SUBJECT TO an easement of right of way granted and conveyed to John Fallon
and Marilyn Susan Fallon, owners of a parcel of property adjoining the above-
described property on the northeast, for the free non-exclusive access,
passage, ingress and egress of John Fallon and Marilyn Susan Fallon, their
successors and assigns, from Peconic Bay Boulevard to lands now or formerly
of Fallon over a part of the property being conveyed as follows:
All that certain plot, piece or parcel of land situate lying and being
in Laurel, in the Town of Southold, County of Suffolk and described as follows:
BEGINNING at a point on the northern side of Peconic Bay Boulevard
which point of beginning is situate at the following two courses and distances
from a concrete monument set at the intersection of the division line between
the land being conveyed and land of the Nature Conservancy with the 'northerly
line of Peconic Bay Boulevard and from said concrete monument RUNNING THENCE
(1) North 32 degrees 32 minutes 50 seconds East 54.73 feet to a point; and
(2) North 62 degrees 39 minutes 50 seconds East 48.27 feet to the point or
place of BEGINNING. RUNNING THENCE North 58 degrees 12 minutes 10 seconds
West 38.16 feet to a point; THENCE North 16 degrees 29 minutes 30 seconds
West 150 feet to a point;
THENCE at right angles, North 73 degrees 30 minutes 30 seconds East
15 feet to the dividing line between lands now or formerly of Hickey and lands
now or formerly of Fallon; THENCE South 16 degrees 29 minutes 30 seconds East
144.28 feet to a point; THENCE South 58 degrees 12 minutes 10 seconds East
41.41 feet to a point on the northerly side of Peconic Bay Boulevard; THENCE
along said northerly side of Peconic Bay Boulevard South 62 degrees 39 minutes
50 seconds West 17 .47 feet to the point or place of BEGINNING.
This easement of right of way shall run with the lands benefitted and
burdened hereby and shall be superior and paramount to the rights of the
parties hereto in the servient estate so created.
SUBJECT to the rights of Martha Husing, as long as she may live, to the
use of said easement and a strip of land north of said easement 15 feet wide
and running along the dividing line between lands herein conveyed and lands
now or formerly of Fallon, running to the northeasterly corner of the lands
herein conveyed. Said rights shall consist of the unrestricted use of said
strip of land for the free, non-exclusive access, passage, ingress and
egress from her lands to the north of the premises being conveyed to Peconic
Bay Boulevard to the south of said premises.
