THIS INDENTURE, made this /2 0 `day of pw.;rtT nineteen hundred and ninety-nine
BETWEEN ZOUMAS CONTRACTING CORPORATION, having its principal place of
business at 18 Deerfield Drive, P. o. Box 361, Wading River, New York 11792
Party of the first part, and
MARK SAPORITA and LORRIE ANN SAPORITA, his wife, both residing at
306 Community Drive, Apt. 2B, Manhasset,New York 11030
WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other
valuable consideration paid by the party of the second part, does hereby grant and release unto
the part of the second part, the heirs or successors and assigns of the party of the second part
forever.
ALL, that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being in the Town of Southold County of Suffolk and State of New
York, known and designated as Lot #9 as shown on a certain map entitled, "Map of Angel
Shores" and filed in the Suffolk County Clerks Office on August 23, 1995 as Map # 9729, and
which said lot is more particularly bounded and described as follows:
BEGINNING at a point on the northerly side of Water Terrace where same is intersected by the
division line between lots. 8 and 9 as shown on said map; RUNNING THENCE North 03
degrees 40' 00" West, along said division line, 223.88 feet; THENCE North 87 degrees 32' 17"
East, 72.35 feet; THENCE South 46 degrees 38' 19" East, 193.89 feet to the northerly side of
Water Terrace; THENCE Westerly, along the northerly side of Water Terrace, on an are of a
arc of a curve bearing to the right having a radius of 300.00 feet a distance of 225.00 feet to the
point or place of BEGINNING
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by
deed dated 12/24/98 and recorded 1/8/99 in Liber 11938 cp 696.
The above conveyance has been made with the unanimous consent in writing of all the
stockholders of the party of the first part.
TOGETHER with all right,title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof. TOGETHER
with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the fust part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold the
right to receive such consideration as a trust fund to be applied first for the purpose of paying
the cost of the improvement and will apply the same first to the payment of the cost of the
improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it to read "parties" whenever the sense of this
indenture so requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and
year first above written.
