PETITION NO. 2012-0060
Upon the application of Peter & Judith Klipp, filed pursuant to 19 NYCRR 1205 on February 06.
2012 and upon all other papers in this matter, the Department makes the following determination:
NATURE OF GRIEVANCE AND RELIEF SOUGHT
The petition pertains to an addition and alterations to an existing one-family dwelling, two stories in
height, Type VB construction, approximately 2,400 square feet in area, located at 10945 Sound Avenue,
Mattituck, Town of Southold, County of Suffolk, State of New York.
Relief is requested from:
t9 NYCRR Part 1220, Residential Code of New York State (2010), Section R305.1, which stipulates
that habitable rooms, hallways, corridors, bathrooms, toilet rooms, laundry rooms and basements shall
have a ceiling height of not less than 7 feet (2134 mm). The required height shall be measured from the
finish floor to the lowest projection from the ceiling. [The petitioner requests to relief to permit
habitable space within a vestibule to have a ceiling height of approximately 6 feet 9 inches above the
finished floor.]
FINDINGS OF FACT
1. A two car garage was added to the subject building. In doing so a vestibule was created from the
new garage into the existing dwelling.
The new garage floor slab was constructed approximately 2 feet below the finished floor of the
existing dwelling. To match the existing finished floor of the existing dwelling the vestibule was
constructed on a platform which reduced the ceiling height to approximately 6 feet 9 inches.
The vestibule is less than 100 square feet in area and is only used as a transition space from the
garage and the main house and some incidental storage.

4. Section AJ601.3 of the Residential Code of New York State permits habitable space in basements
to have a ceiling height of only 6 feet 8 inches.
5. The vestibule in question will not be occupied for any length of time.
6. The Petitioner proposes that the addition and alterations will be compliant with all other applicable
provisions of the Residential Code of New York State.
7.. The local code enforcement official has been consulted in this matter and does not object to the
granting of a routine variance under the provisions of 19 NYCRR 1205.
CONCLUSIONS OF LAW
Strict compliance with the provisions of the Uniform Fire Prevention and Building Code would be
unnecessary in light of the fact that the vestibule will not be occupied for any length of time and that the
Code allows for other created habitable spaces to have a lower ceiling height. The granting a variance
would not substantially adversely affect the Uniform Code's provisions for health, safety and security.
DETERMINATION
WHEREFORE IT IS DETERMINED that the application for a variance from 19 NYCRR Part 1220.1,
Section R305.1, to permit habitable space within a vestibule to have a ceiling height of approximately 6
feet 9 above the finished floor; be and hereby PROPOSED TO BE GRANTED with the following
conditions:
1. That the addition and alterations will be compliant with all other applicable provisions of the
Residential Code of New York State.
This DECISION is issued under 19 NYCRR 1205.6. Unless obiected to by the petitioner in writinq
received by the Department, the decision shall become FINAL after fifteen days of receipt of the
decision by the parties.
This decision is limited to the specific building and application before it, as contained within the
petition, and should not be interpreted to give implied approval of any general plans or specifications
presented in support of this application.

To reiterate on what we discussed, the position of the Building Department Head is to
correct all new construction when possible to meet the minimum NYS Code. We
request at this time you speak to the design professional / builder and create a conforming
space. Please submit new plans with layout and cross section of the area with the non-
conforming height before any work occurs.
After you submit the drawings to the Town and get Building Department Approval on the
plans for the changes. We may be able to recommend an application to NYS for the on
site variance as required.
