February 4, 1970 Richard Lark~ Esq. appeared before the Planning Board to request that a performance bond in the amount of $65~.000. be recommended to the SoutholdTown Board for the completion of roads and othe= improve- ments in the subdivision to be known as "Laurel CountrY_Estates~ ~nc." located at north side of Peconic Bay Blvd.~ Laurel~ New York2 The Board was presented with the two following s/~ed and executed contracts: Paul Corrazini & Sons - roads - $t7~350.; Riverhead Cement Block Co., Inc. - curbs~ drainage~ etc. - $36,230. These two combined give a figure of $53~580, plus a 20% administrative and increase cost of $10,716. the grand total being $64,296. On motion by Mr. Raynor~ seconded by~lr. Moisa,. it was RESOL~ that the Southold Town Planning Board recommend to the -$outhold Town Board a performance bond in the amount of $65~000. for the completi,n of roads and other improvements in the subdivision to be known as "Laurel CountrYEstates~ Inc."~ located off north Side of Peconic Bay Blvd., Laurel~ New York. Vote of the Board: Ayes:- Messrs: Wickham,~ M~isaa Raynor~Coyle. On motion by Mr. Wickham~ seconded by Mr, Raynor~. it was RESOLVED that the South~ld Town Plz~ning Board set the date for final hearing on proposed subdivision "Laurel Country Estates,, Inc." as the first meeting in March. Vote oft he Board: Ayes:- Messrs: Wickham~ Moisa, Raynor~ C~yle. In reference to "Wheatfield Park, proposed subdi%ision located at Grilling street~ Cutchogue~ New York, Mr. Larkinformedthe Board that the Board of Health has given their approval. The Chairman suggested recommending bond as per'Larry Tuthill~s estimate and setting it up forbearing. Mr, Lark requested 'that the Board post- pone any action at this time to enable him to secure contracts to present at the next meeting of the Planning Board to be held on February 25th', ~Mr, Lark said that he will either ~resent contaHcts for the work at the' next meeting or he will go along withLarry Tuthilll~s bond estimatein the amount of $67%000. On motion by'Mr. Wickham, seconded by Mr. M~isa~ it was RESOLVED that the Southold Town Planning Board set the date for the hearing on proposedsubdivision "Wheatfield Park" .as ~the fimst meeting in March. Vote of the Bo~rd~ Ayes:- Messrs: Wickham~ Moisa,: Raynora. In reference to "Bennett's Pond"~ recommendation of bond in the amount of '$15,000. to be presented to Town Board for their acceptance. Mr. Lark has not se=ured the Board of Health Approval. As soon ~as the bond is accepted bythe Town Board and Health Dept. Approval is r, eceived this subdivision will be set up for final ~hearing. Proposed subdivisions "MattituckHills" and"Mattituck Ridge" have not received approval from the Health-DePto, there seems to be a nitrate problem. On motion by Mr. Wickham~, seconded by Mr. Coyle~ it was RESOLVED that the Southold Town Planning Board grant final approval to the minor subdivision of'Casbor~ Inc.~ located at Middle Road ,(CR27)~and Westphalia Road~Mattituck~ N~yi~ subject to receiving fee of $50.00~ three ~3) copies of final map~ and Health Dept. approval. This motion shall include, authorization f0rthe Cha'~man to sign map when fee~ final maps, and Health Dept. Approval are received. ~ote of the, Board: Ayes:- Messrs: Wickhmm~ Moisa~ Raynor~, Coyle. In regard to minor subdivision of JennyLestera located at N/SWestphaliaRoad~ Mattituck~ N~Y~'~ final approvaI has been previouslygranted subject to receiving fee of $30.~ final maps~ and HealthDe~t~ approval. The recent death ofthe appli=ant hms delayed action on this. 'It must now be legally~processed through the administrator Of the estate. On motion by Mr. Wickham~ seconded by Mr. Coyle.~ it was RESOLVED that this meet'ingbe recessed, to be continued across the street at the Presbyterian' Church~ immediately thereafter. Southold Town Planng~,~ BOard -4- '- February 4, 1970 THE CHAIRMAN: I hereby reconvene this February 4th meeting of the Planning Board, I would 1/ke to welcome everyone present. I would also 1/ke to make it clear that this is a Planning Board meetingm~ onlya it is not a public hearing. All of our Planning Board meetings are open to the public, We wish every time we had a consideration of a change of zone or a subdivision application we. could have a turn out like this, we all could learn something, The Chairman introduced the members of the Planning'Board. THE CHA~: The Planning Board is a part t/me job. We ordinarily meet once a month~, sometimes twice. Additional meetings are held for Town matters which concern us, Tonight we have a consideration of a change of zone. The applicant has petitioned the Town Board and the Town Board has referred it to the Planning Board to ascertain the conditions and facts and make a recommendation. Our job is to ascertain the facts and conditions.. Before we get through the Planning B~ard will reach a decision whether to recommend it' to the Town Board or' not to recommend it to the Town Boarde~ or to, recommend some parts and not others. As I have said before this is not a hearing, The usual procedure for a hearing is to take the opposition first. First I will read the petition for this '~hange. of zone~ then we will hear anyone wishing to speak in favor~' and then the opposition. I will ask you to be factual. We are interested in facts onlYe, not numbers. Basically if one person says something and no one ob3ects~. I will assume- that everyone agrees. Your petitions and opposition should be directed to 'the Town Board. We only make a recommendation to-them and then they hold the hearing, We have no 3urisdiction. Our responsibility is tm ascertain the. conditions and facts of the application. We are going to put pads and pencils at the entrance~ upon leaving we would like everyone to sign their n~/aes. The Chairman read letter of referral addressed to the Planning Board from the Town Board~ application for Change of zone~ and reason for' request. RICHARD~.CRON~, ESQ.~: Chairman~ members of the PlanningBo~: and interested citizens of the Tow~ ofSouthold~ I appear on behalf of my client George Semerjian, I think it~ impor, tant before we getinto the merits of this applicati,n~ to go ~h~6 the concept ofwhat is' being set forth here. I think it is urgent and important for'the Town Boar~. the Planning B0ard~ and all the p=ople of the Town of Southold to determine if ~he Southold Town Board -5- '~ February 4, 1970 the concept'we have here is in harmony'with the Town of~Southold, The TOwn of' Southo'ld does not care to have any obnoxious industry. We try to have- tourist trade~ it is our 1 belief that~ what we are presenting is not contrary to this. We believe it is in accord w~th the' Town's policy. I have heard and I know it must be ~rue that there a lot of~ wild rumors going around. I am convinced that the application which has been made is done so in good faith' I as a person, believe it will be done, If what we propose is not in accord with the Town of~Southold we should cease it right~ now. If anyone feels that this is not in the best interest" of the' Town~ if there is anyone-who t~inks that-we should not go any further with this application~ tell me now and I will stop right here? THE CHAIRMAN: The development of our water front is very important. Our' Master Plan study 'proved that most of our~ summer residents are here-because of the rural nature and the-waterfront. We seam to be s.a~isfied to have tourists as our industry. The Planning Borrd is interested in hearing the- facts Of this application. Our 3ob is to ascertain the conditions' and facts& I would like to say again that this is not a public haaringl RICHARD CRON~z ES~: If I may. continue~ I think it is important that-we, look at the entire S~tuation. Looking at the zone~,use comprising the entire 132 acre parcel as it is presently zoned.~ we have 27 acres zoned" "C" ~which was formerly used for a sand pit operation) 9~ acres zoned "'B"~ 10 acres zoned' "M, and the balance of~ the property 85~ acres zoned "A", so there are now 4. different-zone uses~ The most distasteful to you would be the~ "C" zone. We propose to re-zone it as follows: 36 .acres' "M"~, 32 acres~ "B",~ 64 acres ~"A!~ o of the 36 acres of "M" approximately l0 acres are already zoned~' ,M". We think-that we are making this particular~parcel a lot better than it now existS. We are taking away the."C" z~ne~and making it"A" There is a greater degree of control over "B" &' "~" z~nss than could be imposed on the present' "C" zone. Question: Where are the jetties going to be? Mr. Cron explained the lay-out of'the operation on his draw ing. ~Ro' CRON: as they say. is right now' It-is my belief:that the applicants Will do-exactly The Town of:Southold is not going to stay the way it Nobody is going to stop the influx of people into · .. ... Southold Town Plann.~? Board --6- February 4,. 1970 this Town~ Our great~st'tax base is summer residents. Inflation is here tO, staY. Residential property cannot support the Town in the future. Our neighboring communities are welcoming industry of all types into their area. I think there is going to be~a school tax problem in the future. We have to have something to give the Town a wider tax base. This proposal should not be down-graded just because you don~t like the person ~ing the application, To prove that Mr. semerj ian is a human being and not a monster~ I ,would like to introduce him t, you. Mr. George iemerj lan presented himself very briefly before the audience, THE CHAIRMAN: The Planning Board feels that we don~t need commerical industry. The fishing stations bring out quite a lot of people, our industryis the tourist trade. What did you refer to when you said that the reaidential!tax base cannot-support-us? RR~ CRON: Many people are-moving into this area~ the ToWn of S~uthold is growing in population. The school tax is gofu~gto be very large. We must have something to equalize this. This project will help even it out. The Chairman stated that,about 2/3 of the land in' Riverhead Town is zoned for industrial use. He predicted that Riverhead Town will becomean industrial center~ andS0uthold Town and other neighboring towns Will be bedrooms for' Riverhead T~Wn. They will collect ~ll the industrial taxes and theneighboring t~wns will be heavily taxed for residential. The Chairman agreed.that something should be added to ou~ %axbase~ something that will not. be!obnoxious to.the Town. He stated that the above condition now exists in the n~ghbo~ing towns of.Hartford,.~ Connecticute which is' an industrial town. Wm. Schriever~ Orient~: I buy the concept i~f it. I think we have to do something like this~ I agree with the pe~ition~ we need the tax base, Ithink it is a~ good location. The, golf course~ the restaruants, the shopsa etc. Will be desirable. The only thing that bothers meis themarina. We have 2 examples of the undesirability of marinas in the Town~ at' Plum Islan~nd Mattituck. To' build a marina in ~the sound would be costlY and very hard to keepopen. ~uestion: HOW many units would this motel-complex contain? CRON: 6 unitsa 100 apartments in each. The Chairman questionedMr. Terry~ the Building Inspector~ if this density would be all.wed under the Zoning Ordinance. Mr. Terry stated that this number of units would be allowed in transient occupancy only. .. $outhold Town Pla~'~ug Board -7- February 4~. 1970 Question: How long will it take to complete the construction? Mr. Cron said that this question could not be a~swered at this time. THE CHAIRMAn: I will now open this meeting to anyone wishing to speak in opposition. James, Vaughn~ Attorney appeared before~the Board on behalf of East Marion property owners,~ who live near or have property in the vicinity of the subject property. The petitioners believe that this proposal is not in the publiC interest. There is no time table fordevelo~ment~ the map isnot complete~ nothing is backed up by engineers reports. It will be an over burdening or,the East Marion water' supply. It will cause salt water intrusion into the fresh water supply.. It will cause, erosion to the ea~.t ofthe~3etties and a general ~hange in the ecology ofthe area. Mr. Vaughn read letter of opposition to the proposal from Dr. Robt. Cushman Murphy of the Museum of Natural History. Julius Schubert'P.E%' plans to represent some of the Southold Town residen-ts. Hestated that he would testi~y on theeffect of jetties extending into the Sound as soon as the~applicant comes forward with engineers plans. John Fl!rnn~ Engineer for the~ Health Dept, stated that the Health~ Dept. is concerned with water useful'waste disposal~and the effects of water' use on the water supply~'of an area. He discussed'the ~effects such an operation wouldlhaTe ~n sewerage disposal and water' supply. The most detrimental would belthe effect on the water supply. Mr. Flynn~read a section o~t of the Ma~lcolm & Pirnie/Water'Repor~explaining~'the effect~edging wolld haveon the water supply., He explained the dama~the Jamesport operation has dOne to the watersmpply. Helwarned that a~y change-in~e amount of ~e'charge and sto~age of.water can be critical to the area. James Monsell. Village ~f Greenport. The Village of Greenport operates a water utilityLand an electrical supply~ which serves over 1/3 of the population of the Town of Southold. He stressed the f~ct that' the water supply on the Town of Southold is critical. Previous dredging in the Gull Pond area had raised the chloride content of the water. If the proposed d~ed~ing in the application were carried out~. it would cause salt water intrusion. Mrs. Mary Brady~ Mattituck - owns property on the sound bluff not too far east of-Levon Properties operation in Jamesport~ Mrs. Brady referred to the application made by Mr.- ~emerj ian to the Riverhead Town Board in which he stated that the project would not be offending to adjacent property ownersl She cited the problems they are having in regard to erosion and pollution, caused by' Levon Prop. After numerous personal attacks on the applicant ~(of which the Chairman forewarned her) the Chairman asked Mrs, Brady to sit downe The Chairman read letter of opposition from Jos. Boken~ Sr. the adjoining property owner to the south & east of the proposed operation. Said letter was placed on file. The Chairman informed the people that any pe~¥~it to dredge inland would have to be obtained from the Planning Board and a mining permit fromI the Town Board. Dominic Aurichio~ Attorney a/c George & LrvingNewman~ Petty~s Bite~ Orient~ Mr. Aurichio cited his clients opposition to this propOsed change of zone. The Newmans own about 20 acres of Rand in Orient with about 900 feet ofwaterfront on the sound. The League of Women V~ters presented a list of 7 questions which theyfelt should be answered before any consideration should bemade-onthiS Change of zone. Said list was placed on file~ to be answered later byPlanning Board or TownBoard at the public hearing. Wm. Schriever spoke in opposition to the marina again. He suggested that it be eliminated from the, application. Edward Kajeski~ spokesman for the Southold Town Baymens Assoc. spoke in opposition'to the petition. Letter received from the Assoc. stating their~objecti~ns is On file. Bob Rothman~and others questioned the appliCant~sintent and schedule for development. On motion by Mr. Wickham~, Seconded By' Mr. Moisa~, it was RESOLVED that the Southold Town Planning Board table recommendation on this proposed'change of zone for further deliberation of the'Boar~ Vote of the Board: Ayes:- Messrs. Larry Tuthill P~-E.' presented the Board with a bond estimate in the amount of $116~000.00 for the comple~ion of roads and other improvements in the subdivision to be known as "'Leeward Acres". On motion by Mr. Coyle~ seconded by Mr. Raynor~ it was RESOLVED that the-Southold TOWn Planning Board .recommend to the' Seuthold Town' Board a performance bond.'in the amount of' $116~000.00 as prepared by Lawrence Tuthill~ Csnstruction Engineer~ fort he completion-of roads and other improvements in the subdivision to beknown as "Leeward Acres" located at BaY~iew~ Sout/%old~ New York.
