A regular meeting of the Soutkid Town Planning Board
was held at'7:30 P.M., Tuesday, October 3, 1967~ at-the
Town Office, Main Road, Southold, New York.
There were present: Messrs: John. Wickham~ Chairman;
Henry'Moisa, WilliamUnkelbach, Frank~Coyle~ Alfred Grebe.
Also present: Otto W. Van Tuyl, Consultant; Lawrence
TuthilI, Construction Engineer.
Lefferts P. Edson,-Esq. appea=ed'~efore the Board in

On motinn by'Mr. Coyle, seconded by'Mr. Grebe, it was
RESOLVED the'Chairman of the Southold Town Planning Board
be authorized to sign the final subdivision maps of Peconic
Homes, Section II, located at Peconic, New York, owned and
developed by Henry J. Smith, when the letters of approval of the
roads from. Lawrence Tuthill, and Raymond Dean are in the files
of the'Planning Board, and when said approvals are accepted by
the Southold Town Board.
Vote of the Board~- Ayes:- Mr. Wickham, Mr. Moisa, Mr.
Unkelbach, Mr.~ Coyle, Mr. Grebe.
Mr. George Barzac, Jr., appeared before the Planning Board
with a sketch plan for~a subdivision located on the east side
Boisseau Avenue, Southold, New York. The area involved' in this
plan is approximately 12 acres. The map showed an area of the
property.not included in the subdivision plan. Mr. Barzac felt
this was not suitable for residence since it was adjoining
Cassidy property~ however if the Planning Board'felt this should
be included it could be done. The sketch plan showed 18 lots.
The Planning Board does not like to see an oversize lot left
over because at some future date someone might want to divide
the property into two lots and there would be a problem of
access to the second lot. It was suggested that'the park area
be-enlarged so that an oversized lot is notleft. ~Mr. Van
Tuyl showed-and overall plan of the adjoining properties, indicating
aceess to Sawicki's property and Moffat's property.
Mr. Barzac was advised that he should file a preliminary
application for the iproperty under question. Mr. Barzac stated
he w~uld like to,art building a~speculation house on one of
the lots faclng, Boisseau Avenue. The~ Board advisedthat nothing
shQuld'beconstructed until more definit lot lines are
established.
The Southold town Planning Board received from the
Southold Town Board the original petition of Helmut Hass of
North Road, Greenport, New York, relative to a change of
zone from "A" Residential and Agricultural District to "B"
Business District on certain property situated in Peconic,
New York, with the instructions to prepare and official
report and define the conditions described therein.

This property is descxibed as follows:
Ail that'certain peice or~arcel of land si.t~uated at
Peconic in the Town of~Southold, SuffOlk County, New York
and more particularly bounded and described as follows:
BEGINNING at a point'on the southerly line of Middle
Road, as~widened, at the northeasterly corner of land of the~wW~
party of the first part, said point of beginning being about
1400 feet easterly along said southerly line from'Carroll Avenue;
from said point of beginning running along land of~Charles
Hubbard and along land of Suffolk CountY, $. 23° 53' 30" E.-
437.10 feet; thence along land of t~e party of the first part,
two courses as fDllows: ~1) S. 58° 30' 30" W.- 100.29..feet; thence
(2) N. 23° 53' 30" W.- 439.53 feet to said southerly line of
Middle Road (as widened); thence northeasterly along said south-
erly line on a curve to the left, having a radius of 5789.58
feet, a distance of 100.0 feet to the point of beginning, containing
1.00 acre.
The Board held a lenghty discussion on the property in
question. It was felt this woul~ be spo~ zoning;and the fact-that
~property adjoins Long Island Railroad property, characterized
as Industrial property, should not be andetermining factor in
view of the fact the Long Island Railroad is a special franchise.
The Beard looked at'the maps showing what the County was taken
for the widening of County'Road 27.
On motion by Mr. Moisa, seconded by Mr. Grebe, it was
RESOLVED that the Southold Town Planning Board does not
favorably recommend to the Southold Town Board the change of
zone from "A" Residential and Agricultural District to "B"
Business District on the above described property.
The Planning Board is not willing tb recommend a business
zone on the south side of'County Road $27, even under the
circumstances described in the petition. It is thePlanning
Board's feeling that County'Road 27 should be maintained as
a high-spDed arterial without business build-up except'in
areas such as Mattituck, Southold, and in the ~m~%ediate vicinity
of Peconic Lane, Peconic. As a matter of fact, Mr. Clarke,
who lives on the north side of County Road $27, about-where this
property is located, presented a request for a business zone some
time ago and we refused to recommend that. Regardless of the spot

zoning question, if a small business zone is established in this
vicinity, we can logically'expect a tremendous expanded business
area adjacent to this within two or-three years.
Vote ofthe Board: Ayes:- Fir. Wickham, Mr. Moisa,

Fir. Coyle abstained from voting.
The Southold Town Planning Board received from the To~n
Board the oziginal petition of John Geieri North Road, Greenport~
New'York, relative to a change;of zone from "A" Residential and
Agricultural Districtto "B" Business District, on certain
property situated at Greenport, New York, with the instructions
to prepare an official reportdefining 'the conditions described
therein.
This property is described as follows:
All that certain tract, piece, or parcel of'land
situated at Greenport, Town of Southold, County'of
Suffolk, State of Nz~ York, and more particularly bounded
and described as follows:
BEGINNING at a point on the southerly'side of Middle
Road ~.R.'127) North Road,~ where the same is intersected by
the westerly"side of land now or formerly'of Village~of'Green-
port, which'-point is distant~ 350.68 feet westerly fromthe
corner formed by the intersection Of the .southerly side-of said
Middle Road with the westerly side of Moore's Lane, and
from said point ofbeginning., running thence along said'land
south 4° 01' 10" east, 1106.60 feet; running thence still along
said land smth 84° 53' 30"'west, 474..24 feet; running thence

The Board briefly discussed this application.

On motion by Mr. Unkelbach, seconded by Mr. Moisa, it was
RESOLVED t~at the Southold Town Planning Board does not
favorably'recommend to the Southold Town Boardthe change of
zone from "A" Residential and Agricultural Districtto "B"
B,~ness propertyon the above described property.
The Planning Board is unwilling to recommend this change
fof zon~ because the application is for the wrong zoning for
the type of business intended. This change w~uld constitute
spot zoning, and the~Planning Board feels the parcel in question
is too large to be considered under this application.

The Planning Board received from the Town'Board the

Agricultural District to "B" Business'District on certain
real property situated at Greenport, New York, and are
instructed to prepare an official report defining the
conditions described therein/
This property is described as follows:

situated at Greenport in the Town of Southold, County
of Suffolk, and State of New York, and more particularly
bounded and describe~ as follows:
BEGINNING at a monument on the northerlyline of NortNm
Road, adjoining land of'the Village of Greenport; from said

Greenport three courses : ('1) north 33° 47~ 30" west, 373.04
feet to a monument; thence (2) north 4° 23' 20" east, 154.46

On motion by Mr. Moisa, seconded by Mr. Unkelbach, it was
RESOLVED that the Southold Town PlanningBoard does not
favorably recommend to ~he~Southold Town Board thechangeof
zone from "A" Residential and'Agricultural District to "B"
Bu,~iness District on the above described property.
The Planning Bc~rd is of the opinion itwould be a mistake
to establish a business zone adjoining the property of the ~illage
of Greenport, and the residen~ally zoned property. This, of
course, would be spot'zoning.
The Planning Board also points out that't~e County Road
will probably~be subject~to ~ide~gat some future date in
this particular area.

On motion by Fir. Moisa, seconded by Mr. Unkelbach, it-was
RESOLVED that the'Southold Town Planning Board does
favorablyrecommend to the Southold Town Board the~change
~ofZone from "A" Residential a~ndAgricultuKal Dist=ict to
"C" Industrial District on the above described property,
The Board agrees with the reasons for a ch~ge of
zone as presented in the petition.
Vote of the Board: Ayes: - Mr. Wickham, Mr. Moisa,
Mr. Unkelbach, Mr. Coyle, Mr. Grebe.
Mr.~ Lawrence Tuthill, P.E. , Construction Engineer, presented
the following letter to the Southold .Town Planning Board:

"Gentlemen:-I have inspected the roads of Peconic Homes,
Section II and have found them to meet the specifi~atioh of the
Planning Board.
"Respectfully submitted, /s/ Lawrence M. Tuthill."
On motion'by'Mr. Moisa, -seconded by Mr. Unkelbach, it was
RESOLVED that the Southold Town Planning Board =ecommend
to the Southold Town Board that the Bond for-the roads in
Peconic Homes.,-Section II, Peconic, New York, owned and developed
by Henry'Smith, be waived.

On motion by Mr.- Coyle, seconded by' Mr. Unkelbach, it was
RESOLVED that Henry Moisa be known as the official vice-
Chairman of the' Southold Town Planning Board.
Ayes:- Mr. Wickham, Mr. Unkelbach, Mr.~e~e, Mr. Coyle.
Mr. Lawrence Tuthill, P.E., Construction Engineer
presented the following letter to the Planning Board:
"Southold Town Planning Board, Southold, New York,
October 3, 1967.
"Re: Fordham Acres Sec. II
"Gentlemen: I have inspected the roads of Fordham
Acres Sec. II and have found them to meet the specifications of
the Planning Board.

On motion by Mr, unkelbach, seconded by Mr. Moisa, it was
RESOLVED that the Southold TownI Planning Board recommed
to the Southold Town Board that they release the performance
bond on Fordham Acres, Section II, Greenport, New York, owned
a nd developed by Ruth Preston, and Others, subject to receiving
a letter of approval from the Superintendent of Highways.
Vote of'the Board: Ayes.:- Mr. Wickham, Mr. Moisa, Mr.
Unkelbach, Mr. Coyle, Mr. Grebe.
On motion by Mr. unkelbach, seconded by Mr. Coyle, it was
RESOLVED that the minutes of the~ Southold Town Planning
Board ~ated September 6, 1967, be approved as submitted.

Mr. Grebe ~resented a map of land located on Fishers
Island, New York, known as the Pennisula. There is an
existing temporary road shown on themap. There was~a question
of access to certain, lots. The present owner of the property,
Fir. Elbert Burr, wishes to sell off lots in this area. The
following letter was written~to Mr. Burr:
Dear Mr. Burr:
The Planning Board has looked over your~map of the
Penninsula, Fishers Island, New York, dated 1913~ revised
October, 1951; revised July, 1953; and revised September
1967.
The Board has determined that this map is so obsolete that
a new map must be filed before any further division of land is
made. All lots will have to have frontage of at least 100 feet
on the access road and meet the minimum area requirements.
(12,500 square feet~with adequate public water, or,20,000 square
feet without public water). All roads mustbe cleared and
improved at least to 20 feet wide, possible wider depen4ing on
the final number of lots involved.
The New YorkState Real Property ~aw requires the filing
of a map prior to the sale of lots, and the Town of'Southotd
has justrevised their Rules and Regulations for the Subdivision
of Lan~. All property division and sales from October 1, 1967,
are subject to these requirements. No building permits wiltbe
issued without this approval.
In the Matter of M_r. Burnham's lot, the Board recognizes
prior ownership and will recommend ~hat the Board of Appeals
handle the approval of access to this single lot under the
provisions of'the New York State Town Law, Section 280A, with
a mininum road width of 20 feet, cleared and graded.
Mr. Van' Tuyl presented a revised subdivision plan for
RichardA.. Sheldon, Louis Ferretti, and Will amJessup on
property located on east side'Cox Lane, Cutchogue, New York.
This plan was very briefly diseussed, No action was taken on
the matter.

A plan for George Ahler's subdivision, was briefly discussed
and no action .was taken on the matter.
Mr. Van~Tuyl showed a sketch plan for subdivision of
property behind GardinersBay Estates, on Orchard Lane,
East Marion, New York. The Board D~iefly discussed this plan.
It was determined that any roads cut in wou~have to be at
least 50 feet-wide..
The next regular meeting of the $outhold Town Planning
Board-will be held at 7:30 P.M., Thursday, November 2, 1967,
at the Town office, Main Road, $o~thold, New York.
The meeting was ad3ourned at 10:00 P.E.
