feet in width and located on the above-described premises
(hereinafter "Lot 4-H"), and said easement having southeasterly, northeasterly and
northerly limits that are more particularly described as follows:
BEGINNING at a point at the northerly end of a road forty feet wide, said point being
located South 68 degrees 56 minutes 20 seconds East, 20.00 feet from a monument
located at the northeasterly corner of Lot 4-G, said monument also being 184.98 feet
Nodh of a point which is 884.39 feet West of another monument marking the U.S.
Coast and Geodetic Survey Triangulation Station "Chocomount 2"; and
RUNNING THENCE North 21 degrees 46 minutes 40 seconds East, 32.19 feet to
a point of curve to the left having a radius of 131.31 feet and the direction of whose
radius at that point is North 85 degrees 54 minutes 07 seconds West;
THENCE northerly and northwesterly, following the arc of said curve, 263.70 feet to
a point on the first course described in the above description of Lot 4-H, which point
is located South 43 degrees 36 minutes 20 seconds East, 71.23 feet from the point
at which such last course ends.
TOGETHER WITH the right of the party of the second part or any future owner of
Lot 4-H to terminate the aforesaid easement by filing an instrument to such effect in
the Office of the Suffolk County Clerk; provided, however, that prior to so terminating
such easement, the party of the second part or such future owner of Lot 4-H shall
provide funds to the then current owner of Lot 4-G in an amount sufficient to pay for
the construction of a new driveway of comparable quality and width to the existing
driveway which now serves Lot 4-G and is located in the above-described easement
area as of the date hereof. At the option of the party of the second part or such
future owner of Lot 4-H, the proposed new driveway may be located wholly on Lot
4-G or partially on Lot 4-G and partially on Lot 4-H and, if it is located partially on Lot
4-H, the party of the second part or such future owner of Lot 4-H shall grant to the
then current owner of Lot 4-G an easement similar to the one set forth herein over
that portion of Lot 4-H on which the proposed new driveway is to be located.
