MS4 COMPLIANCE COMMITTEE
Minutes of November 2, 20tl
Present: Trustee John Bredemeyer, Jennifer Andaloro, ATA, Jamie Richter, Engineering
Inspector, John Sepenoski, Technical Coordinator II, and Mark Terry, Principal Planner.
Approved minutes from October 5, 2011 meeting. The Committee will file its
minutes with the Town Clerk's Office.
II.
Draft MS4 Local Law - the additional changes were reviewed by the Committee
and the Committee will place the Local Law on the Town Board Agenda for
11/9/11 for a referral to the Code Committee. Additionally, once the law is
referred to Code Committee, it will be circulated to the Building Department,
Planning Department, Zoning Board of Appeals, and Board of Trustees.
III. Updates:
Potential Illicit Discharge reported by the CAC regarding the Moore
property. The Committee noted that the property is presently under
review by the ZBA and will undergo additional Trustee review. Jamie will
write a Memo to the ZBA pointing out that the property has a potential
illicit discharge and will make recommendations, including that the ZBA
should condition any variance on the submission of an SWPPP.
Illicit Discharge Detection Training - is continuing and additional training
may be required once the MS4 Local Law is adopted by the Town Board.
Certified Contractors - prior to the enactment of the MS4 Local Law
which requires certified contractors, the Town will implement a policy that
an applicant for a building permit cannot receive an approval until
documentation regarding a contractor's MS4 certification is supplied to
the Building Department. Jamie will draft a sign to post in the Building
Department and new attachments to building permit application.
Additionally, Jamie will meet with Mike Verity to discuss and verify the
process, as well as notifying contractors when certification training is
offered and where.

d. Grant Update (Mark Terry):
EFC Green Infrastructure Grant Program (GIGP3) application
status. The grant application has been submitted for $460,000 in
MS4/Green infrastructure projects including projects with
biofiltration, infiltration basins. However, the Mattituck Creek
project was not included in the grant because the Town does not
own the property.
ii.
Hashamomuck Sub-Watershed (C303426) - NYSDEC Funding -
This grant has already been awarded to the Town. The
Committee is hopeful that the projects in this grant will go out to
bid in early December. Jamie will prepare the RFP. The Town
will have to coordinate an on-site meeting with the DEC and DEC
is willing to extend funding.
iii.
Developing Priority Impaired Waterbody and Sub-watershed
Management Plans - SGA 22(Goose/-l'own/Jockey Creeks) and
SGA 26 (Richmond Creek) - the Town is ahead of schedule on
these grants.
Review of NYSDEC's modifications to the General Permit:
a. The DEC has extended the retrofit deadline to September 30, 2012.
b. Corrected typographical errors.
The DEC has noticed the addition of 4 waterbodies in Southold Town,
namely, Spring Pond, Wickham Creek, Mud Creek and East Creek.
d. The DEC has also added a pollutant of concern to Maratooka Lake.
Generally - the Town must assess waterbodies according to DEC models
and every assessment must be approved by the DEC. The Town
employees must become conversant in the DEC models. Additionally,
John Sepenoski will obtain approval for multiple employees (Jamie, Mark
and John) to attend meetings related to required modeling.
Next meeting - the next meeting should be scheduled for the week of November
28, 2011.
