(comer Carrington Rd.), Cutchogue, NY SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated April 17, 2012 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject parcel is two adjoining merged lots containing 46,045 square feet in the R-40 district. The parcel has a front yard running 196.79 feet along Nassau Point Road and a second front yard running 293.05 feet along Carrington Road, 302.80 feet along the southern property line and 113.91 feet along the western property line. The parcel is improved with a one story frame house and an accessory pool as shown on the survey prepared by John T. Metzger, L.S. dated January 12, 2012, lots 11 & 12. BASIS OF APPLICATION: Request for Variances from Article IV Code Section 280-18, based on an application for building permit and the Building Inspector's January 24, 2012 Notice of Disapproval concerning proposed additions and alterations to a single family dwelling, at; 1) less than the code required front yard setback of 50 feet to Carrington Road, 2) less than the code required front yard setback of 50 feet to Nassau Point Road. RELIEF REQUESTED: The applicant requests variances for: 1) a front yard setback of 45 feet from Nassau Point Road, requiring a 5 foot variance from the code required 50 foot setback and, 2) a front yard setback of 20 feet from Carrington Road, requiring a 30 foot variance from the code required 50 foot setback. ADDITIONAL INFORMATION: ZBA Appeal #256 granted the subject parcel (SCTM# lot 11) a reduced front yard setback from Carrington Road, then recognized as Carpenter Road. The "amount" or percentage of variance relief was not referred to in Appeal #256, it is simply granted as a reduced front yard setback on a comer lot. ZBA Appeal//256, at that time, recognized "Carpenter Road" as "not a public-road, as unpaved and appearing to be used only for ingress and egress to the garage of the house on the northwest comer of said road and Nassau Point Road". This Board agrees with that description to date as evidence for this appeal. Carrington Road is presently unimproved along the subject parcel and is closed to through access to Wunneweta Road via a chain link fence at Page 2 of 3 - May 17, 2012 ZBA File#6564 - Pizzolla the rear property lines. The subject parcel has no vehicular ingress/egress to Carrington Road at this time. A letter of support for granting the requested variances was received from the adjoining property owners to the north who use Carrington Road. FINDiNGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on May 3, 2012 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law §267-b(3){b){1). Grant of the requested variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The applicant proposes to construct a second story to the existing one story dwelling. Two story dwellings are characteristic of this neighborhood and there was no evidence presented to indicate that the proposed construction with the requested variances would cause a detriment to nearby properties. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The existing dwelling exists in its present nonconforming code location and any additions or alterations to the dwelling at these locations will require a variance. 3. Town Law §267-b(3)(b){3}. The variance granted herein for a 45 foot front yard setback from Nassau Point Road is not mathematically substantial, representing 10% relief from the code. The existing one story dwelling has existed with this 45 foot front yard setback without any evidence of detriment to the neighborhood. The variance granted herein for a 20 foot front yard setback from Carrington Road is mathematically substantial, representing 60% relief from the code. However, a similar requested setback was granted under Appeal #256 for a one story structure and the setback is to a property line that functions more as a side yard than a front yard. Additionally, the proposed second story addition will maintain the existing setback. 4. Town Law §267-b{3}(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. All storm water runoff will be retained on site. The second story addition is proposed over the existing first floor footprint. 5. Town Law §267-b(3)(b)(5). The difficulty has not been self-created insofar as the existing dwelling has existed in its present location with a granted front yard setback variance to Carrington Road and a conforming front yard setback to Nassau Point Road at its time of construction. The more restricting front yard setback requirements of the present town code has created the difficulty for this proposed addition and alteration to the existing dwelling. 6. Town Law §267-b. Grant of the requested reliefs is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of constructing additions and alterations to the subject single family dwelling while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Schneider, seconded by Member Goehringer, and duly carried, to GRANT., the variances as applied for, and shown on the Architectural Plans entitled Pizzolla House, Additions and Alterations, sheets A-l, A-2, A-3 and A-4 all dated 2/27/2012, prepared by Mark Schwartz, R.A., and the survey of the subject parcel (SCTM Lot#l 1) by John T. Metzger, L.S. dated 3/20/2012 also showing in the survey a minor addition ora 6x16 entry platform with an open porch above. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity.
