After careful consideration, the Planning Board has determined that the development area for Lot 3, as proposed, is not in an acceptable location. Placing the house for Lot 3 in the middle, or at the southern end of this parcel would have a detrimental effect on the resources that conservation subdivisions are designed to protect. Active agriculture, an important resource in Southold, would likely be discontinued by this configuration of lots. The location also intrudes into an otherwise unbroken block of 400 acres of preserved agricultural land and open space, and would take away from the expansive and unique scenic vistas now enjoyed by the public from both Orient State Park and Hallocks Bay. Further, the proposed location is at the low elevation of five to six feet, and the distance to groundwater is probably only about two to three feet below the surface. Locating the development area of Lot 3 next to proposed Lots 1 and 2 is advised, would better protect thc resources, and follows the principles of good planning. Site visit conducted in December, 2008 2. Planning Board meetings on 1/7/08, and 1/22/08 The site visit was conducted on December 6, 2008 at 8:00 am. It was about 20 degrees and breezy that day, and no one took notes or photographs. We simply walked the property, marked out where we believed the proposed building envelopes were on the ground, and then drove to Orient State Park to visualize the potential scenic impacts. We used the subdivision map provided by your office, and the tax map to help us understand on the ground what is shown on the maps. No ensuing correspondence or notes were generated as a result of the site visit. Instead, we waited, at your request, to discuss the site visit at a ~vork session where you and your client could be present -- the Jannary 7, 2008 work session. The Planning Board meetings to which you refer were Planning Board work sessions where no minutes are routinely kept. On January 7, 2008, I kept notes, as I also did at the Land Preservation Committee meeting on January 8, where Marty Sidor, Planning Board member attended to discuss whether there were any possible alternatives for the house location on Lot 3. Both pages are enclosed. On January 22, 2008, I noted that the Planning Board wanted to send a letter that contained what was stated to you in person at the work session, and you received a letter to that effect shortly thereafter, dated January 23, 2008. Francis & Son, Inc., and its President, William Trinkle, in connection with the referenced subdivision application, which involves a 26.482 acre parcel in Orient. We are scheduled to appear before the Planning Board on January 7, 2008. We respectfully submit this letter so that you understand the history of this application and the applicant's position. By way of background, in March 2005, the applicant was considering whether to purchase this parcel, so we met with Town of Southold Planning Department staffto discuss the feasibility of subdividing this parcel. At that time, we were strongly encouraged by staff to proceed with a conservation subdivision and to prepare plans for their review. From the outset, we emphasized that Mr. Trinkle was interested in this parcel because he wanted to build a home for himself in the southerly portion. At our second meeting, in May 2005, we presented the first of many sketch plans to the Planning Department staff, including a conservation subdivision plan showing a buildable area 20 MAIN STREET 51 HILL STREET 106 ROUTE 112, FL 1S 400 TOWNUNE ROAD 56340 MAIN ROAD, P O. The plan included three buildable lots, with Lots 1 and 2 located along the northerly property line, and Lot 3 located toward the southerly portion of the property. Based upon the very positive feedback from the staff and assurances at these meetings, our client purchased the property on July 1, 2005. The next meeting with the Planning Department staff was held in October 2005 to present our revised plans based upon recommendations from the staff. Additional meetings were held over the next year with the Planning Department staff whereby our client diligently incorporated each request by staff into his plans. Based upon the recommendation of staff, we presented a 75/75 conservation subdivision plan to the Southold Planning Board at a pre-submission hearing held on October 30, 2006. At that meeting, the Board expressed their enthusiasm for the proposed plan, which consisted of a three lot subdivision with a development area of 6.392 acres while preserving 19.175 acres. In fact, one Board member stated: "This is exactly what we are looking for." The Planning Board's only comments were recommendations (1) to utilize the existing right of way, (2) to create a buffer and setback area for the southerly lot, and (3) to move the southerly lot slightly north while keeping the center of the lot contiguous open space for farming. Our client set about revising the subdivision plan based upon the Board's recommendations and presented a revised plan to staff in April 2007, at which time they advised us that we were ready to file an "official" subdivision application. We filed the 75/75 Conservation Subdivision Application with the Planning Department on October 4, 2007. We learned on October 17, 2007 that our application was presented to the Board two days earlier at its October 15, 2007 work session, without any notice to our office or the applicant so that we could be present to discuss any issues the Board or staff may have raised. Unfortunately, and much to our surprise, despite two years of meetings with staff and the Board, the application was rejected. We received a letter from staff advising that to qualify for a conservation subdivision we must apply for an 80/60 Conservation Subdivision, preserving a larger portion of the parcel, and that the location of Lot 3, which had always been located near the southerly end of the property since the very first sketch plan in 2005, was no longer acceptable. In addition, we were informed that the Southold Land Preservation Department also rejected our application. On November 13, 2007, Mr. Trinkle, his surveyor and I met again with the Planning Department staff and Melissa Spiro of the Land Preservation Department, to discuss these latest developments. Based upon the discussions at that meeting, Mr. Trinkle agreed to file an 80/60 Conservation Subdivision, reduce the lot sizes, reduce the development area to 5.110 acres, and increase the preservation area to 20.440 acres. Staff indicated that they felt the Board would be "flexible" and allow the applicant to locate Lot 3 in the southerly portion. This revised plan was submitted to the Land Preservation Department and the Planning Department on November 20, 2007. 'Town of Southold Pl~nning Board December 31, 2007 Page 3 We spoke with staff on December 18, 2007 to discuss the revised 80/60 Conservation Subdivision Plan, at which time we were advised that the proposed plan had been rejected. This time, staff, despite the Board's prior request to keep the open space contiguous and in the center of the lot, advised that the southerly Lot 3 must be moved further north towards the center of the parcel,l It should be noted, that the location of Lot 3 had changed only slightly in the almost three years of meetings and discussions with the Planning Board and Planning Department and their continuous review and editing of our client's plans. Why did it take two and one-half years to inform our client that his plan of building his home in the southerly portion, which is the main reason that he purchased the property, would not be approved? It has always been our understanding that the purpose of a pre-submission hearing with the Planning Board is to advise the applicant ifa proposed application is acceptable to the Board. We received praise from the Board for the previously proposed 75/75 Conservation Subdivision plan on 10/30/06, which included the contiguous open space in the center of the property, and Lot 3 in the southerly portion. However, despite this fact, our client followed the advice of Planning Department staff and converted the plan to an 80/60 Conservation Subdivision, only now to be told that the new plan is unacceptable. We are enclosing for your review a copy of the proposed 80/60 Conservation Subdivision Plan, last revised on 11/19/07. As you can see, the proposed plan incorporates the recommendations of the Board members, including keeping the open area contiguous, as well as the most recent recommendations of the Planning Department staff to reduce the lot sizes and increase the preserved area. It should be understood that our client has always planned and intends to build a home and live on Lot 3. It has come as a great shock to him that after all of this time, effort and monies expended over the past two and one-half years, he is now being told that he cannot build a home where he has not only always planned and envisioned doing so but was encouraged to proceed with the plan by staff. We have been directed by our client to advise that should the Board not approve the 80/60 Conservation Subdivision with Lot 3 in the southerly portion of the property, we are to withdraw the conservation map and to apply for an eight (8) lot Standard Subdivision, as shown on the enclosed "Sketch Plan A for a Cluster Development", last revised on 10/21/05. The only change to that plan would be that the development area of Lot 8 would be moved further to the north, adjacent to Lot 7. ~ We also received correspondence from the Southold Land Preservation Department, dated December 10, 2007, advising that the Town is no longer interested in purchasing the open space created by this proposal. ~'own of Southold Plar~fing Board December 31, 2007 Page 4 Please include this letter and its enclosures in the record of this matter. In order to work within Right of Way of State Route 25, a NYSDOT Highway Work Permit will be required. In recent years, many states have employed access management as a major technique to address conflicts between through traffic and that generated by developments. The goals of access management are to limit the number of access points, separate conflict points and remove turning movements from through traffic. New York State is utilizing this technique to minimize impacts to State highways. We recommend, therefore, that the site driveway be designed as a shared access with the neighboring property(s). Also, cross access to this site should be obtained from adjacent properties. If this is not presently possible, it should be shown on the plans for implementation as part of future redevelopment. The submitted plans do not contain all of the information we normally require to commence our review. Additional items need to be included in the site plans for the work to be performed within State Road's Right Of Way. We are particularly interested in the site's internal drainage, since we do not permit runoff from private property onto our State highways. A Maintenance and Protection of Traffic (MPT) plan must also be provided for work on Route 25. The plans must also show the following items: a. All existing and proposed traffic signs (including size and text) b. All existing pavement markings, curbs, sidewalks c. All drainage structures, trees, underground / overhead utilities, traffic signal control devices d. Any other appurtenances along site's State highway frontage e. ROW lines, controlled access lines and property lines f. Distance from each existing and proposed site driveway to each adjacent and opposite driveway and cross street g. All existing features to remain or to be demolished, as well as proposed features must be clearly shown on the plans We have attached "SITE PLAN REQUIREMENTS CHECKLIST" for the required features to be included in the plans for your guidance. Please note that all work should be referenced to the latest NYSDOT item numbers and specifications. Please submit four (4) sets of revised plans showing the changes. Please note that any utility work proposed in State Highway right-of-way will require a separate application and submission of utility plans to our Maintenance facility at Riverhead. The utility plans shall include installation and restoration details in addition to Maintenance and Protection of Traffic plans - all referenced to NYSDOT specification item numbers and the Manual of Uniform Traffic Control Devices. The question of whether an action may be significant is not always easy to answer. Frequently, there are aspects of a project that ars subjective or unmeasurable, h is also understood that those who determine significance may have little or no formal knowledge of the environment or may not be technically expert in environmental analysis. In addition, many who have knowledge in one particular ares may not be aware of the broader concerns affecting the question of significance. The full EAF is intended to provide a method whereby applicants and agencies can be assured that the determination process has been orderly, comprehensive in nature, yet flexible enough t(~ allow introduction of information to fit a project or action. Full EAF Components: Tho full EAF is comprised of three parts: Part 1: Provides objective data and information about a given project end its site.
