Notice of Public Hearing to Consider Amending Town Code
{}330-245 (Evaluation Criteria and General Development
Standards) of Article XXVI (Planned Development District) to
Include the Water Mitigation Program Fund
RESOLVED, that the Town Board of the Town of Southampton hereby directs that a public
hearing shall be held on June 12, 2012, at 1:00 p.m., at Southampton Town Hall, 116
Hampton Road, Southampton, New York, to hear any and all persons either for or against a
local law entitled: "A LOCAL LAW amending Town Code {}330-245 (Evaluation Criteria and
General Development Standards) of Article XXV[ (Planned Development District) to include
the Water Mitigation Program Fund," which provides as follows:

A LOCAL LAW amending Town Code {}330-245 (Evaluation Criteria and General
Development Standards) of Article XXV[ (Planned Development District) to include the
Water Mitigation Program Fund.
BE TT ENACTED by the Town Board of the Town of Southampton as follows:
SECTTON 1. Legislative Tntent.
When addressing PDD's, or incentive zoning provisions, as authorized under Town Law
§261-b, the Town Board may advance the Town's specific physical, social and/or cultural
policies, in accordance with the Town's Comprehensive Plan and other community planning
mechanisms and land use techniques, for zoning incentives, such as "community benefits."
Currently, the Town Board is contemplating adding a provision to the Town Code, Chapter
75, to create a Water Mitigation Program Fund. The purpose of this local law is to include
the Water Mitigation Program Fund on the list of community benefit considerations, so that
contributions may be considered during the deliberative process.
SECTTON 2. Amendment.
Town Code §330-245(T) is hereby amended by deleting the stricken words and adding the
underlined words as follows:
§330-245. Evaluation criteria and general development standards.
I. Community benefit. For each PDD approved, the Town Board shall establish a
required community benefit(s) specific to the project. The required benefit(s) shall
be detailed in the resulting PDD legislation. Tn determining the community benefit
requirement for a proposed PDD, the Town Board shall consider:
(1) The benefit to the applicant of the proposed zone changes, above an as-of-right
project on the subject property;
(2) The value to the Town and hamlet of achieving the proposed development or

redevelopment project in the project location, including, but not limited to,
whether the project:
(a) Advances the goals of the Town's Comprehensive Plan and other adopted
plans relevant to the project location;
(b) Eliminates a nonconforming use;
(c) Meets an established community need;
(c) Tnvolves site rehabilitation or reclamation;
(e) Will set a model for future area development or redevelopment; or
(f) Stimulates desired economic development activity;
(3)
Community impacts anticipated as a result of the PDD that cannot be
mitigated through project design and traffic system improvements. Such
impacts include, but are not limited to, long-term costs of community services
and development inducing impacts;
(4) The cost to the applicant of providing the community benefit, with such costs
verified by independent, fair appraisals, professionally prepared estimates
and/or other relevant documentation as may be appropriate to the specific
benefit(s) under consideration;
(5)
Whether the project is in a school district with unredeemed Pine Barrens
credits. Tf so, priority shall be given to PBC redemption as all or part of the
required community benefit;
(6)
Whether the applicant proposes project features that would otherwise be
required of development on the subject property through the site plan,
subdivision, architectural, SEQRA, or other regulatory review process. Said
features shall not qualify as community benefits.
(7)
Whether affordable housing is an appropriate public benefit, that is, when
there is a demonstrated need in the hamlet where the project would be
located for the type of affordable units proposed.
(a) Tn making said determination, consideration shall be given to the need for
affordable housing in the particular hamlet, the appropriateness of the
proposed site, the environmental suitability of the site, and the protection
of community character;
(b)
Tn making said determination, the density incentive should not result in an
adverse impact on the affected school district or other special assessment
district.
(8)
Whether contribution to the Water Mitigation Program Fund
pursuant to Town Code Chapter 75 is appropriate. Tf so, priority shall be given
to contributing to this Fund as part of the required community benefit.

list of desired hamlet-specific community benefits, maintained by the
Department of Land Management, and prepared in accordance with community
input, and hamlet-specific priorities identified in the Comprehensive Plan
and/or other related studies. Said list shall not be exclusive.
(a) Where there are several alternative benefits being considered, the Town
Board shall consider the feasibility and timing of the implementation of
each, with priority being given to benefits that may be more readily
achieved.
SECTION 3. Authority.
The Town Board may amend Town Code §330-245 pursuant to Town Law §§261-b, 264,
and 265, as well as Municipal Home Rule Law §10(1)(ii)(d)(3).
SECTION 4. Severability.
Tf any section or subsection, paragraph, clause, phrase, or provision of this law shall be
judged invalid or held unconstitutional by any court of competent jurisdiction, any judgment
made thereby shall not affect the validity of this law as a whole or any part thereof other
than the part or provision so adjudged to be invalid or unconstitutional.
SECTION 5. Effective Date.
This Local Law shall take effect upon filing with the Secretary of State pursuant to Municipal
Home Rule Law.
AND BE TT FURTHER RESOLVED, that the Town Clerk is hereby directed to forward a copy of
the proposed law to the Southampton Town Planning Board as well as the Suffolk County
Planning Commission for their review and recommendations; and be it further

Assume Lead Agency and Issue Positive Declaration for the
Purpose of SEQRA Review for the Change of Zone
Application from Resort Waterfront Business (RWB) and
Motel Business (MTL) to Maritime Planned Development
District (MPDD) as it Relates to the Redevelopment of the
Canoe Place Inn (CPI) and Canal Property
WHEREAS, on February 23, 2012, the Town Board of the Town of Southampton received a
formal application for a Change of Zone to allow a Maritime Planned Development District
(MPDD) for the Canoe Place [nn site and the neighboring Canal Property, with an electronic
copy received on March 2, 2012; and
WHEREAS, the application requests the redevelopment of the Canoe Place [nn (CP[) site
(SCTM No's: 900-207-5-3 & 4), as well as the neighboring Canal Property, which consists of
four parcels located directly east of the Shinnecock Canal and north of Montauk Highway
(SCTM No's: 900-207-4-22.1, 23, 24 &25), and an Eastern Parcel, which consists of a
single parcel located east of North Shore Road (CR 39), and north of Montauk Highway
(SCTM No. 900-208-2-18.1); and
WHEREAS, specifically, the proposal seeks to rezone (i) the CP[ and Canal properties from
their Resort Waterfront Business (RWB) designations, to MPDD, and (ii) the Eastern Parcel
from Motel Business (MTL) to MPDD; and
WHEREAS, the proposed redevelopment of the CP[ site includes retaining all existing
buildings so that public access may be provided and renovating the CP[ building for use as
an inn with 20 units, a catering facility with a 300-person maximum room occupancy, a
210-seat restaurant with a 24-seat bar area, and the renovation of the five existing
cottages on the property for extended-stay guest units; the Canal Property is proposed to
be redeveloped with 40 high-quality townhouses with a clubhouse/amenity building, pool
and a private marina; the Eastern Parcel will contain a community sewage treatment
system to handle the proposed townhouse development; and
WHEREAS, the proposed Change of Zone is a Type [ Action pursuant to the State
Environmental Quality Review, and the regulating provisions of 6 NYCRR Part 617; and
WHEREAS, on March 27, 2012, by Resolution No. 433, the Town Board commenced the
SEQRA process to coordinate lead agency, and
WHEREAS, the following are deemed involved agencies:
1. Town Board of the Town of Southampton
2. Planning Board of the Town of Southampton
3. Suffolk County Department of Health Services
4. Suffolk County Department of Public Works

WHEREAS, the Town Clerk forwarded the Change of Zone/Maritime Planned Development
District application to all involved agencies for the purposes of determining Lead Agency for
SEQRA review, and
WHEREAS, no involved agency has responded to the coordination request or made
comments on the action at this time; and
WHEREAS, the proposed development may result in a significant adverse impact on the
environment, including re-grading activities and the removal or destruction of large
quantities of vegetation with installation of impervious paved surfaces- impacting soils,
watershed and groundwater resources; the impairment of the character or quality of
aesthetic resources or of the existing community or neighborhood character by the increase
in permitted density; significant adverse impacts on existing traffic patterns and carrying
capacity of the road system, and may result in development that is in sharp contrast to local
land use plans and goals; and
WHEREAS, pursuant to Article 8 of the Environmental Conservation Law (ECL § 8-0109),
"agencies shall use all practicable means to realize the policies and goals set forth in this
article, and shall act and choose alternatives which, consistent with social, economic and
other essential considerations, to the maximum extent practicable, minimize or avoid
adverse environmental effects, including effects revealed in the environmental impact
statement process"; and
WHEREAS, the Town Board as Lead Agency finds that the preparation of an Environmental
Tmpact Statement (ETS) will aid in the decision-making process which requires the balancing

of competing factors and is the best avenue to evaluate cumulative impacts and alternatives
pursuant to SEQRA guidelines; now therefore be it
RESOLVED, that the Town Board of the Town of Southampton hereby assumes Lead
Agency; and be it further
RESOLVED, that the Town Clerk is directed to notify all involved and interested agencies of
the Town Board's Lead Agency Status; and be it further
RESOLVED that the Town Board of the Town of Southampton as Lead Agency hereby adopts
a Positive Declaration pursuant to the State Environmental Quality Review Act and Chapter
157 of the Town Code; and be it further

Set Public Scoping Session for the Preparation of a Draft
Environmental Impact Statement (DEIS) in Connection with
the Change of Zone Application from Resort Waterfront
Business (RWB) and Motel Business (MTL) to Maritime
Planned Development District (MPDD) as it Relates to the
Redevelopment of the Canoe Place Inn (CPI) and Canal
Property
WHEREAS, on February 23, 2012, the Town Board of the Town of Southampton received a
formal application for a Change of Zone to allow a Maritime Planned Development District
(MPDD) for the Canoe Place Inn site and the neighboring Canal Property, with an electronic
copy received on March 2, 2012; and
WHEREAS, the application requests the redevelopment of the Canoe Place Inn (CPI) site
(SCTM No's: 900-207-5-3 &4), as well as the neighboring Canal Property, which consists of
four parcels located directly east of the Shinnecock Canal and north of Montauk Highway
(SCTM No's: 900-207-4-22.1, 23, 24 & 25), and an Eastern Parcel, which consists of a
single parcel located east of North Shore Road (CR 39), and north of Montauk Highway
(SCTM No. 900-208-2-18.1); and
WHEREAS, specifically, the proposal seeks to rezone (i) the CPI and Canal properties from
their Resort Waterfront Business (RWB) designations, to MPDD, and (ii) the Eastern Parcel
from Hotel Business (MTL) to MPDD; and
WHEREAS, the proposed redevelopment of the CPI site includes retaining all existing
buildings so that public access may be provided and renovating the CPI building for use as
an inn with 20 units, a catering facility with a 300-person maximum room occupancy, a
210-seat restaurant with a 24-seat bar area, and the renovation of the five existing
cottages on the property for extended-stay guest units; the Canal Property is proposed to
be redeveloped with 40 high-quality townhouses with a clubhouse/amenity building, pool
and private marina; the Eastern Parcel will contain a community sewage treatment system
to handle the proposed townhouse development; and
WHEREAS, the proposed Change of Zone is a Type I Action pursuant to the State
Environmental Quality Review, and the regulating provisions of 6 NYCRR Part 617; and
WHEREAS, on Hay 8, 2012, by Resolution No. 570 of 2012, the Town Board adopted a
Positive Declaration pursuant to the State Environmental Quality Review Act (SEQRA) and
Chapter 157 of the Town Code for this change of zone application; and
WHEREAS, pursuant to SEQRA regulations {}617.8, the Town Board may initiate 'scoping' to
focus the Environmental Impact Statement on potentially significant adverse impacts; and
WHEREAS, the applicant as project sponsor must submit a draft scope that contains the

items identified in SEQRA paragraphs §617.8(0 (1) through (5) to the lead agency; and
WHEREAS, the applicant, R Squared Development LLC, has submitted a "draft scoping
document" pursuant to SEQRA §617.8; and
WHEREAS, scoping for the Draft ETS is found to be appropriate, as this process provides an
opportunity to identify the issues to be considered and how they should be analyzed to
ensure that the Draft ETS is a concise, accurate, and comprehensive document that covers
all concerns and issues for public and agency review in an appropriate method and level of
detail; now therefore be it
RESOLVED, that the Town Board as lead agency elects to have Scoping in connection with
the preparation of a Draft Environmental Tmpact Statement (DETS) for the Zone Change
application from Resort Waterfront Business (RWB) and Motel Business (MTL) as it Relates
to the Redevelopment of the Canoe Place Tnn (CPT) and Canal Property; and be it further
RESOLVED, to ensure that the relevant concerns of all involved and interested agencies are
included in the draft ETS, the Town Clerk is directed to forward this resolution and the draft
scoping documents to those agencies identified in the Positive Declaration resolution of May
8, 2012 for their review and recommendations; and be it further
