ACTION OF THE BOARD OF APPEALS
Appl. No. 4140.
Upon Application of JOHN CROKOS for a Variance to the Zoning
Ordinance, Article XXIII, Section 100-239.4A(1) for permission to
locate structures within 100 feet of the top of the bluff along
the Long Island Sound. Location of Property: 2110 Grandview
Drive, Orient, NY; County Tax Map Parcel No. 1000-14-2-3.11.
WHEREAS, public hearings were held on January 14, 1993 and
February 23, 1993, at which time all those who desired to be
heard were heard and their testimony recorded; and
WHEREAS, the Board has carefully considered all testimony
and documentation submitted concerning this application;
WHEREAS, Board Members have personally viewed and are
familiar with the premises in question, its present zoning, and
the surrounding areas; and
WHEREAS, the Board made the following findings of fact:
1. AREA VARIANCE. This is an application received Novem-
ber 24, 1992 for a Variance under Article XXIII, Section
100-239.4, subsection A(1), for approval of new construction
within 100 feet of the bluff, or bank, along the Long Island
Sound. The Building Inspector's Notice of Disapproval upon which
this appeal is based is dated November 18, 1992.
2. CODE REQUIREMENT. Article XXIII, Section 100-239.4A of
the Zoning Code requires all buildings and structures located on
lots upon which there exists a bluff or bank landward of the
shore or beach of shall be set back not less than one hundred
(100) feet from the top of such bluff or bank.
3. PROPERTY DATA. The premises in question is situated
north of Grand View Drive in Orient and is shown as Lot #7 on the
Major Subdivision Map of Grand View Estates. This parcel
contains a total lot area of 42,134 sq. ft. and is presen~¥

vacant. Areas seaward of the Coastal Zone boundary line (near
the top of the bank) are unbuildable, which lends to the
limitations for building while meeting all other zoning code
requirements.
4. PROPOSAL. Proposed in this application are requests to
locate the northwesterly corner of a proposed dwelling with patio
and deck areas above natural grade, inground swimmingpool, and
landscape areas with retaining walls, all within 100 feet of the
top of the bluff (bank) along the Long Island Sound {see site
plan map dated October 14, 1992 by Keller-Sandgren Associates).
The setbacks at their shortest distances under consideration in
this application are shown at 50 feet to the outside patio area
of the proposed pool, 30+- feet to the fence enclosure north of
the same patio area, and 54 feet to the closest corner of the
swimming pool. The dwelling as proposed is situated on an angle
(northwest), rather than parallel with the bluff or northerly
property angles, which creates the need for a variance at the
northeast corner of the house of up to 5-1/2 or six feet.
5. SITE INSPECTION(S).
(a) An inspection of the site reveals that most of the
bluff face is stabilized by shrubs. From the street, the lot's
elevation rises several feet and flattens out over most of the
land, 25 to 26 feet above mea sea level. There is presently a
slight berm across the bluff top edge; the existing grade is
away from the bluff face. The bluff areas must be protected, and
regrading and new landscaped areas must be done to keep surface
water runoff directed away from the bluff face. A continued low
berm at the top edge would help to ensure no over-bank runoff.
Also, measures will need to be taken to either truck the pool
water off site, or properly install dr!;well drains.
(b) Research of town records shows that there are other
lots in the area with nonconforming setbacks in the immediate
vicinity; i.e. Lot 5 (Monacelli) for construction at 80+- feet
from the top of the bank; Lot 3.8 (Hungerford) at 80 - 85+-
feet; Lot 24 (Cipitelli Bros. Realty) 70+- feet; Lot 3.9
(formerly Betancourt) at 50+- feet.
6. OTHER TOWN AGENCY JURISDICTION/REVIEW. Correspondence
has been received from the Office of the Town Trustees confirming
that the addition as proposed is not within their jurisdiction
under either the Coastal Erosion Hazard Act (Ch. 37) or the Town
Wetland Ordinance (Ch. 97).
7. EFFECTS OF RELIEF REQUESTED. It is the position of this
Board that in considering the relief requested and more

particularly shown on the October 14, 1992 site plan (as modified
from the October 14, 1992 landscaping plan), that:
(a) the setback at 54 feet is substantial in relation
to the requirements, that is, 46 percent of the requirement;
(b) the grant of the entire relief will, in turn set a
precedent, and will alter the essential character of the
neighborhood;
(c) the difficulties are uniquely related to the
property and its topography, and the difficulties claimed are
not personal to the landowner;
(d) the difficulties claimed have not been created by
the landowner - the lot preexists the enactment of this zoning
requirement;
(e) the amount of relief requested would in turn be
adverse to the safety, health, welfare, comfort, convenience or
order of the town, or be adverse to neighboring properties;
(f) there is an alternative for appellant to pursue,
as noted below, for lesser relief (greater setbacks);
(g) in view of all the above, the interests of justice
will be served by denying the relief, as requested.
8. ALTERNATIVE. Alternatively, the Board finds that a
setback restriction at not closer than 75 feet to the top of the
bluff (bank) for all structures, retaining walls, and buildings,
would be more feasible and is reasonably available for applicant
to pursue.
9. EFFECTS OF ALTERNATIVE. It is the position of the Board
that in considering this alternative:
a) the benefit to the applicant, as weighed against the
detriment to the health, safety, welfare of the community, is
greater, and is not unreasonable in light of limited upland area
available for residential use;
b) the benefit sought by the applicant cannot be
achieved by a method, feasible for his to pursue, other than an
area variance;
c) the alternative relief is not substantial in
relation to the requirements;

d) the relief requested will not have an adverse effect
or impact on the physical or environmental conditions in the
neighborhood or district;
e) the difficulties created are related to the
uniqueness of the land and are not personal to the landowner;
f) the relief as alternatively granted will not be
adverse to the preservation and protection of the character of
the neighborhood and the health, safety, and welfare of the
community.
Accordingly, on motion by Member Dinizie, seconded by
Member Wilton, it was
RESOLVED, to DENY the relief requested in the application,
and be it further
RESOLVED, to GRANT alternative relieffor a minimum setback
at 75 feet from the top of the bluff (bank) to all structures,
retaining walls and buildings, SUBJECT TOT HE FOLLOWING:
1. That the drywells be installed for proper discharge of
pool water; no pool water or roof runoff shall not be discharged
towards the bluff face and all water shall be properly contained
(or removed);
2. That the relief alternatively granted is limited to this
particular application made under Section 100-239.4A of the
zoning code as pertains to the bluff setback (and shall not apply
to side yard reductions, lot coverage in excess of 20%, or other
variations from the code in the event of future code modifica-
tions).
3. That there be no land disturbance to or close to the
bluff (bank) area, and that hay bales shall be temporarily placed
north of the area under construction while construction
activities are pending.

implementing regulations pertaining to Article 8 of the N.Y.S.
Environmental Quality Review Act of the Environmental
Conservation Law and Local Law #44-4 of the Town of Southold.
An Environmental Assessment (Short) Form has been
submitted; however, Section 617.13 of 6 NYCRR Part 616, and
Section 8-0113 of the Environmental Conservation Law, this
variance application falls under the Type II classification as
established by law. Further, this Department may not be an
involved agency under SEQRA {Section 617.13(a) as amended
February 14, 1990).
Although this action is classified as Type II for this
variance application under SEQRA {specifically 617.13, 616.3(j),
and 617.2(jj)}, this determination shall have no affect upon any
other agency's interest or SEQRA determination as an involved
agency.

rendered Tuesday night by the Board following the public

Department for issuance of appropriate permits or other
documents before commencing construction activities. A copy of

MR. SANDGREN: We have not in any way changed the site
plan since the Board has reviewed it.
THE CHAIRMAN: All right. We had our Town Engineer
review the plan, and he just --There is a little bit of a
difference in interpretation-- We just got this.
MR. SANDGREN (receiving paper referred to): Fine.
THE CHAIRMAN: It is nothing. You can either comment
by mail or after you look at it.
MR. SANDGREN: I see.

THE CHAIRMAN: I just wanted to mention to you that
sometimes in situations like this it becomes all-encompassing
for us to digest a plan of this magnitude, okay. And --I am not
trying to be redundant or evasive or anything of that nature.
Certainly the ultimate scenario for us would be --or the Utopian
scenario would be, to build the house, to build the rear yard
porches and garden area, and then to add the pool --because then
we could actually digest the whole plan at that point because it
is a very extensive plan; it is a very beautiful piece of
property, and it is a very beautiful house from what we can see,
as I mentioned the last time. So we will do the best we can in
what I can tell you in setbacks at this point; and if for any
reason the setback restrictions are more severe on the bluff
side, I might suggest to you that you hold in abeyance the
construction of the pool until the house is built, and then you
come back with that, and we will be able to see it. What I am
saying to you is, you presented us the entire application; we
will deal with the entire application. We will as five members
of this Board so empowered by the Town Board, as we sit in this
position, that we have a diversity of feelings concerning
projects of this magnitude, and there may be significant
setbacks, you know, in reference to placement of the pool at
this time because of the magnitude of it. But we will see what
happens. Just so that you understand that because you have been
very gracious in coming in twice, and we appreciate that.

out the pool and really evaluating the views from the home at

getting a permit to place the home, and then come in under a
separate permit for pool and terraces--

Dear Mr. Goehringer:
We have completed a site inspection at the parcel known as Lot #7 in the
development of the Grand View Estates Subdivision.
The bluff face appears to be well stabilized by shrubs covering nearly the
entire face. There is a footpath worn into the bluff face leading down to the
beach. The toe of the bluff does not appear to be affected by the high tide
line which doesn't reach the toe. From the street the lot's elevation rises several
feet and flattens out over most of it. There is a slight berm across the bluff
top edge. The existing grade is away from the bluff face.
To protect the bluff face from the foot traffic, stairs should be designed by a
professional engineer, and installed according to design. Care must be taken
to disturb a minimum amount of the existing vegetation. Any regrading should
keep surface water runoff directed away from the bluff face. A low berm at the
top edge would ensure no overbank runoff.
Provisions should also be made to dispose of the pool water. A drywell drain
could be installed for this purpose.

Answer:
The property has a configuration of a rectangle, with the shorter sides touching the
water the north and the access road to the south. This configuration precludes us
from consideration of a pool and terrace area on either side of the residence. We
therefore have designed a pool and terrace area in the rear yard. Although we have
made all efforts to minimize this area, the closest point of terrace comes within 50
feet of the bluff line. This area is all to the land side of the coastal erosion hazard
line.

application before the public is a setback from the existing lip
of the bluff, and this application will be held in abeyance
pending Trustees' approval for anyone that would like to come

coastal erosion hazard line.

MR. SANDGREN (continuing): And, therefore, at this
point we feel that this is, that we are far enough back from the
actual line here and should be in good shape as far as the
stabilization of this land. We have also contacted the firm of
Land Use Company, who will be working on a maintenance program
for the bluff over time. Also attached are some exteriors of
the home, if you wish to look at them.
THE CHAIRMAN: I have a million questions. Do you
want to ask any questions first, Bob?

THE CHAIRMAN: We have, Mr.
Sandgren --first of all,
is a magnificent house. No question about it. A magnificent

piece of property. It is the type of property that, no matter
what day you are out there, it is magnificent. I was out there
on a day like today, and it is still magnificent.
Conceivably,we would do whatever we can to work with you and we
want to work with you on this basis. We do have certain
precedents that we deal with in reference to setbacks and, as
you know as I mentioned in the inception of this hearing, that
we are going to hold this in abeyance for a short period of time
until the Trustees make a decision. My main concerns are --I
know we have a 4,200 plus or minus square-foot house, so are we
talking--
MR. SANDGREN: The area of the footprint and
terraces in all were about 9.8 per cent lot coverage.
THE CHAIRMAN: Anything that is a blade of grass above
elevation I would like you to construe to be lot coverage
because it really is.
MR. SANDGREN:

Yes, I agree.
And so that we don't have any further
problems in reference to determining lot coverage and
understanding the lot coverage, because the worst possible
scenario would be to grant the application and then have you
come back for all the accessory stuff. Or to be deprived of a
portion of the accessory structure stuff, you know, that would
be involved in something. So the figures that you are giving us
include all of the lot coverage, all the decks, cement and pool
area.

MR. SANDGREN: Right. The reason why we proceeded
by doing this, including a landscape designer, who has worked
out the terraces and pool --primarily, just for that reason,
that we didn't want to do just a part of this project and then
later on figure out what we were going to do with the terraces.
We wanted to get the full picture to the Town of Southold so we
didn't have any after-the-fact kind of things happen. So that
this is ALL that we intend to do on the property.
THE CHAIRMAN: We have not deliberated upon this at
all. We have visited. We looked at the plan. We have gone out
and looked at the property. By the time we finish here, there
may be some modifications in reference to setback. That's all I
can tell you at this particular time. I know this is about the
third redraft that you have done in reference to putting
everything into a more condensed version; is that correct?
MR. SANDGREN: That is correct.
THE CHAIRMAN: This was during the process you were
actually filing, during the Christmas holiday?
MR. SANDGREN: That's right.
THE CHAIRMAN: There may come a time and I am only
mentioning this to you -- that we may require that the pool in
some way be placed a little closer to the house or a little over
to one side a little more or whatever the case might be, so as

to create a greater depth in reference to its proximity to the
lip of the bluff.

Dear Mr. Pauzer:
Our office has an application under review which involves
the proposed construction of an inground swi~ingpool and
landscaping bulkhead structures landward of the pool contiguous
to the north side of the proposed dwelling. Enclosed is a
reduced copy of a map of the proposed construction and its
location (with property contour lines shown), and a copy of the
County Tax Map showing the vicinity of the subject parcel. This
property is presently vacant and is referred to as Lot #7 in the
development of Grand View Estates Subdivision.
May we ask your department's assessment of the property and
the history and possible effects on erosion and stability of the
area of the proposed pool.
A determination on this variance request is not expected to
be made until February or March 1993 (at the earliest).

Dear Mr. Sandgren:
As confirmed with you yesterday afternoon, the
documentation, delivered by priority mail yesterday at noon, was
not able to be advertised for a (final) hearing.
In reviewing the reduced photocopy of a map, it was found
that:
(1) there is no guarantee that a side yard variance
would not also be necessary for the diving board and areas of
construction above grade that are shown presently to be within
the required side yards. Alternatively, an amended rough
Sketch could be submitted to comply with the side yards and the
50 ft. front yard setback designation, rather than a 40 ft~
front yard designation}
(2) the loeation and type of fence enclosure around
the pool yard area must be shown on the sketch;
(3) the distance and proposed elevations of the
patios, decks, steps, walkways, etc. which are located within
the 100 ft. bluff setback restriction and within the 20 and 15
ft. side yard restrictions, will be needed;
(4) seven original prints, to scale, of all maps
including the elevation sketches are needed;
~(5) original postmarked receipts at the time of
mailing the neighbor notices were not furnished and are needed.
In the event your client chooses to proceed with a sideyard
variance for the divingboard area, please obtain a new Notice
of Disapproval from the Building Inspector and submit a copy to

us with the new (updated) appeal documents. (The filing fee for
two or more areas of relief is presently $500.00 instead of the
initial $300.00.) Or, if you are not going to apply for side
yard relief, we will await transmittal by you of seven (7)
original prints of the elevation and site layout maps, as noted
above, together a copy of the updated Notice of Disapproval
which would be based on the new map (and certified mail
receipts).
Please submit the above if possible before Monday, Decem-
ber 14, 1992 in order that the inspection process may be
commenced before the January hearings calendar and possibly a
determination in January as well.

2. Application, typed or neatly written, signed and notarized:
a. Article and Sections of the Code must be printed in detail
b. Describe permission or relief on bottom of first page.
c. Street Address, Name of Subdivision (if any), County Tax Map
Number (all from Notice of Disapproval).
d. Zone District (from Building Inspector's Office).
e. Current owners' names and addresses. Persons other than owners

Disclosure if a corporation, partnership or other entity.
f. Describe difficulties or hardship due to strict compliance with
the zoning regulations. (Side 2)
(g. Special Exception Form ZB2 must include use~ and activities
existing as well as those proposed, in addition to maps.
h. Sign applications must include general wording of sign,
dimensions, height from ground, location with distances to
property lines, written permission from property owner.)
3. Notice to Adjoining Property Owners Form:
a. Confirm current adjoining landowner names and addresses with
Assessors Office. (Notice must also be given to owners of
private rights-of-way.)
b. Send copies of this form by certified mail to each adjoining
landowner (with front side completed) together with copy of your
map or sketch.
c. Receipts must be postmarked by Post Office at time of mailing.
d. Return original form, with reverse side completed, signed and
notarized, to ZBA office with postmarked mail receipts.
Environmental Assessment Form (Short or Long Form) completed and

will be necessary.}
5. Z.B.A. Questionnaire. {If "yes" box is checked, please furnish
additional information.} Please complete and sign.
6. Copies of: (a) sketch/building floor plan, height of structure
Please include location of entrance doors; (b) current or
available Certificate of Occumancv from Building Department;
(c) current deeds are necessary f~r subdivision projects or
new dwelling projects.
Original and three prints of a survey (or other certified map
to scale, showing showing all setbacks of existing and proposed
structures, patios, driveways, wetland areas, square footage and
dimensions of lot, dimensions of new construction, fences~ tanks,
overhangs, chimneys, etc. (If your project involves total lot
coverage at more than 20% of the area of the lot, please provide
~ lot and building calculations.)
8. If new construction is proposed at this time, please flag
outside cornersfor on-site inspections as early as possible.
Photographs of flagged construction areas should be submitted at
least 14 days before the expected hearing date.

9. Filing fee check payable to the "Southold Town Clerk." (A copy

review and receipt of all the above documentation. Written notification of
the hearing date will be confirmed by mail by way of a Copy of the Legal
Notice (as advertised in the L.I. Traveler-Watchman and Suffolk Times
newspapers). If your project:
(a) involves freshwater or saltwater wetland areas, please be
sure to file applications to the Town Trustees and N.Y.S. Department of
Environmental Conservation {subdivisions included} and provide proof of
filing and a copy of the SEQRA determination, when available;
(b) abuts other property you own, please provide us with
copies of all deeds {a single-and-separate title search for substandard

(c) involves a lot-line change, increase in density, or

We reviewed the map in the above project (which was courteously
furnished this morning to us by Gary). Unfortunately, the map
shows that the side yards are not at the required 20 and ~5 feet
on this 42,000+ sq. ft. parcel, that the front yard may be less
than 50 feet for all raised construction, including raised
patios, steps at more than 48 sq. ft., walkways, etc., and that
the fence enclosure is not shown.
John Sangren was contacted and indicated that their office would
be doing a new schematic (rough drawing) for re-submission to
the Building Department - possibly for a side yard ~ariance as
well as a new bluff setback.
When a new or amended Notice of Disapproval is issued, please
forward a copy of the lot calculations (for lot coverage) when
available for all raised construction for record purposes.
The application which was submitted based on the Notice of
Disapproval was found deficient and returned to the applicant.
