This correspondence is intended primarily to expedite the procedural requirements of SEQRA pertaining to the establishment of lead agency. The comments provided below are, therefore, general in nature, representing several of our most common concerns regarding Suffolk County projects. The department wishes, however, to reserve its right to provide more detailed information within the comment period(s) established for this action. I. Suffolk County Sanitary Code (SCSC) 1. The SCDHS maintains jurisdiction over the final location of sewage disposal and water supply systems, pursuant to the authority and requirements of Articles 4, 5, and 6 of the SCSC. Applications must comply with all relevant density and construction standards for water supply and sewage disposal. Applicants should not undertake the construction of, or connection to, either system without Health Department approval. 2. The Suffolk County Department of Health Services has not received an application for the commercial proposal as required by Article VI of the Suffolk County Sanitary Code (SCSC). The project sponsor should submit an application to our agency's Bureau of Water and Wastewater at the earliest possible date so that a complete technical assessment of this proposal can be undertaken. Some of these items will be answered in this letter and some have been addressed in the revised drawings that are attached hereto. Following are our responses to your questions; I. We have been in contact with the Building Department to address your concerns about the date of the denial letter and should have a written response from them shortly. 2. An application fee is attached 3. There are currently three buildings located on the three parcels owned by the Library. One of the buildings is currendy vacant and is to be partially demolished and moved to a new location. This building has now been labeled as the Library Annex on the site plan. It will have a gross floor area of I250 square feet and potential uses will be accessory office space for the Library. We have proposed a non-medical office use for the purpose of parking calculations. The second smaller building is currently used by 'The Friends of the Library' for book storage and occasional book sales to generate funds for Library activities. This building has been labeled as the Friends Building on the revised drawings. It has a gross floor area of 657 square feet. We have proposed a retail use for the purpose of parking calculations. The third building is the current library which will be expanded. 4-. Updated parking calculations for the uses stated above are located on sheet S-I of the drawing sets. 5. A landscape plan has been submitted for your review on sheet LP-I. 6. We have asked out lighting representative to prepare a photometric drawing for the exterior lighting on the project and submit a written specification for the proposed lights. Attached is a lighting diagram which shows the proposed exterior LED lights mounted on I4 feet high poles. The diagram shows compliance with the maximum average .8 foot candle illumination throughout the site. 7. A 200 feet radius map is included with the drawing set on sheet S-3. The information was taken from the tax map drawings located in the Town's Assessor's office. The uses were derived by a walk-through of the area. t!O. Also included as part of the site plan are two additional buildings on site namely the library annex 1,250 sq. ft. proposed to be re-located on site for office space and The Friends of the Library building 657 sq. ft. for retail space. The property is located in the Hamlet Business Zoning District on the north side of Main Street (through street, Traveler Street), approximately 190 feet west of Beckwith Avenue, $outhold. Reasons Supporting This Determination: An Environmental Assessment Form has been submitted and reviewed. The determination was based upon the following: SEQR NeRative Declaration - PaRe Two Impac, t On Land Soils on site consist of Riverhead and Haven Soils (RhB) and Haven Loam (HaA). Riverhead and Haven soils are representative of outwash plains; are well drained, and medium textured. The hazard of erosion is slight. Haven Loam normally occurs on outwash plains; is well drained, medium textured soils with slight hazard for erosion. Aerial analysis indicates that the proposed library addition is located on Riverhead and Haven soils. There are no engineering concerns associated with the soil series. Potential impacts to the soil stability have been mitigated with on-site drainage system as depicted on the Grading and Drainage Plan (S-2). Soil borings indicate that groundwater levels are greater than 17 feet. Therefore, the depth to groundwater is sufficient to meet the 3' separation distance required for sanitary systems per Suffolk County Department of Health standards. No substantial impact to groundwater is expected to occur if the project is implemented as planned. Impact of Water 1. Water Supply The proposed addition will be served by public water. 2. Sanitary Disposal Sanitary disposal will be managed by on-site underground sewage leaching systems. In 1978, the Long Island Regional Planning Board published the Long Island Comprehensive Waste Treatment Management Plan (208 Study). The 208 Study identified eight (8) hydrogeologic zones in Nassau and Suffolk Counties. These zones were distinguished based upon differences in underlying groundwater flow pattems and water quality. The subject site is located within SCDHS Groundwater Management Zone IV, which according to Article VI of the Suffolk County Sanitary Code, has an allowable flow of 600 gallons per day (gpd) per acre in areas served by public water. The sanitary design flow is computed using SCDHS manual Standards for Approval of Plans and Construction for Sewage Disposal Systems for Other Than Single Family Residences. The manual establishes the design flow as follows: Total acreaRe of 1.78 x 600Rpd = 1~068 .qpd allowable flow Total proposed flow = 1068 .qpd. Therefore, the proposed application would conform with Article VI of the Suffolk County Sanitary Code and would not be expected to adversely affect ground water quality provided properly functioning systems are designed and installed. SEQR Negative Declaration - Page Three 3. Ground or Surface Water Quality or Quantity A grading and drainage plan has been submitted and reviewed. Best management practices to deal with storm water are adequate and therefore, potential impacts from storm water run-off are expected to be Iow. No sun'ace water is located within the vicinity of the site. 4. Flooding The proposed improvements are located within FEMA Flood Zone X; areas identified as areas of moderate or minimal hazard from the principal source of flood in the area, therefore, the potential impacts from threat of flooding are Iow. Impact on Air No substantial adverse change in existing air quality is expected to occur. Impact on Plants and Animals The parcel is not located within a New York State Department of Environmental Conservation Critical Environmental Area or a New York State Department of State Significant Fish and Wildlife Habitat Area. The parcel(s) are developed. The proposed location of the 7,258 sq. ft. three-story addition on the east side of the existing library is currently an unimproved parking lot where a building was razed. The proposed parking areas are also proposed to be located on improved parcels. Therefore, the potential occurrence of rare or threatened plants or animals on site or within the vicinity of the site is Iow. The parcels are in lawn or residentially landscaped. No significant removal or destruction of large quantities of vegetation is expected to occur. Correspondingly, no substantial interference with the movement of any resident or migratory fish or wildlife species nor impacts on a significant habitat area is expected to occur. Impact on A~lricultural Land Resources The parcel is located within the Southold Hamlet Business District and not currently in agricultural production. Therefore, no adverse impacts to agricultural lands will occur. Impact on Aesthetic Resources The parcels are located adjacent to a designated New York State Scenic Byway (S.R. 25) and west of Traveler Street. Historically, the site where the proposed addition would be located had been improved with buildings. The site is now an unimproved parking area and vacant. SEQR Ne,qative Declaration - Pa,qe Four The historic single family residence building that is located adjacent to Traveler Street is proposed to be re-located to the west on the same parcel. Following the removal of the structure, the parcel will be developed into a parking area. The development of the parcels is not in conflict with the surrounding streetscape character and/or will not cause an adverse impact on aesthetic resources. No substantial adverse impacts to aesthetic resources are expected to occur. Impact on Historical and Archeolo.clical Resources The parcels are not located within the Southold Historic District. However, the library building (SCTM 61 .-1-14) was constructed in 1891 for the Southold Savings Bank and is SPLIA listed. In 1927, the library re-located to the building from a rental. The single family residence structure on 1000.-61-1-15.2 was built in 1844 and moved to the parcel in 1978 from Main Street. It is SPLIA listed and served as the first Town Clerk's Office. A portion of the structure is proposed to be re-located to the west on the same property. The New York Department of State GIS-Public Access map was referenced for occurrence of archeo-sensitive areas on site. The area is included and identified as an amheo-sensitive site. The New York State Department of Parks and Recreation and Historic Preservation should be contacted to determine what level (if any) amheological audit should be accomplished. Therefore, it is unknown if the proposed action will impair important historical or archaeological resources at this time. Impact on Open Space and Recreation No impacts to public open space or recreational areas will occur as a result of this action. Impact on Critical Areas The proposed action is not located within a New York Department of Environmental Conservation Critical Environmental Areas. Impact on Transportation The applicant submitted Average Vehicle Trip Ends per 1000 square feet of gross floor area for Public Libraries taken from the "Trip Generation 7th Edition Volume 3 Of 3 by the Institute of Traffic Engineers". Potential impacts from traffic volume (generation) or flow are expected to be Iow over current conditions. Impact of Energy A photometric diagram of exterior lighting product cut sheets for exterior LED lights has been submitted. Lighting fixtures are proposed as dark sky compliant. No major change in the use of either the quantity or type of energy is expected to occur. SEQR Ne,qative Declaration - Pa.qe Five Noise and Odor Impact No substantial change in noise or odor is expected to occur. Impact on Public Health No creation of a hazard to human health is expected to occur. No substantial increase in solid waste production, leaching or drainage problems is expected to occur if the proposed action is implemented as planned. Impact on GrowthI Character of Community or Neighborhood The proposed action is not in a si.qniflcant material conflict with a community's current plans or goals as officially approved or adopted. Based upon such, no significant adverse impacts to the environment are expected to occur should the project be implemented as planned. This site plan has been prepared by the office of Gary Jacquemin, Architect and Robert Stromski, Architecture, PC and has a revision date of 7/14/10. Please consider the following: 1. The Southold Free Library Site is made up of three (3) individual Tax Map parcels. Tax Map Parcel # 14 is 60' in width and extends out in a northerly direction across Traveler Street to the LIRR Property. This portion of the property has not been shown on the site plan as part of the proposed development. Enclosed you will find and aerial view highlighting this area. It is recommended that this area be outlined with meets and bounds descriptions and be offered for dedicated to the Town as part of this Site Plan Application. 2. The southerly portion of this site plan terminates along State Route 25. It is recommended that this site plan be submitted to the State DOT for review and comment. A State DOT Curb Cut Permit or a letter of non jurisdiction should be required. 3. Access to the adjacent site noted as "53795 Southold Properties LLC" will be restricted by the proposed construction. It appears that the existing drive will be narrowed by as much as 75% of its current width and would prevent parking in the rear yard of this adjacent parcel. The Planning Board should consider requiring the applicant to verify all access easements and/or property rights of the adjacent parcel prior to authorizing these improvements. 4. Drainage Calculations have been provided and meet the minimum requirements of Town Code Chapter 236 for Storm Water Management. 5. The Drainage design needs to provide additional information. The proposed Catch Basins and leaching pools should be labeled and/or numbered in a manner that corresponds back to the Drainage Calculations. The size and type of drainage piping used must be indicated or shown on the plan. All leaching pools and/or catch basins should be noted with an overall size and section details should be provided for each different structure type. The plan must also indicate all top of grate and pipe invert elevations to ensure that the functionality of the proposed drainage swale areas. Page I of 2 Martin H. Three Drainage Swale areas have been indicated on the site plan. Will these areas be excavated down to sand? What will be planted at this bottom contour? Will the inlet grates on the leaching pools shown in these areas be raised above the bottom elevation of the drainage swale? A cross section detail should be provided to indicate the intent of the proposed design and the overall capacity of the proposed swale areas should be noted or indicated on the plan. 7. The Landscaping Plan must be coordinated with the Drainage Plan. Some of the proposed trees appear to be positioned over drainage structures that are located within the proposed drainage swales. Trees and landscaping should not be planted over leaching pools. In addition, if the swale areas are designed to accommodate additional drainage capacity they should not be grassed over. Vegetation & planting that is tolerant of sandy soils should be used to enhance the capability of these drainage swale areas. BASIS OF APPLICATION: Request for Varinnces from Code Section 280-46, based on an application for a building permit and the Building Inspector's October 13, 2009, Notice of Disapproval concerning proposed addition to a commercial building, at: height exceeding code permitted maximum number of two stories. RELIEF REQUESTED: The applicant proposes to construct what has been determined by the Southold Town Building Department to be a three [3] story addition to the main Library building. This number &habitable stories is not allowed by Town Code and requires a variance prior to being permitted to proceed with the proposed construction. ADDITIONAL INFORMATION: The Applicant's proposed additions are subject to site plan approval by the Southold Town Planning Board. These three properties owned by the Southold Free Library have been the subject of several past decisions of this Board. In Appeal 3145 the Board rendered a decision dated Aug. In Appeal 3256 the Board rendered a decision dated Aug. 14, 1984 approving the division of land which created two lots, 15.1 and 15.2, from 1000-61-01-15. In Appeal 3861 the Board rendered a decision dated Oct. ~., 1989 approving an addition to the main Library building located on lot 1000-61-01-14. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application July 29, 2010, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Town Law ~267-bI3){b~(l), Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. A public library is a permitted use in the Hamlet Business District. No variances are requested for any setbacks. The proposed addition will improve public access to the library by establishing a street level entrance and plaza along Main Strefft at the basement level of the existing library. The overall height of the proposed addition will be the same as the existing library and will comply with the maximum building height allowed by Town Code. 2. Town Law ~267-bI311b~(2L Thc benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance, because a new three-story habitable structure is not allowed in Town Code except through the grant of a variance. 3. Town Law ~267-b13'~lb~(3~. The variance granted herein is substantial considering the fact that new three story habitable structures are not permitted under Town Code. However, the proposed addition is for an extension of an existing three story public building being used as the Southold Town Free Library, and such a public use presents a compelling reason to grant the variance for the proposed three story addition. The overall height of the proposed new addition, at 33.7 feet, will not exceed the maximum height of 35 feet allowed by Town Code. 4. Town Law ~267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this Hamlet Business District will have an adverse impact on the physical or environmental conditions in the neighborhood. There will be a significant increase to the available onsite parking, including more parking spaces for vehicles used by handicapped persons. Vehicle access to the parking will be by way of Traveler St., which is a less traveled road than is Main Road S.R. 25, which will also continue to have a pedestrian only access at the front of the building. 5. Town Law ~267-b(3)(b)(51. The difficulty has been self-created, and is a result of the architectural design chosen by the Applicant for the proposed addition. However, given the substantial difference between the elevation of the existing library building above street level along Main Steer and the adjacent property upon which the addition is to be built, the proposed three story design is the most feasible for the applicant to pursue, since it will avoid substantial re-grading and the creation of potential drainage complications. 6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a new addition, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion wes offered by Member Goehringer, seconded by Member Weisman (Chairperson), and duly carried, to Pagc 3 - August IS, 2010 GRANT, the variance as applied for, and shown on the site plan survey and architectural drawings prepared by Robert Stromski and dated Sept. 15, 2010. We have been in contact with the Building Department to address your concerns about the date of the denial letter and should have a written response from them shortly. 2. An application fee is attached 3. There are currendy three buildings located on the three parcels owned by the Library. One of the buildings is currendy vacant and is to be partially demolished and moved to a new location. This building has now been labeled as the Library Annex on the site plan. It will have a gross floor area of I250 square feet and potential uses will be accessory office space for the Library. We have proposed a non-medical office use for the purpose of parking calculations. The second smaller building is currently used by 'The Friends of the Library' for book storage and occasional book sales to generate funds for Library activities. This building has been labeled as the Friends Building on the revised drawings. It has a gross floor area of 657 square feet. We have proposed a retail use for the purpose of parking calculations. The third building is the current library which will be expanded. 4. Updated parking calculations for the uses stated above are located on sheet S-1 of the drawing sets. 5. A landscape plan has been submitted for your review on sheet LP-i. 6. We have asked out lighting representative to prepare a photometric drawing for the exterior lighting on the project and submit a written specification for the proposed lights. Attached is a lighting diagram which shows the proposed exterior LED lights mounted on 14 feet high poles. The diagram shows compliance with the maximum average .8 foot candle illumination throughout the site. 7. A 200 feet radius map is included with the drawing set on sheet S-3.
