In response to the Site Plan Use Determination (SPUD) issued on August 29, 2007, the
Planning Board held a work session on September 4, 2007 to review the determination and
offers the following comment:
Please note the determination is for an Accessory Walk In Cooler located on the north side
of the existing building along the railroad tracks. The Planning Board understands that
Town Code Section 280-55 (C) Accessory Uses states the proposed Walk In Cooler is
subject to site plan review.
Upon review of Town Code Section 280-127 Site Plan Applicability, we believe that the
proposed action does not constitute a "change in use or intensityof use" of the primary
preexisting restauram. Additionally, Town Code Section 280- 77 Parking and Loading does
not require additional parking for a walk in cooler. We understand that all storm water
runoff must be contained on site and that the runoff will be reviewed under the Building
Permit process by the Building Department. In addition any curb cuts or highway work
permits needed bythe NYSDOT can be addressed under the building permit process.
Since site changes have occurred under a building permit with a determination bythe
Building Department not to require the site plan process, the Planning Board has
determined that a site plan is not required for the accessory use of a walk in cooler.
This determination is specific to this site and proposed accessory use; the Planning Board's
determination should not be utilized on any other site plan determination.

sets of plans, accurate plot plan to scale. Fee according to schedule.

c. The work covered by this application may not be commenced before issuance of Building Permit.
d. Upon approval of this application, the Building Inspector will issue a Building Permit to the applicant. Such a permit
shall be kept on the premises available for inspection throughout the work.
e. No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector
issues a Certificate of Occupancy.
f. Every building permit shall expire if the work authorized has not commenced within 12 months after the date of
issuance or has not been completed within 18 months from such date. If no zoning amendments or other regulations affecting the
property have been enacted in the interim, the Building Inspector may authorize, in writing, the extension of the permit for an
addition six months. Thereafter, a new permit shall be required.

It has come to our attention that the Town of Southold may have issued a building permit for work at
the subject site. The site is located on the north side of NY 25, on the outside radius of a horizontal
curve.
Rigid stone planters have been constructed along the NY 25 highway frontage. By copy of this letter
we request that we be provided with three (3) copies of site plans that clearly depict the planter
locations and the NY 25 ROW line. Our policy recommends that any permanent structures installed
on private property provide a minimum fifteen (I 5 ) foot offset from the ROW line.
The development should be sensitive to the unique visual and historic setting of the Long Island
North Shore Heritage Area, which runs from the Queens/Nassau County line to Orient Point, and
from Route 25 or I495, whichever is farther south, north to Long Island Sound.
In all future correspondence, please refer to the subject case number. The plans must also include the
County tax map number.

Hello to All,
This email is to update everybody on the inquiries I have received about the big Mammas
site.
On Friday I received a transferred telephone call from Mark Wolfgang of the NYS DOT
in reference to the work at Big Mammas in Southold. The State is concerned that the
masonry work may encroach the NYS ROW. I indicated to Mark that the Planning
Department is not working on a site plan and that I believe that the Building Department
issued a construction work permit. I also advised Mark to write a letter to the Building
Department and to cc; Supervisor, Superintendent of Highways and the Planning Board
Chairperson.
Additionally, on Thursday 6/21/07 at the ARC meeting, Nick of ARC questioned the
facade changes at the Big Mamas site. The committee had a full discussion with respect
to Facade changes without approval from them. The general concern is that the entire
front of the restaurant appears to have changed from what was originally built. I
suggested that they send a letter to the Planning Board about the concern.
As you can see the Planning Department is receiving multiple inquiries about the site
changes, please inform me if the Plalming Board would like me to do anything else other
then the above.

Big Mamas SCTM 56-4-6 and general Site Plan violations/conformance
issues for site plans.
To All,
Please be advised that a discussion took place with Pat, Mike, Amy and myself about site plan
conformance in Pat office this morning.
This was meant to be a general discussion on site plans, however it focused on Big Mamas Restaurant
The following is some general history. Jamie Richter notified Bruno Semon last Thursday around
11:30am about site work at Big Mammas Restaurant site on the Main Road in Southold. Jamie informed
me that phragmities were being cut, parking lot pavement being extended and belgium block being
installed. At this time mostly site plan elements. Within a short time of speaking with Jamie I went down
to the Building Department and asked Damon/Pat if a building permit/SPUD is pending. The answer was
no not at this time. I then went into Mikes office and informed him about Jamie's concern and was told
this needs to go to Ed Forrester. Lynn Krauza was then informed of this issue. I have now been informed
that Ed made a site visit on Friday and verbally spoke with Mike about the site work and site plan
requirement. On Tuesday afternoon Jamie contacted Amy after driving by the site with concerns and
wanted to know if the Planning Board new of the work taking place which included: removal of phragmites,
repaving parking lot & possibly increasing the parking lot. Jamie stated it appeared they were preparing an
area to be made into a patio in the front.
As of today Mike indicated he is involved with a window change permit and possibly a kitchen alteration.
Mike stated that he will take care of the parking and drainage change in the Building Department and
probably not require site plan as of now. Mike indicated that he has a new form which will be used under
the new drainage code to take care of some site plan improvements. Mike told us we need to research
for approvals on our end. Bruno indicated that this site may not have a site plan approval and may be pre-
existing, additionally all information would be in the Building Departments permit / certificate of occupancy
file. Bruno stated that both the NYS DEC and the Trustees possibly need to look at the site work because
wetlands exist across the LIRR tracks and across the Main Road. It was agreed that the MtI~'3'T paved
the aprons during the road repaving, however there may not be an approved I~v~T~__urb cut. ~S'i3~ C
A site visit was made at 2:30pm today and pictures are available upon request. We met Bill the owner
and several other people at the site. Be advised we were invited into the building and witnessed the
following work on site:
Electrical, plumbing, framing and various other trades in the building and on the property.
In reference to the SCTM 56-4-6 the following facts were discovered with research:
No Planning Board site plan approval could be found.
Three Building permits have been issued on the property
BP # 3620 was issued in 1968 and received a c/o on June 11, 1968 for the restaurant building
BP # 8287 was issued in 1975 for an addition and has no c/o issued.
BP# 18337 was issued in 1990 and received a c/o on April 27, 1990 for a fire door.
None of the above referenced building permit laser fiche files had Planning Board approval.
The following was discussed and will need to be further discussed with Mark, the Planning Board and all
involved parties:
It was requested that Planning'l~partments site plan staff upon notification ~l~ut site development
changes will investigate the changes as to whether the actual site changes for example ( increase in
pavement, landscape, parking lot restriping, aisles, access, etc) conforms with the approved site plan.
it is in violation with an approved site plan staff will bring it to the Planning Board and then notify the
applicant by letter about such violation.
If
The following information and questions need further discussion and clarification:
Planning Department Staff is under the impression that only the Building Depadment can determine the
following within the Town Code;
If a site plan violation on exists on a site with respect to Town Code.
If a site plan is required for the site work.
If a site plan amendment is required for the work.
In the past Planning Department Staff has been informed that they must review the parking requirements
of the Town Code by Mike Verity as well as Handicap space compliance.
If no building permit is required for the site improvement work who determines a site plan violation exists?
If it is determined that a violation exists, who determines if a site plan application or an amended site plan
application is required?
If no site plan has been approved by the Planning Board and the use/building is existing, does the a site
improvement now require site plan approval?
If no site plan approval exists and no drainage exists on site, does the site require drainage for the site
improvements and intern a site plan application?
At what in time is Planning Staff legally allowed to inspect site plan work on a property?
Please be advised that this will be added to the Planning Boards Work Session agenda for April 30, 2007
