A. For new building or new use: 1. Final survey of property with accurate location of all buildings, pvoperty lines, streets, and unusual natural or
topographic features.
2. Final Approval from Health Dept. of water supply and sewerage~lisposal (S-9 form).
3. Approval of electrical installation from Board of Fire Underwriters.
Sworn statement from plumber certifying that the solder used in system contains less than 2/10 of 1% lead.
5. Commercial building, industrial building, multiple residences and similar buildings and installations, a certificate
of Code Compliance from architect or engineer responsible for the building.
6. Submit Pla. nning Board Approval of completed site plan requirements.

a. This application MUST be completely filled in by typewriter or in ink and submitted to the Building Inspector with 4
sets of plans, accurate plot plan to scale. Fee according to schedule.
b. Plot plan showing location of lot and of buildings on premises, relationship to adjoining premises or public streets or
areas, and waterways.
c. The work covered by this application may not be commenced before issum~ce of Building Permit.
d. Upon approval of this application, the Building Inspector will issue a Building Permit to the applicant· Such a permit
shall be kept on the premises available for inspection throughout the work·
e. No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector
issues a Certificate of Occupancy·
f. Every building permit shall expire if the work authorized has not commenced within 12 months after the date of
issuance or has not been completed within [ 8 months t'rom such date. If no zoning amendments or other regulations afli~cting the
property have been enacted in tbe interim, the Building Inspector may authorize, in writing, the extension of the permit for an
addition six months. Thereafter, a new permit shall be required.

SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk
County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its
reply dated Nov. 16, 20tl, stating that this application is considered a matter for local determination as there
appears to be no significant county-wide or inter-comnmnity impact.
LWRP: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt
list and is not subject to review under Chapter 268.
PROPERTY FACTS/DESCRIPTION: The Applicants' property is a t8,498 sq. ft. parcel in the R-40 Zone. The
northerly lot line measures 123.32 feet. The easterly lot line measures 150 feet along Madison Ave. The southerly
lot line measures 123.32 feet along West St. The westerly lot line measures 150 feet. The property is improved
with a single family dwelling, an in ground pool, and an accessory shed, as shown on the site survey drawn by John
C. Eh lets, Land Surveyor, last revised July, 18, 2011 to show the location of the "as built" nonconforming sections
of stockade fencing cited in the Bldg. Dept. Oct. 21,201 I Notice of Disapproval.
BASIS OF APPLICATION: Request for Variance from Article XXII Code Section 280-I05 and the Building
Inspector's October 21, 20t I Notice of Disapproval based on an application for an "as built" fence, at; 1) more
than the code required maximum height of four (4) feet when located in the front yard.
RELIEF REQUESTED: The Applicant proposes to construct an "as built" 6 foot high stockade fence in a front
yard area, when Code specifies that a fence located in a front yard shall not exceed four feet in height, therefore the
Applicant requests a variance for ti:ncc height that is two feet taller than that allowed by Code.
ADDITIONAL INFORMATION: The owners of the properly recently replaced sections of stockade fencing in
front yard areas similar in height and kind to the sections that had existed on this parcel for a number of years,
since before the current owners purchased the property in 2001. The property has two front yards along the well
travelled, and busy intersection of Madison Ave. and West St. The owners maintain that the purpose of the six
foot high fencing, in addition to providing for the fencing required to surround an in ground pool, is to provide a
degree of privacy not obtainable with a four foot high fence which is permitted by Code in front yard areas.

The Zoning Board of Appeals held a public hearing on this application on December 1,2011, at which time written
and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the properly,
an assessment of thc character of the neighborhood, and other evidence, the Zoning Board finds the following facts
to be true and relevant and makes the following findings:
1. Town Law §26%b(3)(b){l). Grant of the variance of will not produce an undesirable change in the character
of the neighborhood or a detriment to nearby properties. A similar stockade fence existed in front yard areas of this
property for numerous yearn with no objections from any neighbors. The approximately 48 feet length of six foot
high stockade fencing along West St. is setback about 70 feet from that front property line. The fencing, and the
approximately 80 feet of six foot high stockade fencing along Madison Ave. are located in the functional side yard
and rear yard areas of this property, in relation to the front entrance located on West St., and such fencing would be
considered legally permitted by Code where it was built, if the property had only one designated front yard.
2. Town Law ~267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible
for the applicant to pursue, other than an area variance. The Code permitted fence height of four feet in a front
yard area does not provide the same degree of privacy and screening for their swimming pool from within view of
a busy street, as is offered by a six foot high fence.
3. Town Law ~267-b(3)(b)t3). The variance granted herein is mathematically substantial. However, it's mitigated
by the fact that it replaced an identical fence of the same height that had been in place for many years.
4. Town Law §267-b{3)(b){4) No evidence has been submitted to suggest that a variance in this residential
community will have an adverse impact on the physical or environmental conditions in the neighborhood. No trees
were cut, and no grading of land was necessary when the replacement fencing was constructed.
5. Town Law §267-b(3)(b}(5). The difficulty has been self-created because, although similar fencing had existed
in its place for many years, the Applicants did purchase the parcel after the Zoning Code was in affect, and it is
presumed that the Applicants had actual or constructive knowledge of the limitations on the use of the parcel under
Zoning Code in effect, prior to, or at the time of purchase.
6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the
applicant to enjoy the benefit of the privacy for a swimming pool that is provided by a six-foot high stockade fence,
while preserving and protecting the character of the neighborhood and the health, safety and welfare of the
community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under
New York Town Law 267-B, motion was offered by Member Homing, seconded by Member Weisman
(Chairperson), and duly carried, to
GRANT, the variance as applied for, and shown on the site survey drawn by John C. Ehlers, Land Surveyor, last
revised July, 18, 201 lto show the location of the "as built" nonconforming sections of stockade fencing cited in the
Bldg. Dept. Oct. 21,2011 Notice of Disapproval.
Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a
possible denial by the Building Department ora building permit, and may require a new application and public hearing before
the Zoning Board of Appeals.
Any deviation from lhe variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or
survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action
does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the
Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action.

The Southold Town Board of Trustees reviewed the survey prepared by John C. Ehlers
Land Surveyor, last dated November 24, 2010, and received on January 5, 2011, and
determined that the construction of a proposed in-ground swimming pool, patio, and
drywell, is out of the Wetland jurisdiction under Chapter 275 of the Town Wetland Code
and Chapter 111 of the Town Code.
Therefore, in accordance with the current Wetlands Code (Chapter 275) and the
Coastal Erosion Hazard Area (Chapter 111 ) no permit is required. Please be advised,
however, that no construction, sedimentation, or disturbance of any kind may take place
seaward of the tidal and/or freshwater wetlands jurisdictional boundary or seaward of
the coastal erosion hazard area as indicated above, or within 100' landward from the
top of the bluff, without further authorization from the Southold Town Board of Trustees
pursuant to Chapter 275 and/or Chapter 111 of the Town Code. It is your responsibility
to ensure that all necessary precautions are taken to prevent any sedimentation or other
alteration or disturbance to the ground surface or vegetation within Tidal Wetlands
jurisdiction and Coastal Erosion Hazard Area, which may result from your project. Such
precautions may include maintaining adequate work area between the tidal wetland
jurisdictional boundary and the coastal erosion hazard area and your project or erecting

York State Department of Environmental Conservation (DEC), the DEC has determined that your
proposal to construct an in-ground swimming pool, patio, pool equipment, and drywell, as shown on the
survey plan prepared by John C. Ehlers last revised on 2/11/11, is more than 100 feet from New York
State regulated freshwater wetland SO-1. Therefore, no permit is required pursuant to the Freshwater
Wetlands Act (Article 24) and its implementing regulations (6 NYCRR Part 663).
Please be advised, however, that no construction, disturbance, clearing, or sedimentation of any kind
may take place within 100 feet of the regulated freshwater wetland boundary without a permit. It is your
responsibility to ensure that all necessary precautions are taken to prevent any sedimentation or other
alteration or disturbance to the ground surface or vegetation within Freshwater Wetlands jurisdiction
which may result from your project. Such precautions may include maintaining adequate work area
between the freshwater wetland jurisdictional boundary and your project (i.e. a 15' to 20' wide
construction area) or erecting a temporary fence, barrier, or hay bale berm.

02/15/12. The first survey denotes the "area of the detail" that appears on the second survey. The second
survey denotes a proposed plan to move several sections of the east to west length of 6' stockade fence at the
north end of our property off of Village of Greenport property and on to our property line. I have included a
"key" in order to clarify which sections offence would be moved and where the stockade fence would not be
moved due to the tree that straddles the property lines. In the event that Crreenport ever saw fit to remove the
sections of stockade fencing remaining on their property, leaving our property unprotected, we also plan to
install a 4' high chain link fence on our side of the tree (see the curved dotted line in front of tree, spanning two
stockade fence sections) in order to provide the necessary cominuous coverage. As you can understand, I
would like confirmation from the Town that this solution will result in the issuance of the coveted C of O for
the pool before I take any action on this plan.

I am again forwarding the attached surveys, dated 02/15/12, for your review, in hopes
that you can confirm that out ~ will remedy the DOB compliance issue with the
northern length of fence, running east to west, in connection with the above referenced DOB
Permit. Please disregard my previous fax and attachments (dated 3/05/12) in favor of this
~ that was made during an on-site visit by our fence contractor, Robert Canberg, of
Royal Fence, on Saturday, March 10.
As before, the first survey denotes the "area of the detail" that is reflected on the second
survey. The second survey denotes our proposed plan to move two (2) sections of the east to
west length of 6' stockade fence that are located west of the stockade gate firom Village of
Crreenport property back to within our property line. You may recall, the solution is complicated
by a mature Sycamore Maple tree that straddles the properties. As such, we are proposing to
leave the remainder of the stockade fence where it is and mn 4' hish chain-link fence around the
tree, as noted on the survey, extending west to the next stockade post that is on our property. A
4' wide walk gate, opening out with a key entry, will be installed at the western end of the chain-
link with bottom coil safety wire and posts installed with concrete footers, ail to pool code. This
solution will protect the yard should the Village, for any reason, decide to remove the stockade
fencing that remains on their property, leaving the 4' high chain-link on our side as a continuou~
boundary around the pool.
Again, I am sure that you can understand our reluctance to proceed with further changes,
and the associated costs ($1,395.), without some kind of assurance from the Town that this
solution is likely to result in the issuance of the C of O for the in-ground pool.
