NYSDEC~ NYSDOS, USACE February 1, 2012 APPLICANT: JOHN REARDON SCTM #: 1000-90-2-19 LWRP CONSISTENCY ASSESSMENT FORM Policy 1 Foster a pattern of development in the Town of Southold that enhances com- munity character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of development. [] YES ~NO [] NOT APPLICABLE The reconstruction of an existing bulkhead and an existing retaining wail is not inconsistent with the character of the waterfront community, and because of the relatively smail footprint of the existing structures and their existence on the down- slope of a shoreline bluff, it is felt that there is no adverse impact on the desired preservation of open space. Infrastructure use is not a factor since the project is ac- cessory to and accessed from private property. The maintenance of the erosion control purpose of the structures is certainly a beneficiai use of the coastai location, and there is no incrementai increase in development in the area since the structures aiready exist in the same forms as they will have after completion of the project. Policy 2 [] Yes Preserve historic resources of the Town of Southold. ~ro [] NOT APPLICABLE There is no evidence to indicate that the immediate area of the project includes his- toric features, and it is to be expected that the mainly intertidal nature of the project area is unlikely to have been the site of recoverable artifacts of past civilizations. Policy 3 Enhance visual quality and protect scenic resources throughout the Town of Southold. [] YES ~O [] NOT APPLICABLE The reconstruction will be done in such a manner that upon completion of the pro- ject the will be no apparent change in the project site. The existing structures, which will retain their present forms, are compatible with other existing shoreline structures in the area, and will not adversely affect dynamic landscape elements (tidal fluctuations, seasonal vegetation changes; seasonal/diurnal changes in ambi- ent light) which might contribute to ephemeral visual qualities. Policy 4 Minimize loss of life, structures, and natural resources from flooding and ero- sion. [] YES ~NO [] NOT APPLICABLE It is intuitively obvious that the likelihood of the proposed activities contributing to increased hazards which could result in the loss of life from flooding or erosion is probably non-existent. The proposed reconstruction will have a significant posi- tive effect on the protection of structures and natural resources from flooding and erosion in that the existing structures, which have provided those features, have been seriously storm-damaged and their reconstruction is required in order that these protective features continue in effect. Policy 5 Protect and improve water quality and supply in the Town of $outhold. [] YES ~O [] NOT APPLICABLE The project will not have any effect, either positive or negative, upon water quality and supply in the Town of Southold. Policy 6 [] YES Protect and restore the quality and function of the Town of Southoid's ecosys- tem. [] NOT APPLICABLE The project presumably will extend the useful life of the existing structures and hence delay the time when they must be replaced, and therefore delay the time at which either of those eventualities will generate some degree of impact upon the Town's ecosystem. In the meantime, the project of itself will have no direct effect upon the Town's ecosystem, however that may be defined. The project will have no adverse effect upon existing tidal patterns and there will be no degradation of water quality. All statutory and regulatory requirements, at all levels of government, will be strictly complied with. No dredging, excavating, or filling in wetlands is included in the project. Policy 7 Protect and improve air quality in the Town of Southold. [] YEs [] APPLICABLE Activities to accomplish the project will not result in significant mounts of new air pollution, nor will the existence of the reconstructed structures upon completion of the project.. Policy 8 Minimize environmental degradation in the Town of Southold from solid waste and hazardous substances and wastes. [] YES ~O [] NOT APPLICABLE The project as proposed will not result in the generation of any additional solid waste. The handling and storage of petroleum products, if any, will be accom- plished through the use of approved containers and facilities, and approved meth- ods of handling and storage will be followed. Policy 9 Provide for public access to, and recreational use of, coastal waters, public lands, and public resources of the Town of Southold. [] YES [] NO ~OT APPLICABLE This policy is not applicable to the proposed project. Policy 10 Protect Southold's water-dependent uses and promote siting of new water- dependent uses in suitable locations. [] YES [] NO ~NOT APPLICABLE Policy 11 This policy is not applicable to the proposed project. Promote sustainable use of living marine resources in Long Island Sound, the Peconic Estuary and Town waters. [] YES [] NO ~OT APPLICABLE Policy 12 [] YES This policy is not applicable to the proposed project. Protect agricultural lands in the Town of Southold. [] NO ~¢NOT APPLICABLE This policy is not applicable to the proposed project. Policy 13 Promote appropriate use and development of energy and mineral resources [] YES ~NO [] NOT APPLICABLE The planning and construction of the project is, and will be, such that energy effi- cient design criteria are applied throughout, based upon any local or State building codes, or upon practices generally recognized as desirable in this regard. As has been stated, any handling and storage of petroleum products will be accomplished through the use of containers, facilities and methods of handling and storage as approved for residential property use and generally accepted as safe. Site drainage and water control will be designed and accomplished in accordance with Town policies and requirements.
