Long Island Sound)Mattituck, NY SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated March 6, 2012 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated March 28, 2012. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our recommendation that the proposed action is EXEMPT from Coastal Consistency Review. PROPERTY FACTS/DESCRIPTION.- Subject parcel is improved with a one story single family dwelling with attached garage and decks. It contains 28,242 sq. ft. and has 102.03 feet of frontage on Sound Beach Drive. 281.88 feet along the eastern property line, 100.56 feet on Long Island Sound and 290.00 feet along the western property line as shown on the survey dated August 28, 2000 last revised February 13, 2012 by John T. Metzger, Licensed Land Surveyor. BASIS OF APPLICATION: Request for Variance from Article XXIII Section 280-124 and the Building Inspector's February 15, 2012 Notice of Disapproval based on an application for building permit to construct alterations and "as built" deck addition to existing single family dwelling: 1) less than the code required minimum side yard setback of 15 feet. RELIEF RE UE~: The applicant requests variances for an "as built" deck addition and alteration of the existing garage with a side yard setback of 10 feet, where the code requires a minimum side yard setback of 15 feet. ADDITIONAL INFORMATION: The applicant's agent indicated that when the Certificate of Occupancy was issued on 6/1/02 for the garage at 10' from the westerly side yard, the as built deck was in place. Additionally the garage alteration consists of dormer additions so that the current owner may use the space for storage. Page 2 of 3 -April 19, 2012 ZBA File#6554 - Kalogems CTM: 1000-99-1-I0.I F1NDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on April 5, 2012 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighbOrhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes tile following findings: 1. Town Law §267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The attached garage has been in existence since 2002. The "as built" deck meets the same set back as the garage. 2. Town Law §267-b(3)(b)(21. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance .Based upon testimony taken at the hearing the "as built" deck has been in existence with the same setback as the garage since 2002. Although, the Certificate of Occupancy was issued in error because the as built deck was not included, the applicants' relied on the action of the Building Inspector 3. Town Law §267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 33% relief from the code. However, both structures have been in place for more than ten years and the garage was issued a certificate of occupancy. Many of the homes in the area have the same or similar setbacks, 4. Town Law §267-b(3)(b)(41 No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. Applicant will retain all storm-water runoff on site. 5. Town Law §267-b(3)(b)(5). The difficulty has not been self-created. When the original garage was constructed the deck was noted on the final survey, however the certificate of occupancy did not note the deck. Additionally, when the original permit was issued it was overlooked that the stmctare should have been located 15 feet from the side property line as was required by code. 6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an expanded garage and a legally existing deck while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Goehringer, seconded by Member Homing, and duly carried, to GRANT, the variance/variances as applied for, and shown on the survey dated August 28, 2000 last revised February 13, 2012 by John T. Metzger, Licensed Land Surveyor. And the architectural plans dated 1-16-12 prepared by S.L. Maresca Associates and noted as Kalogeras Residence sheets S-1 & S-2. Condition: 1. The garage shall be used for storage only. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when )ssued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department ora building permit, and may require a new application and public hearing before the Zoning Board of Appeals. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action.
