Prior to an approval of the site work and issuance of a New York State Highway Work Permit, the following items must be addressed: 1. The plans show three of the four (4) advertising signs within the NY 25 right-of-way (ROW) along this site's NY 25 frontage called out for removal. Please revise the plans so that all four (4) advertising signs within the NY 25 right-of-way are called out for removal 2. The curb design for the buffer median to separate the one-way access points for the farm stand / retail store should have curved radii shown at each corner. A two (2) foot radius should be sufficient. Also, the driveway radii on the west side of the ingress and the east side of the egress should be increased to thirty three (33) feet in accordance with our current driveway design guidelines. Please revise the plans accordingly providing specifications and details in accordance with NYSDOT standards. 3. The "exit only" signs shown at the winery egress shall not be shown within the NY 25 ROW as they are not MUTCD compliant. 7. Stop signs should be shown and called out in the egress driveways. 8. NY 25 pavement, at this location, consists of composite pavement with asphalt shoulders. A note shall be added to the plans stating that if the contractor causes any damage to the existing concrete pavement the contractor shall replaces the concrete pavement to the existing longitudinal joint in accordance with NYSDOT Calcium Chloride Pavement Repair Details. 9. The Work Zone Traffic Control plan signing indicates a shoulder closure but the scheme shows that a lane is taken. The plan should be revised to show the placement of channelizing devices along the white edge line or the signing should be revised in accordance with the plan. Site plan approval for highway work permit issuance is contingent upon our receipt of all of the following items within six (6) months of the date of this letter and no further revisions are made to the plans once we approve them. If the Highway Work Permit will be secured by anyone other than the property owner, i.e. contractor, the applicant must provide a signed letter from the property owner stating the applicant is authorized to act on behalf of the property owner in this matter. The letter must also include the property owner's mailing address and telephone number. Kindly submit three (3) sets of revised plans. We recommend that the design professions consult our driveway policy manual which is available on our website at Aww.nysdot.uov. On the NYSDOT A -Z bar click on "H", then click on Highway Work Permits and then click on Policy and Standards for the Design of Entrances to State Highways. In addition to the driveway design and permitted number of access points per parcel, the publication contains a complete list of items to include on submitted site plans. Please make sure all items are included on the plans such as all the existing and proposed State Highway pavement markings, all the existing and proposed signs (including text) along the site's State Highway frontage, etc. 2. In recent years, many states have employed access management as a major technique to address conflicts between through traffic and that generated by developments. The goals of access management are to limit the number of access points, separate conflict points and remove turning traffic from through movements. New York State is utilizing this technique to minimize impacts to State highways. We recommend, therefore, that cross access to this site be obtained from adjacent property. We will not permit three (3) access points to this site. Our current policy recommends one (1) access point to a parcel. A second access point may be necessary if there are extenuating circumstances. The center access point is not sufficiently wide enough to permit two-way traffic. It may be possible to consider a one way ingress on the west end of the parcel with a one-way egress in the center, while considering a two-way access point for the farm stand / retail store. All access points must be designed in accordance with our current driveway design policy for us to consider this scenario. This plan submission does not reflect a driveway design that could be considered for approval. 4. The driveway section must be constructed with full depth asphalt pavement for the minimum limits shown in our driveway policy manual. All work and material details shall be shown referenced to NYSDOT specification item numbers. 5. A detail plan(s) showing all the work proposed in the NYSDOT ROW is needed. The plan shall include NYSDOT standard sheets, details, sections and items. The plan shall address the following as needed: NYSDOT standard driveways, grading & elevation information, storm water run-off (note all drainage must be contained on-site), erosion and sediment control, landscape plantings & restoration. 6. We recommend that the applicant plant wire friendly trees (see National Grid tree list on their website) along NY 25 on the state ROW to enhance the streetscape. Use an approximate set back of 15 feet (or less depending on the ROW width) from the edge of the travel lane. 7. This proposed development is situated along NY Bike Route 25. Consideration should be given to installing bike rack(s) on site. 8. A note shall be added to the plans requiring the contractor to clean existing drainage basins along and immediately adjacent to the NY 25 site frontage at the completion of construction. 9. A Work Zone Traffic Control plan must be provided for work on NY 25. The plan should be developed to accommodate bicycle traffic. The plan must include the note "All lanes must be open to traffic before 10 AM and after 3 PM. No lane closings are permitted on weekends or holidays. Nighttime lane closings will not be permitted without prior approval from the State Permit Inspector." 10. The plan must include the note "Repair existing shoulder, sidewalk and curbing as ordered by State Engineer." 11. Please show and call out the nearest NY 25 mile marker on the plan. 12. We recommend that permanent survey markers be installed at the property limits along the State highway frontage. 13. By the time we were able to pick up the mail at the post office , the date of the hearing already had approached. What type of games are these? Again, why did we have to deliver our material (see below) to our neigbors more than 3-4 weeks in advance of a hearing and the attorney for Lav -Cor (return address totally illegible, something like Karen H... , Esq.) mails out these notices a few days before the hearing? Why does she sit on the mail that was dated 10/21/10 to arrive on November 8? At that date no postal worker made it to our door, but instead left a note in our mail box to pick up a letter? By the time my husband picked up the letter, the day of the hearing had already rapidly approached. Have you heard of people who work during the week and can only make it to the post office on Saturdays? I strongly protest such lack of proper timely notice, together with the lack of information being included (see below). Such procedures do not reflect any serious attempt to reach the neighborhood and to participate intelligently in the hearing. It certainly smells of self dealing. Peconic Bay Winery Dear Ms. Kalin, OEC -72010 I received a registered flyer with the above identified reference, informing me about an amended site plan for Lav -Cor Agricultural, Inc/Peconic Bay Winery ("Lav -Cor") 12/7/2010 Page 2 of 3 I am very surprised about this type of "abbreviated" , non -informative Notice. Recently, we had a Buildings Department Request of a smallish nature (garage extension), now resolved, and we were required to conduct an entire survey of our one acre residential property, showing every detail of the property. We then were required to provide the extended neighborhood with a tremendously thick package of information, also registered, including copies of the survey plan - all to a great expense, in preparation for the public hearing. It appears that the plans of Lav -Cor are of a much larger scale, involving the public in general and public access etc. However, in the Lav -Cor case, no survey is provided and we are told that the file for Lav -Cor can be inspected in the Planning department of the Town Hall during normal business hours of 8AM -4PM. I am a working professional and I am not able to take off to inspect such plans. Why doesn't Lav -Cor have the same obligations as a private residence has? Thus, I am asking you to make at least a reduced version of the site survey available to us, which we can study at a time convenient to us and before the hearing. Lav -Cor already has solar banks, so are the solar panels announced in the notice in addition, where would they be located? Where exactly is the additional parking located, where it the access? While promoting the recent North Fork Rock concert, Lav -Cor had information in its website link, announcing that the Entrance would be on about 1410 Stillwater Ave. Stillwater is a smallish residential Street with no real outlet or even an area for turn- around. Any parking for the concert at that area would have been a disaster. As it turned out, this address apparently was an "overflow parking", which apparently was not needed after all. However, it signaled that Lav -Cor has not much concern for the residential tranquility of bordering areas, such as Stillwater Ave. The same is the case for Lav-Cor's always expanding musical entertainment, they offer on a regular basis to its customers. From non -electronically amplified music, during the afternoon hours, they expanded to highly amplified music during expanded hours into the evening, and now they further expanded to a Band Stand for accommodating larger bands and full concert electronic equipment. With the apperance of the band stand, the musical entertainment further expanded into the evening hours. Where the neighbors ever consulted with respect to this exceptional loud music and always expanding hours? Apparently Lac -Co is not subject to any noise ordinance? Don't get me wrong, I am all in favor of local business doing well and coming up with innovative ideas. I myself support everyone as much as possible, including Lav -Cor. The site plan indicates Drainage system "A" in three locations. From the chart provided, it would appear that two of these locations should be renamed system "B" & "C" respectively. Grade elevations for all driveway and parking areas should be provided to indicate direction of surface flow. Top of grate elevations should be provided to indicate the proper slope needed to allow the proposed drainage structures to function as designed. Final grade elevations along the property line must be left high enough to direct surface flow back toward the proposed drainage systems and prevent storm water runoff from entering the state right of way. 3. Drainage Calculations have not been provided for the proposed solar array. It is recommended that the site area below these solar panels be left free of topsoil and/or loam to allow the recharge of storm water generated by these panels. 4. Handicap parking spaces noted on the site plan appear to be located in gravel parking areas.
