A regular meeting of th~' Southold Town Planning Board
was held at 7:30 P.M., Tuesday, July 18, 1967, at,the Town
Office, Main Road, Southold, new York~
There were present: Messrs: Henry Moisa, Acting Chairman,
William Unkelbach, Alfred Grebe, Frank~Coyle, ~h~ Wickham,
appeared at .the meeting later in the evening.
Also present: Messrs: Otto Van Tuyl, P.E., Consultant;
Howard Terry, Building Inspector.
PUBLIC HEARING: Upon question of approval of the following
plat: Plat of property owned by Henry J. & Stella M.-Smith,
entitled Peconic Homes, Section II, consisting of a parcel of
land 9.~8 acres, situated at Peconic, in the Town of~$o~thold,
Suffolk' County, New-York, and bounded anddescribes as follows:
BEGINNING at a point on the wes~erty line of a proposed
high way to be known as "Henry's Lane"~ 1'585.24 feet'northerly
along said westerly line from~Middle Road, said point of beginning
being the northeasterly corner of lot 12, as shown on'"map of
Peconic Homes", filed in ~he' Suffolk~County"Clerk's Office as

The Chairman opened ~the hearing~by reading the legal notice
of hearing, and the affidavit'attesting to its publication~in the
official newspaper of the Town.

in opposition to bis application for'a subdivision?
NELSON AXIR~: I live in Peconic. I~havew~th condition
a right of ,Way:that is'going to be closed off by lot-18 in ~the
new subdivision. This'will show. the right'of way aswe~have it.
There is .about 15 feet whichis needed to, get Contactwith
this pubiic:highwlay'through this'right of way. ~r.~Axien
read from~his deed giving access to his property~)~ F~c,.Krupski
suggested a pretty easyway'out here, that is to~hav~ Henry
to get a ~quit .Claim deed over a piece of property~that-would
incorporate the. right of way in this piece, to be .entered into
t~is particular'property thatWe would touch ~ith the
highWay'and that is all'we would Want..
-MR. UI~EELBACH: Would you abandone this part of the right
of way?
~R,~ ~JfwRN: Yes. A quit claim deed would be ~the best
solution. Ialso. saw Mr. Edson and I explaLin th~is'to~im
and he seemed to nod his head'in consent. This ~ould actually
shut us off.
MR~'VA~'TUYL: If he was to acquire a right of way over this
and abandone this~ it would'be a .fair solution.

MR. AXINE: No it-does not. This is part-of what used to
be Stepnoski~s ~roperty. This is an old deed. Once'you
touch a public highway that it' tha~. '~he lawyers understand
that 'perfectly.
MRS' UNKELBACH~ Ithink ~that-right of .way will have to
be abandoned by description.
MR. VAN'TUYL: If'on this property,. Mr j- Axien had' a right-of
way I"can't see Where anything needs to be done on the map.
MR. UR-K~LBACH: You have to f ~ile a legal ' instrument- to
abandone it.
MR.~'AX!EN~ That doesn't- have to be done.
MR%~ UNKELBACH: It Will have to be done if someone searches
the title.
MR. AX/dEN: There isa deed 'that states when or if it: at
'this point-this road touches and goes into a public highway this
Will cease.
HERRY~"SMITH: When the Town accepted_this, this wall all
abandoned.
· MR,' UNKELBACH: Has- an abandonment been' filed in' the County
'Clerk' s ~OEfice ~"
MR. SMITH: Yes. This road will continue to go through
there.
~A discussion was held on the question of 'the rightof
way,, and who had right of way to what property.)
THE~ CHAIRMAN: We~will recess the hearing at this point
until this matter' can be settled. When the-matter is settled
we will~ke up the hearing again at our next regular meeting.

Mr. Harold'Reese appeared before-the Boardwith a plan for
a parcel of land located off'Silvermere Road, Greenport. Mr.
Reese wanted to know if it'would be permissible to run a.road
down,he middle or, this property. Said road~would'.runparallel
to and be 300 feet south of the Main R~ad. On motion by Mr.
Coyle~ sdconded by'Mr..Unkelbach~ and unamieusly carried, it
was agreed this proposal be approved.
Mess=s: Richard A. Sheldon, Louis Ferr&tti, &'William
Jessup appeared before the Board with a preliminary subdivision plan
on propertytocat~d on the east side Cox~Lane~ Cutchoguea New
York. The plan shOWed 121 building lots on ,the parcel. The
three lots on the existing road would only.be 12~500 square
feet in area. These wouldnotbe inciudedin the filed
subdivision:map. The map did not show a 100 foot turnaround.
Instead the 100 foot dead-end,as angled. It was suggested
that'possibly there will have to be fewer lots and make the
i00 foot' turnaround and t_helots on the,existing street larger
to be made part of'the filed subdivision map. TheChairman
advised that_the Planni~ Board would have to check with the
Superintendent of Highways on the question of the turnaround
and they will advise '_the applicants ofthe ~etermina~ion.
A delegation~of property owners from the' Deep HoleCreek
area in Mattituck~ appeared before the Planning Board. Nrc.
Harold'L. Crowell~ 2850~Deep Hole Drive was the spokesman for
the group. The major'complaint concerned the ~ain pipes of
Mr. Zaleski. It sccms the water is
land in-Deep'Hole'~reek-Estates onto the
onDeep'Hole Drive~ which is a Town Road.

destroyed. It,was felt this condition was a public hazard on
the road corner'beacuse of the skid, The road is also~collasping
on the side. It was also reported that it :was proposed that
a marina for'71 boats was to be, put in Deep Hole' Creek. Everyone
present was assured that this woul~notbe permissible. The-residents
were advised that the Subdivision was presently under bond and
the bond has not, run out. Mr. Zaleski has ~other year and one
half to complete all improvements in the subdivision. The residents
were-assured that~the Planning Board would have Mr. Lawrence Tuthilla
P.E. Construction inspector make a progress report and advise the

A COl~e of the following letter was received from the
Southold Town Trustees:

matter.

2. A continuing program for improvement and expansion of
public beaches, parks and playgrounds,~launching ramps, improved
docking 'facilities,. possible town marin~s, etc.
3.-Purchase of well fields for furture public water supply;
including all aVa/lalbe land on Laurel Lake.
4.~ Creation of-water districts and capital funds for each.
