Project Description: To install bluestone stepping stones within approx. 670 sf,

Findings: The project meets all the requirements for issuance of an
Administrative Permit set forth in Chapter 275 of the Southold Town Code. The
issuance of an Administrative Permit allows for the operations as indicated on the
site plan prepared by Marshall Paetzel Landscape Architecture, P.C. dated
March 19, 2012 and stamped approved on Apd118, 2012.
Inspections: Final inspection
If the proposed activities do not meet the requirements for issuance of an
Administrative Permit set forth in Chapter 275 of the Southold Town Code, a
Wetland Permit will be required.
This is not a determination from any other agency.

Dear Mr. Herrmann:
The Board of Trustees reviewed the site plan prepared by Marshall Paetzel Landscape
Architecture, PC dated March 19, 2012 and determined the proposed new section of driveway
and a 22'X 26' garage on the landward side of the existing dwelling to be out of the Wetland
jurisdiction under Chapter 275 of the Town Wetland Code and Chapter 111 of the Town Code.
Therefore, in accordance with the current Wetlands Code (Chapter 275) and the Coastal
Erosion Hazard Area (Chapter 111) no permit is required. Please be advised, however, that no
construction, sedimentation, or disturbance of any kind may take place seaward of the tidal
and/or freshwater wetlands jurisdictional boundary or seaward of the coastal erosion hazard
area as indicated above, or within 100' landward from the top of the bluff and/or wetlands
jurisdictional boundary, without further authorization from the Southold Town Board of Trustees
pursuant to Chapter 275 and/or Chapter 111 of the Town Code. It is your responsibility to
ensure that all necessary best management practices are taken to prevent any sedimentation or
other alteration or disturbance to the ground surface or vegetation within Tidal Wetlands
jurisdiction and Coastal Erosion Hazard Area, which may result from your project.
This determination is not a determination from any other agency.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my recommendation that the action is
CONSISTENT with the LWRP
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

Dear Mr. King:
We represent Joseph and Laura Mazza, who plan to construct a new section of driveway and a 22' x 26'
garage entirely on the landward side of the existing house and more than 100 feet from the face of the
bulkhead that separates the property from Great Peconic Bay tidal wetlands, all as depicted on the site
plan prepared by Marshall Paetzcl Landscape Architecture, PC, dated March 19, 2012. A copy of this
plan is enclosed along with a current land survey of the property, site photographs, and agent
authorization letter.
As all proposed work and related construction activities will therefore occur beyond the jurisdiction of the
Board of Trustees pursuant to §275-3(C)(5) of the Southold Town Code, would you kindly prepare a non-
jurisdiction letter for the project. Please note that we are simultaneously requesting under separate cover
a wetlands permit for activities depicted on the site plan that would occur less than 100 feet from
wetlands, including removal of a section of existing driveway and placement of bluestone stepping stones
and a bluestone walkway from the new driveway to the existing house.

Based on the information you have submitted the Department of Environmental Conservation (DEC)
has determined that the property landward of the pre-existing (prior to 8/20/77) bulkhead as shown on
the survey prepared by Joseph A. Ingegno last revised on February 18, 2004, is beyond Article 25
(Tidal Wetlands Act) jurisdiction.
Therefore, in accordance with the current Tidal Wetlands Regulations (6NYCRR Part 661) no permit is
required.
Be advised, however, that no construction, sedimentation, or disturbance of any kind may take place
seaward of the tidal wetlands jurisdictional boundary, as indicated above, without a permit. It is your
responsibility to ensure that all precautions are taken to prevent any sedimentation or other alteration
or disturbance to the ground sudace or vegetation within Tidal Wetlands jurisdiction which may result
from your project. Such precautions may include maintaining adequate work area between the tidal
wetland jurisdictional boundary and your project (i.e. a 15' to 20' wide construction area) or erecting a
temporary fence, barrier, or hale bay berm.
Please note that this letter does not relieve you of the responsibility of obtaining any necessary permits
or approvals from other agencies or local municipalities.

Dear Mr. Terry:
Attached please find a copy of an application being filed with the Board of Trustees for a Town
Wetlands Permit to remove a section of existing driveway and place a smaller area of bluestone
stepping stones in its place more than 50 feet from wetlands; and to place more than 50 feet from
wetlands less than 250 square feet of bluestone walkway leading from a proposed driveway to be
located more than 100 feet from wetlands.
The proposed actions located within 100 feet of wetlands and thus requiring a wetlands pemfit
pursuant to Chapter 275 should therefore meet the following definition of a minor action
pursuant to §286-3 ("Definitions") and thus be exempt from waterfront consistency review
pursuant to §268-5 ("Review of Actions"): "CC. Structures less than 250 square feet in size that
are accessory to existing permitted primary structures, and which accessory structures are greater
than 50 feet from a boundary ora natural protective feature and freshwater or tidal wetlands."
