WARREN E. HUFE, JR.) Variance to the Zoning Ordinance, Article
VIII, Section 100-82, for approval of an addition, for storage

WHEREAS, a public hearing was held on March 5,
those who desired to be heard were heard and their
recorded; and

WHEREAS, the Board has carefully considered all testimony and
documentation submitted concerning this application; and
WHEREAS, Board Members have personally viewed and are
familiar with the premises in question, its present zoning, and
the surrounding areas; and
WHEREAS, the Board made the following findings of fact:
1. By this application, appellant is requesting approval of
storage addition at the westerly side of the existing building.
The addition is 14'8" and 4" overhang, all to be set back 11.5 (or
12 feet) from the westerly (side) property line. Although the
setback requested in the application is 12 feet, the setback
according to the survey prepared February 5, 1992 indicates that
the building is presently set back 26.0 feet from the westerly
side property line at its closest point, thus a reduction in this
setback by 14'8 feet and a 4" overhang will leave a setback at
approximately 11.2 feet.
2. The premises in question is nonconforming as exists with
a total lot area and width containing a total area of 13,718.85
feet (.3149 ac.). The building as exists is nonconforming in the
northerly rear yard (on this corner lot) and the front yard
setback from County Road 48 is shown to be 18.4 feet at its
closest point.

3. The premises is located in the Limited Business (LB) Zone
District and the existing principal building with addition has
received a Certificate of Occupancy under No. Z6919 dated March 4,
1976. (It is noted, however, that the metal truck trailer shown
on the February 5, 1992 survey prepared by Joseph A. Ingegno is
pending reviews by the Building Inspector at this time and is not
part of the variance request at this time -- requiring a separate
application.)
4. This addition is to be used for garage and storage
purposes which are accessory and incidental only to the principal
use of the premises.
5. It is the position of the Board in consideration this
application that:
(a) the circumstances are uniquely related to the land
and buildings and are not personal in nature;
(b) the relief is substantial in relation to the
requirement, being a variance of approximately 40% {from a 20 ft.
setback to 11.2+- feet};
(c) the relief as granted will not be an increase in use
density since it will be used for accessory storage purposes;
(d) the relief requested is not unreasonable due
uniqueness of the property - being a corner lot and of a
substandard size;
to the
(e) there is no alternative for appellants to pursue
other than a variance;
(f) the variance will not in turn be adverse to the
safety, health, welfare, comfort, convenience, or order of the
town, be adverse to neighboring properties, or alter the essential
character of the neighborhood.
Accordingly, on motion by Mr. Grigonis, seconded by
Mr. Goehringer, it was
RESOLVED, to GRANT reduction in the westerly side yard
setback for the proposed addition for storage purposes, as applied
under Appl. No. 4076 in the Matter of the Application of FUTURE
SCREW MACHINE PRODUCTS, INC. (HUFE).
Vote of the Board: Ayes: Messrs. Grigonis, Doyen, Dinizio,
Villa and Goehringer. This resolution was duly adopted.

During 1992 the owners of, the above premises appeared before the
Board of. Appeals,for setback area variances for a storage addition at
the westerly-side and for an addition at the northerly yard with the
understanding that the trailer would, be removed immediatoly once the
construction was finalized. The trailer has not been removed and
since it was placed at the premises without permits or approvals,for
site plan or otherwise, we ask that you please notify the property
owners immediately-to remove,the trailer.

The Chairman opened the hearing and read the notice of hearing
and application for the record. Hearing opened at 8:27 p.m.
CHAIRMAIN GOEHRINGER: I have a survey by Joseph A. Ingegno
indicating this corner lot of Kenny's Road and North Road, It has
a lot area of 13,718.85 sq.ft, or .3149 acres and is improved by
a one or two story frame concrete building, which is used as a
machine shop. And I have a copy of the Suffolk County Tax Map
indicating this and surrounding properties in the area. Is there
somebody who would like to be heard. Mr. Moore?
MR. MOORE: Thank you Mr. Chairman, William Moore of Moore & Moore
315 Westphalia Road, Mattituck, NY. I will begin by giving you a
few photographs. I'm sure you have seen it, its visible from
48, so if you haven't stop to take an inspection, I know Mr. Villa
was there, you can see, I have a few photographs to show this which
was stopped by a stop work order late fall, I think the e~d of
November. This was a, I hate~to e~en ~alI it a-structure, Mr.
Hufe thought that he could simply cover a small area to protect
one of his bar feeds. The machine shop takes stock, which is in
bar form, feeds it into a machine which then creates these small
specialized parts that is produced at the facility. The Building
Department gave him a Stop Work Order and advised him that if in
fact it was going to be a structure and he needed a building permit
and that proposed requires a side yard setback. So here we are.
What we are doing with this addition is simply replacing what had
been stockade fence in technically the same place which screened
those bar feeds with now an addition, I was calling it a lean-to
shed or what have you. It is not going to be occupied for storage
only, to technically weatherize those bar feeders. The problem
is that the new machines that are going to take the place of these
old ones are a little more high tech. They are hydraulic in nature
and they can't be exposed to the weather. Mr. Hufe simply wanted
to put up basically a canvas screen and a fiberglass lid over the
top, as simple as possible, to protect these things. Once we
discovered the Building Department viewed it as a structure, he went
down that road, I think he realized that it made sense to make it
a little bit more substantial than a simple canvas and fiberglass
top. It will still be the most basic type of construction that
the Building Department will permit to provide the weatherization.
CHAIRMAN GOEHRINGER: Will the sides be enclosed though.
MR. MOORE: Yes. The Planning Board is asking what is going to be
enclosed. But I assume it is some kind of sheeting with a finished
end that will make it look compatible with what the rest of the
buildin is. Yes it is going to be enclosed. I think we provided
some rudimentary builders drawings to show how basic this shed is
going to be and you had a couple of questions which we have provided

MR. MOORE (Con't.): the answers to, which was the height of this
thnig at 14feet 8 inches. It is going to come as close as 12 feet
to the side yard. There is an existing driveway, which is going
to remain there. As you are aware the side yard requirement for
this zone is 20 feet, so were are seeking a variance down to 12
which is , we will be providing 60% of the requirement or a reduction
by 40%, if my math is right. Mrs. Surozenski is in the audience
I don't want to impose upon her to speak, not to tell her she has to
speak. She is the adjourning property owner she's been advised
that if you feel that she has no objection, in fact she supports
this application. So she would be the one most impacted by this
addition and she is in support of their request tonight. As you
are well aware when you are considering al side yard variance
there are a few criteria that you have to consider the first being
how substantial is the variance requested in either requirement.
We are seeking 40% reduction in that. Second~, ~. by granting
the variance we are somehow impacting or increasing the population
density in the town. This application will not provide any such
population density increase. No more employees are going to be
employed there. No less employees are going to be employed there.
This is simply an enclosure of existing or new equipment. Third
criteria, substantial change in the character of the neighborhood
or substantial detriment would take place and with the neighbor
here who would be most impacted consenting to and approving or
endorsing this application. I think that I have satisfied that
consideration in particular since we are simply replacing stockade
fence with the addition, stockade fence that has been there for
years, I think back to 1974. Finally, you have to consider whether
or not there are means other than a variance by which they could
accomplish this enclosure. They are simply working within the
existing layout of the building. I asked them if there was any
way they could possibly swing the equipment around and stick out
the east side of the building, but for windows and doors and
deliveries and things like that, it doesn't work. We are stuck
with this size of building where we are and its present proximaty
to the neighbor. Finally, you have to consider the interest of
justice being will be served by granting the variance. The
euqipment is designed to replace outdated equipment, its designed
to retain their competiveness, it is not intended to make them
more profitable, but simply to maintain a level of competition in
industry that is getting higher and higher in the level of technology.
I would suggest that there is no adverse impact on health, safety,
or welfare. The existing driveway will remain there. Emergency
vehicles can still maintain access with 12 feet of the side yard
the 11 (eleven) feet plus at the rear yard will remain. So there
is no real change in that regard. I have nothing further. Mr. Hufe
is here if you have any particular questions for him.
CHAIRMAN GOEHRINGER: Well , we had toured Mr. Hufe's building
several years ago and I noticed the placement of the machines
prohibited the actual bringing the stock in and that was the purpose
of these terrets, if that is what you want to call them whatever
you want to call them. Is this stock then placed in these things
from the outside and brought around the back of the building and
then slid in from the outside and then you feed them in as you need

CHAIRMAN GOEHRINGER (con't.): them. Is that correct?
Mr. Hufe: No, they are fed in from the inside.
CHAIRMAN GOEHRINGER: No they are fed in from the inside. Okay
because that was the question I had had of Mr. Moore was there
going to be doors placed on this so that the doors w~uld then inhibit
the driveway area, so there will probably be only one door placed
in this.
MR. MOORE: You put a door on the north side, were you going to
put a door on the south side for those...
MR. HUFE: I was also going to use the area for storage for scrap,
for recycleable scrap. And I think we need more than just a doorway
too.
CHAIRMAN GOEHRINGER: Okay, but they are not going to be swinging
doors, that would be swin~ingout toward..
MR. HUFE: No. I prefer sliding doors. If you have any further questions
CHAIRMAN GOEHRINGER Alright, I don;t have any questions. This
is certainly not a temporary structure anymore. This is a permanent
structure that will be added to the main structure and that is
what the basic, the reason for the disapproval, the reason why you
are here and the issue.
MR.Moore: Exactly. I couldn't see just putting canvas up when,
that would not be recognized as a temporary structure, you may as
well put something that will work, not blow away in the first darn
good wind.
CHAIRMAN GOEHRINGER: Great. Thank you.
MR.MOORE: I would like to make just one last point and that is we
are working under both a tough economic times, as everyone knows
about, so we have not made a simultaneous application to the Planning
Board. We have met with staff members of the Board and discussed
with them. I understand the Planning Board has made their comments
and their recommendation regarding this application to you. If the
Board does see fit to grant the application, we will as quickly as
possible be seeking the site plan approval from the Planning Board
so that, if it is possible at all, if you are inclined to grant
the variance, that you might do so as quickly as you could. We
would appreciate it

MEMBER VILLA: The only thing that I would want to say for the
record is that speaking to Mr. Hufe, the State DEC and the Health
Department are requiring that the scrap stuff be stored in a
permanent type of structure.
CHAIRMAN GOEHRINGER: Enclosed structure.
MEMBER VILLA: Enclosed structure and they would require. They
have requirements on concrete pads and berms and everything else,
so you can't leave something like that open to the atmosphere.
So it's got to be a substantial kind of structure
CHAIRMAN GOEHRINGER: Thank you Bob. Any other questions, anybody
in the audience like to say anything? Hearing no further questions,

Dear Members of the Board:
In response to your letter of January 6, 1992, I am enclosing the following:
1. Six prints of the existfn~ survCy~rdaowing the existing parking area, the
1974 additions to the structure, and the proposed new construction.
(A new survey has been ordered and we should have copies available
to you on February llth).
A letter from our clients specifying the exact distance from the
property line to the proposed addition at the closest point. (The
builder's drawings of the proposed structure were submitted
previously.)
The construction diagrams requested in your letter were previously
submitted. The north view shows the access door to the proposed
structure. There will be no windows. The height of the proposed
structure where the new roof will meet the existing roof line is 10 feet
8 inches. As the north side view construction diagram illustrates, the
height of the building slopes down to 8 feet in height.
A copy of the CO for the 1974 additions to the front and rear of the
premises.
We are submitting an application to the Building Department for a Certificate of
Occupancy for the structure prior to the 1974 additiom. The primary structure was
constructed prior to the enactment of zoning in Southold.
I trust that with the submission of this information, you will be able to schedule this
hearing for the evening of March 5, 1992. Please advise ff there is any additional
information you require. Thank you for your attention to this matter.

In response to your letter of January 6, 1992, I am enclosing the following:

1. Six prints of the eramng survey/~howmg the existing parking area, the
1974 additions to the structure, and the proposed new construction.
(A new survey has been ordered and we should have copies available
to you on February llth).
A letter from our clients specifying the exact distance from the
property line to the proposed addition at the closest point. (The
builder's drawings of the proposed structure were submitted
previously.)
The construction diagrams requested in your letter were previously
submitted. The north view shows the access door to the proposed
structure. There will be no windows. The height of the proposed
structure where the new roof will meet the existing roof line is 10 feet
8 inches. As the north side view construction diagram illustrates, the
height of the building slopes down to 8 feet in height·
A copy of the CO for the 1974 additions to the front and rear of the
premiseS.
We are submitting an application to the Building Department for a Certificate of
Occupancy for the structure prior to the 1974 additions. The primary structure was
constructed prior to the enactment of zoning in Southold.
I trust that with the submission of this information, you will be able to schedule this
hearing for the evening of March 5, 1992. Please advise if there is any additional

This Notice is issued pursuant to Part 617 of the
implementing regulations pertaining to Article 8 of the N.Y.S.
Environmental Quality Review Act of the Environmental
Conservation Law and Local Law #44-4 of the Town of Southoldo
An Environmental Assessment (Short) Form has been
submitted; however, Section 617.13 of 6 NYCRR Part 616, and
Section 8-0113 of the Environmental Conservation Law, this
variance application falls under the Type II classification as
established by law. Further, this Department may not be an
involved agency under SEQRA {Section 617.13(a) as amended
February 14, 1990}.
Although this action is classified as Type II for this
variance application under SEQRA {specifically 617.13, 616.3(j),
and 617.2(jj)}, this determination shall have no affect upon any
other agency's interest or SEQRA determination as an involved
agency.

1. STRICT APPLICATION OF TH~,~ANCE would produce practical difficulties or unneces-
sa~ HARDSHIP because appellant_~~,/--,~ .... ~ to replace an existing fence with
an attached shed/lean-~ Yor storage and protection of machine shop tools
used to feed materials into the building. Existing machinery is due to
be replaced and the new machinery requires greater protection from the
weather than the present fence affords. There is no mean~ other than by
the granting of a variance that will enable the appellant to use the
property as a machine shop with the new machinery. The requested variance
is not substantial and will have no adverse impacts or effects in the
surrounding neighborhood or the use district.
2. The hardshipcreotedis UNIQUE andisnotshored by all propedies alike in the immediate
vicinity of this property and in this use district because the machine shop which is
relatively small in size has unique requirements for its operation
which include feeding of materials into the machine shop tools. These
materibls are fed through the side of the building and the materials
must be protected from the weather for the machine to work properly.
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because the property has a fence already in the
locatioR~of the proposed structure. The fence would be replaced by an
attached shed structure to enable the operation of the machine shop to
continue. The proposed shed will have no more of an impact on the
character of the district or surrounding properties than the existing
fence which it will replace. The fence has been 10 feet from the
property line. The proposed shed would be placed approximately 10'8"
from the property line. The proposed variance would create no 'additional
traffic, noise or other adverse impact in the district. In fact, such
impacts, if any, would be reduced by enclosure of the ar~a as proposed.

By this application, the Hufes seek approval for construction of a shed type structure
attached to the main building of the machine shop. The structure will not be heated nor
served by other utilities. It is designed to provide protection of the machine shop
equipment from the weather and to provide a covered storage area. This structure is to
replace an existing stockade fence in approximately the same footprint.
Please advise if there is any additional information needed. To expedite matters, we
have at this time requested a pre-submission conference with the planning board to obtain
their input regarding the proposed structure.
We hope that this application can be heard at the board's January meeting as the
Hufes must make some business decisions regarding equipment purchases which are
predicated on the determination of this application.
