Owen Morrel Southold Planning Board Thursday,July 15, 2004 Dear Mark Terry and Planning Board Members; As per my discussion with Mr. Terry; prior to my submissions of An application for a 'set off' on my 12.5 acre parcel in Peconic I engaged Mr. Terry and Ms. Spiro (who evidently also conferred with Mr. Terry ) in 3 separate conversations in April and May of 2004 regarding the appropriateness of my application and it was confirmed to me that due to the fact that, as of record ,there were no prior subdivisions; it would be" appropriate" to submit my application for a 'set- off' with all the required supporting material. Thus ,I contracted an engineer, test hole driller, surveyor etc. at considerable time and expense to me. Two months later I received the enclosed letter from the Board stating that my application was inappropriate ,my check had been 'inadvertently' cashed and I would be required to re-submit at a later date an entirely new application. The Planning Board has determined that the application type is a minor subdivision and cannot be classified as a set-off pursuant to Planning Board policy. Consequently, the application is subject to Local Law No. 3 of 2002, Local Law No. 3 of 2003 and Local Law No.13 of 2003 and therefore, cannot be accepted by the Planning Board at this time. The Planning Board can only accept the application upon the expiration of the moratorium on August 9, 2004. The application fee of $250.00 was inadvertently cashed. The Planning Board will create an incomplete file for the action and note that no more fees are due upon resubmission, unless you prefer reimbursement in which we could initiate a petition for the same.
